MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE TOWN OF PINETOP-LAKESIDE, ARIZONA, HELD THURSDAY, MAY 12, 2016, IN THE TOWN COUNCIL CHAMBERS. Chairman Jarchow called the Regular Meeting to order at 6:00 p.m. Roll call was as follows: ROLL CALL: Present Absent Present Absent John Jarchow X Timothy Williams X James Snitzer X Errol Heslop X Rob Ingels X Adam Staley __X__ Richard Smith X STAFF PRESENT: Cody Blake, Interim Zoning Administrator and Jill Akins, Assistant to the Town Clerk. ITEM NO. 3, CALL TO THE PUBLIC: There were no requests to address the Commission at this time. ITEM NO. 4, APPROVAL OF THE REGULAR MEETING MINUTES FOR March 24, 2016: COMMISSIONER INGELS MOVED TO APPROVE THE REGULAR MEETING MINUTES FROM MARCH 24, 2016. COMMISSIONER WILLIAMS SECONDED THE MOTION AND IT CARRIED UNANIMOUSLY. ITEM NO. 5, STAFF REPORTS: Chairman Jarchow said he asked for staff reports to be moved on the agenda to under item number four. He would like Cody Blake to present the staff report at the beginning of the meeting, because of the numerous changes in the Town’s leadership since the last meeting. He said he asked Mr. Blake for an update on how things are functioning now at the Town since all of the changes had been made, and said there are currently five public works projects and Mr. Blake would give an update on the projects. Cody Blake said David Sargent, Chief of Police and Co-Interim Town Manager; said approximately twenty-five applications had been received for the Town Manager position. He said the applications would be reviewed by a board consisting of the two interim Town Manger’s, Leah Chavez and David Sargent, and three Town Councilmembers on May 16, 2016. He said they would narrow the group down to seven to eight applicants and would begin interviews on May 25 and May 26, 2016. He said a follow-up interview would be held on June 3, 2016, and said this would be an in-depth interview with the entire Town department heads involved and the Chamber of Commerce, Planning and Zoning Commission and Advertising and Promotion Committee involved. Commissioner Ingels said he would like the public to be involved in meeting and interviewing the potential Town Manager. Mr. Blake said the plan is to have the Town Manager in place on July 1, 2016. Mr. Blake said he is the interim Zoning Administrator. Chairman Jarchow said the Commission had a commitment from the former Town Manager, Ms. Racette, that the Planning and Zoning Commission would have a meeting with the Town Manager and the Town Zoning department. He said the Commission was told by Ms. Racette that she would make sure a meeting was held between the Commission and Navajo County Public Works Department. Chairman Jarchow said Mr. Blake is currently handling everything that was formally handled out of the Community Development Department. 1 Mr. Blake said the Giant gas station would be installing new gas tanks, and said there would be making the sidewalks more ADA compliant. He said there are currently five different public works projects going on in the Town. He said most of the projects are road work, the bridge across Billy Creek is being maintained and a sidewalk is being installed from the corner of Woodland Road to Navajo Road. Mr. Blake said June 10, 2016 would be the first tent vendor event of the summer held at Blue Ridge School. He said he reviews the special event permits. He said the Burger King in Pinetop would be remodeled, and said Burger King had hired an architect for the remodel. Mr. Blake said Taco Bell is in the process of bidding out a contractor for the remodel, and said as soon as a contractor is hired they would pull a permit to begin the remodel. Commissioner Williams asked for Mr. Blake to give an update on the Community Counseling Center home at the next meeting. ITEM NO. 6, INFORMATION/DISCUSSION REGARDING TITLE 16 AND TITLE 17 ORDER OF SUB SECTIONS: Chairman Jarchow said the Commission would not make any decisions this evening, but said Title 16 and Title 17 would be discussed and the Commission would think of some guidelines for implementing Title 16 and Title 17 with the General Plan implementation measures. He said the Commission would revise Title 16 and Title 17 to make them user friendly, and decide whose authority each section falls too. Discussion ensued regarding the Commercial and Residential Building Codes. Chairman Jarchow