Minutes from the Petersburg City Council meeting held on: February 20, 2015 -1– ______________________________________________________________________________ The special meeting of the Petersburg City Council was held on Friday, February 20, 2015, at the Union Train Station. Mayor Myers called the special meeting to order at 12:00p.m. 1. CALL TO ORDER – 12:00 P.M. 2. ROLL CALL: Present: Council Member David R. Coleman Council Member John A. Hart, Sr. Council Member Brian A. Moore Council Member Samuel Parham Council Member Treska Wilson-Smith Mayor W. Howard Myers Absent: None Present from City Administration: City Manager William E. Johnson, III City Attorney Brian K. Telfair Clerk of Council Nykesha D. Jackson, CMC 3. CONSENT AGENDA: a. A request to schedule a public hearing to receive public comment on a petition for a Special Use Permit to operate a stand-alone used vehicle business not associated with a new-vehicle dealership at 1614 East Washington Street, subject to certain terms and conditions; suggested date March 17, 2015. b. A request to schedule a public hearing to receive public comment on a petition for a Special Use Permit to operate a stand-alone auto vehicle sale not associated with a new-vehicle dealership and a stand-alone auto vehicle repair business, subject to certain terms and conditions, at 534 East Washington Street; suggested date March 17, 2015. c. A request to schedule a public hearing to receive public comment on a petition to rezone 557- 559 Commerce Street, T. P. 023-03-0012, from M-1, Light Industrial District, to R-3, Two Family Residence District, to facilitation for residential use; suggested date March 17, 2015. d. A request to schedule a public hearing to receive public comment on a petition of Thomas Dickey to rezone 123 Pine Street, identified as Tax Parcel 023-30-0004 from M-1 Light-Industrial District to PUD (Plan Unit Development) for 40 market rate rental units; suggested date March 17, 2015. e. A request to schedule a public hearing to receive public comment for the issuance of bonds for Utility Capital Projects for fiscal years 2015-2017 (FY15-FY17); suggested date March 17, 2015. Council Member Wilson-Smith made a motion to accept the Consent Agenda to schedule public hearings for items 3a-3e on March 17, 2015. The motion was seconded by Council Member Moore. The motion was approved on roll call. On roll call vote, voting yes: Coleman, Hart, Moore, Parham, Wilson-Smith, and Myers 4. CLOSED SESSION: Minutes from the Petersburg City Council meeting held on: February 20, 2015 -2– ______________________________________________________________________________ City Attorney, Brian Telfair, stated that it was City Council’s desire to enter into a closed session under Section 2.2-3711.A (1) of the Code of Virginia, and specifically under Subsection 1 to discuss certain issues related to Council appointees, specifically the interim appointment for the Ward 2 representative on Council. Council Member Moore moved that the City Council go into closed session for the purposes noted by the City Attorney. The motion was seconded by Council Member Hart. There was no discussion on the motion, which was approved on roll call vote. On roll call vote, voting yes: Coleman, Hart, Moore, Parham, Wilson-Smith, and Myers City Council entered closed session at 12:05 p.m. CERTIFICATION: Council Member Coleman made a motion to return City Council into open session and certify the purposes of the closed session. The motion was seconded by Council Member Parham. There was no discussion on the motion, which was approved on roll call vote. On roll call vote, voting yes: Coleman, Hart, Moore, Parham, Wilson-Smith, and Myers 15-R-10 A RESOLUTION CERTIFYING, AS REQUIRED BY THE CODE OF VIRGINIA, SECTION 2.2- 3712, THAT TO THE BEST OF EACH MEMBER’S KNOWLEDGE, ONLY PUBLIC BUSINESS MATTERS LAWFULLY EXEMPTED FROM OPEN MEETING REQUIREMENTS OF VIRGINIA LAW WERE DISCUSSED IN THE CLOSED SESSION, AND ONLY SUCH PUBLIC BUSINESS MATTERS AS WERE IDENTIFIED IN THE MOTION CONVENING THE CLOSED SESSION WERE HEARD, DISCUSSED, OR CONSIDERED. 5. BUSINESS OR REPORTS FOR/FROM THE MAYOR AND OTHER MEMBERS OF CITY COUNCIL: a. Appointment of Ward 2 Council Member Vacancy Council Member Parham made a motion to appoint Darrin L. Hill to fill the Ward 2 Vacancy until November 2015. The motion was seconded by Council Member Coleman. There was no discussion on the motion, which was approved on roll call vote. On roll call vote, voting yes: Coleman, Hart, Moore, Parham, Wilson-Smith, and Myers 15-R-11 A RESOLUTION APPOINTING DARRIN L. HILL TO FILL THE WARD 2 VACANCY UNTIL NOVEMBER 2015. Council Member Coleman moved that the City Council go into closed session. The motion was seconded by Council Member Parham. There was no discussion on the motion, which was approved on voice vote. On voice vote, voting yes: Coleman, Hart, Moore, Parham, Wilson-Smith, and Myers City Council entered closed session at 2:00 p.m. CERTIFICATION: Council Member Moore made a motion to return City Council into open session and certify the purposes of the closed session. The motion was seconded by Council Member Hart. There was no discussion on the motion, which was approved on roll call vote. Clerk of Council, Nykesha Jackson, asked whether there was a nomination for Vice Mayor. Council Member Wilson-Smith nominated Council Member David Ray Coleman to be Vice Mayor. On roll call vote, voting yes: Coleman, Hart, and Wilson-Smith; Voting No: Moore, Parham, and Myers There was no discussion on the nomination, which was not approved on roll call vote. Council Member Moore nominated Council Member Samuel Parham to be Vice Mayor. On roll call vote, voting yes: Hart, Moore, Parham, and Myers; Voting No: Coleman and Wilson-Smith There was no discussion on the nomination, which was approved on roll call vote. 15-R-13 A RESOLUTION APPOINTING SAMUEL PARHAM AS VICE MAYOR. 6. ADJOURNMENT: Council Member Moore moved for adjournment. The motion was seconded by Council Member Parham. There was no discussion. The motion was approved on voice vote.
