Board of Trustees
October 16, 2018
1. The meeting was called to order at 6:00pm.
2. Everyone stood for the Pledge to the Flag.
3. Upon roll call, the following Trustees were present: Trustee Harn, Trustee Dan
Mariscal, Trustee Diane Mariscal, Trustee Reichert, Trustee Goett, and Trustee Carter.
4. Minutes: Trustee Goett moved to approve the minutes for September 18th, 2018.
Trustee Dan Mariscal seconded the motion, which was approved by a vote of 6- 0.
5. Correspondence: Deputy Clerk Sarah Witbracht read a thank you letter from Julie
Bielfeldt thanking the board for the support for Open House in the Heights. She also
read a letter from Brian Johnson from GPSD thanking Mayor Phelan for taking time out
of his schedule to meet with him. She also read a letter from the Peoria Park District
asking for a favorable vote in selling Raccoon Lakes.
6. Announcements: Sarah Witbracht gave an update on the Halloween event.
7. Trustee Reports:
Public Works: Trustee Harn had nothing to report.
Administration/Personnel: Trustee Mariscal had Administrator Sutton give an update
on health insurance for village employees. He explained that next week a package will
be presented to the employees that will give them 3 options that will save the village
around $60,000.
Economic Development/Village Improvements: There was nothing to report.
Police: Trustee Carter had nothing to report.
Fire: Nothing to Report.
8. Comments from the Audience: Casey Kepple on behalf on Norman Gates stated that he
has some comments on the used car lot at 3707 Vincent. Tessie Bucklar read a letter
from the Economic Development Committee on behalf of the Zoning Board of Appeals
and stated that the Zoning Board of Appeals voted unanimously in favor of
recommending to the Village Board of Trustees an overlay district. Craig Masters stated
that the Zoning Board of Appeals has spent many hours putting their research and
labor into the overlay district presentation. He also stated the reasons as to why this
overlay district is so important to preserve our downtown business district.

Trustee Dan Mariscal made a motion to approve Ordinance 2018-1570; An Ordinance
Amending Title 10 of the Village Code of the Village of Peoria Heights for the Purpose
of Adding a New Chapter 11 Providing for Overlay Zoning Districts and Amending Title
11 of the Village Code in Order to Accommodate the Subdivision of Land in Accordance
with Regulations Applicable Within an Overlay Zoning District. Trustee Goett seconded
the motion. Chairman Rick Picl of the Zoning Board of Appeals and Co-Chair Cathy
Stevenson of the Zoning Board of Appeals came forward to state their support for the
overlay district and provide more information. They stated that an overlay district may
be placed in any corridor to help preserve what Peoria Heights already has. They
further added that it drives consistency and incentivizes developers to the area.
Trustee Harn inquired about the original ordinance and asked why the 1970’s code was
so different. Cathy Stevenson stated that it is crucial for Peoria Heights preserve the
land that it has being land-locked. Mayor Phelan added that this would create a higher
and better use of the property. Trustee Reichert had some questions about existing
businesses regarding renovations and requested a map showing the included parcels.
The motion approved 6-0. Trustee Dan Mariscal made a motion to approve Ordinance
2018-1571; An Ordinance designating the Peoria Heights Downtown Overlay District and
Approving a Plan that Shall Apply Within the District. Trustee Goett seconded the
motion which was approved 6-0. Trustee Dan Mariscal made a motion to approve a
request for approval of a Special use for 3707 Vincent for a used car lot. Trustee Goett
seconded the motion. Attorney Casey Kepple represented Mr. Norman Gates and
explained that this permit has been granted before and that Mr. Gates will be
complying with all previous provisions. He also explained that no mechanical work will
be done on property. He also added that he would like sufficient time to file an
objection. Deputy Clerk Sarah Witbracht read a letter from Sarah DeVore of the Zoning
Board of Appeals stating her support for the request. Gary Kempf stated that has
owned the property for 17 years and was originally given the permit allowing 25 cars.
He further stated that no more than one car has ever parked on the street at a time in
the years that he has owned the business. Trustee Goett made a motion to table this
item until Mr. Kepple has filed his objection, and Trustee Harn seconded which was
approved 6-0. Trustee Reichert would like to see this added to the departmental for
discussion. Trustee Harn made a motion to approve the request to purchase a water
service vehicle and hydro vacuum excavator not to exceed $40,000 total using water
department improvement loan funds. Trustee Goett seconded the motion which was
approved 6-0. Trustee Harn made a motion for a request of approval for the relocation
of a water tower communication line from the water department pumphouse at 1201
E. Kingman to the Centennial Building located at 1203 Kingman. David Marfell stated
that there are two quotes and that he is recommending the quote from Koerner
Electric in the amount of $6,300. Trustee Goett seconded the motion which was
approved 6-0. Trustee Carter made a motion for the approval of a Peoria Heights
Police Department Dispatch Area HVAC System Repair in the Amount of $7,540. Trustee
Diane Mariscal questioned the most recent repairs within the last couple years. Trustee
Harn seconded the motion which was approved 6-0.
11. Treasurer’s Report- Trustee Goett made a motion to approve the Treasurer’s Report.
Trustee Dan Mariscal seconded the motion which was approved 6-0.
12. Trustee Harn made a motion to enter executive session at 7:05. Trustee Diane Mariscal
seconded which was approved 6-0.
13. The regular session was adjourned at 8:15pm upon a motion from Trustee Goett and a
second by Trustee Mariscal.