directed the Commission to discuss the topic of Title 16 and Title 17 codes. He said 16.08 Administration is listed first in Title 16 and 17.132 Administration is the last item in Title 17. He said each title should be in the same order. He said 16.40 Enforcement and Penalties is listed last and in Title 17 it is listed next to the last. He said in Title 17, 17.04 Mountainside Development Regulations is listed first, and said this does not make sense to him. He said Title 17 is zoning use, and asked why Mountainside Development is listed first. He said Conditional Use Permits are at 17.80 and Nonconforming Uses are at 17.112, and said both of these items are similar. He said it would easier to understand if these items were side by side rather than split by numerous sections. Commissioner Ingels agreed with Chairman Jarchow’s suggestions. Chairman Jarchow said he does not know if 17.102 Medical Marijuana should be listed between 17.100 Property Maintenance and 17.104 Supplemental Provisions. He said the Commission wants a user friendly document that is not redundant. Commissioner Ingels said Title 16 and Title 17 should be clear, concise and user friendly. He said the goals of the Commission are to prioritize Title 16 and Title 17 to coincide with the General Plan. Chairman Jarchow said the Commission only has jurisdiction over Title 16 and Title 17. Chairman Jarchow recommends dealing with Title 16 first, and said at the next meeting the Commission may be able to complete Title 16. He said Title 17 is far more complex, and said he is hesitant to tackle Title 17 until the new Town Manager is in place. ITEM NO. 7, FUTURE AGENDA ITEMS: Chairman Jarchow said Title 16 would be discussed at the next meeting. He said Title 16 would be used as a template when reviewing the complexity of Title 17. He said Title 16 would be agendized as Discussion/Information/Action at the next meeting and would be agendized at following meetings until the Commission is ready to take action. He said after action is taken on Title 16 it would be used as a model for Title 17. Mr. Blake said the Conditional Use Permit would be heard at the June 9, 2016 meeting. Mr. Blake said he would not have any agenda items for May 26, 2016, and the Commission decided not to have a 2 meeting on May 26, 2016 due to this being the Thursday before Memorial Day Weekend. Mr. Blake said the Conditional Use Permit is for a thirty by fifty event tent that the new owner of Pico’s Nursery would put on the property. He said the tent would be for weddings and wedding receptions, and said the tent would be up during the summer and taken down in early fall. He said the property is an existing established commercial use for weddings and wedding receptions. Chairman Jarchow said the Conditional Use Permit would be for future commercial events. Chairman Jarchow said the next meeting would be June 9, 2016 for the Conditional Use Permit and discussion, information, and potential legal action for Title 16. Dated this 24th day of May 2016. Pursuant to Arizona Revised Statutes Section 38-431.02, notice is hereby given to the members of the Pinetop- Lakeside Planning & Zoning Commission and to the general public that the Planning & Zoning Commission will hold a public meeting on Thursday, May 12, 2016 beginning at 6:00 p.m., in the Town Council Chambers located at 1360 N. Niels Hansen Lane, Pinetop-Lakeside, Arizona. AGENDA 6:00 p.m. REGULAR MEETING: 1. Call to Order and Ascertain Quorum. 2. Pledge of Allegiance. 3. Call to the Public. This is a business meeting of the Planning and Zoning Commission. The Town values and welcomes public input. Please address the Commission as a whole and not individual Commission Members. Do not address staff or members of the audience. Commission action on items brought up in Call to the Public is limited by the Open Meeting Law. The Commission may direct staff to study the matter and reschedule for further consideration at a later date. Items on the agenda will not be heard or discussed in Call to the Public. Individuals are limited to three (3) minutes. 4. Consent Agenda a. Approval of the regular meeting minutes for March 24, 2016. 5. Staff Reports: No action will be taken 6. Information/Discussion Re: Title 16 and Title 17 order of sub sections. 7. Future Agenda Items: Discussion regarding any future agenda items. No action will be taken.
