Call to Order Chairman Turner called the meeting to order at 6:00 p.m. Chairman Turner led the Pledge of Allegiance. Call to the Public Chairman Turner called for public comments. Rob Ingels offered the following comments, “Thank you Chairman and Commissioners. It’s not very often that I get to look up this year and actually see the Planning Commission. I want to thank those of you that are here tonight, and I Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 2 appreciate the work that you do. I want to comment on having the minutes come up tonight. It was pleasant to see discussion amongst the Commissioners regarding issues that were important to the community. Reading through those minutes I felt good about being a citizen in a town with you guys as a Commission. I appreciate when we are here observing or participating in meetings, to see the dialogue and to know how our Commissioners feel about our community. Thank you for that. I am going to express at this point that I find it difficult when I come in and out of the town offices for meetings like this where certain agenda items could be reflected with the Town Zoning map on the wall with maybe a 3’ x 4’ sized map. If things needed to be referenced where certain zones are or the Future Land Use Map which is part of the 2015 General Plan. I think that those are important documents for a Planning Commission and for the citizens to have access to if they are here in the Chambers when matters are being discussed that are relative to that. Maybe it’s always easy to push a button and have screens show the zoning map or the future land use map as items are being discussed that are planning issues for the Commission. But as a citizen, having a little piece of paper with a map to reference and share with others what that means, it’s difficult. Maybe as a future agenda item the Commission can discuss if that is valued or not. Thank you.” C. Consent Agenda C.1Consider approval of the Minutes of the Regular Meeting of the Planning and Zoning Commission held on April 11, 2024. Vice Chairman Kendzlic moved to approve the minutes of the Regular Meeting of the Planning and Zoning Commission held on April 11, 2024. D. New Business Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 3 D.1 Public Hearing, Discussion and Legal Action regarding creating Town Code Chapter 17.08.055, thereby regulating the Placement of Manufactured Homes. Community Development Director Loyd reviewed his staff report and said that limiting the placement of modular and manufactured homes to those that are no older than ten years old will improve the aesthetic of the Town, ensure safety, reduce costs of abatement, and adhere to high quality development that is outlined in the General Plan. The recommendation is to add Town Code Chapter 17.08.055 and regulate the placement of manufactured homes. Chairman Turner opened the Public Hearing, no comments were offered, so the Public Hearing was closed. Chairman Turner asked if the Commissioners had any questions or discussion. Chairman Turner made a motion to recommend approving Town Code 17.08.055, Placement of Manufactured Homes, thereby regulating the installation of Manufactured Homes, to the Town Council. Commissioner Williams seconded the motion and by a show of hands the following vote was recorded: AYES NAYS ABSTAIN Harry Turner X Tim Kendzlic X Alison Stewart X John Salskov X Jack Pence X Timothy Williams X Chairman Turner declared the motion passed with a 6-0 vote. D.2 Public Hearing, Discussion and Legal Action regarding a Minor Amendment to the Land Use Element of the General Plan changing the land use designation from R-Low to Planned Development for 32.3 gross acres on the corner of Show Low Lake Road and White Mountain Boulevard for the Lake Pointe Development. Community Development Director Loyd reviewed his staff report and stated, that the applicant is requesting Community Commercial Land Use designation along White Mountain Blvd and Planned Development in the back for townhomes. Director Loyd stated that Planned Development designation in the Land Use Element would allow for both requested zonings. Mountain Gate, which is northwest of this property, is designated as Planned Development. The parcels being considered have a net acreage of 31.05 acres. Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 4 The applicant, Jeff Fassett, stated, “Thank you for having us here. My name is Jeff Fassett, and we are all natives of Arizona. I actually married Kate Baldwin who graduated from Blue Ridge. So, for the last 18 years I have been coming up here a lot. My mother and father-in-law, who are here, have been residents for 50 years in the community. Gene Cooper is a veteran and owned a fire suppression company for 40 years. This lends to making sure that everything is aligned with fire concerns. The other member here is Daryl Fassett and he is also an Arizona native. His background is in landscape architecture. So, he brings value to work with the land and developing it without scraping it down and then building it from the ground up. Like I said, we are all natives of Arizona, and we are looking for successful small business owners who have been coming to Pinetop-Lakeside for decades. We are not a big company from out of state coming and telling Pinetop-Lakeside what we think you need, and this is what we are going to do. We want to work with the community and build something that is going to highlight the uniqueness of Pinetop-Lakeside for generations to come. Like I said, we are all natives and I have a couple of kids. When we come up here it would be cool to have a legacy project that we can come and play pickleball on the court that dad helped develop. We have been working hard meeting with the public, we have met with the neighbors, and my mother and father-in-law to learn about Pinetop, Jeremiah has been amazing to help us get insight on what the Town needs. We used Painted Skyes for the topo map and surveying. We are looking to focus on a truly public space where you can play pickleball. People say that pickleball is the biggest keyword ever. We have an all- weather community center, maybe indoor golf, or some other yard games. Somewhere the community can get together and have an event space. The hotel is along the front and there is a rock outcropping. That is going to be the feature photo spot and have a waterfall. The hotel is not going to just be one level, it is going to be 3 or 4 levels, working with the contour of the land. The plan is to build a hotel that works with the land and that has an amazing venue space for pictures, prom, weddings, and special events. We have shops that will be on the top left. The thought there is to highlight local shops. We are not looking to bring in national chains necessarily. The Woodland Lake path in Pinetop-Lakeside is amazing. We are going to keep the pathways that are there so that people can exercise and ride their bikes or whatever they want to do there. We are working with local engineers. We had a long meeting with Bruce Ironside talking about some things that the Town needs. We have been working with the utility companies and they have been great. We have a general idea of where the sewer will be. All three, the power, water, and sewer Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 5 companies said that they have the capacity to take this project on. We have well over the 30% open space which is required by the Town. Like I said, our goal is to increase the visibility and uniqueness of Pinetop through this project. The houses and buildings are going to be in line with the look and feel of Pinetop. We are looking for the front portion to ideally be commercial and the back portion to be a little higher density residential, with the townhomes. Like Jeremiah said, everything around the front is already commercial. The benefit of changing this to commercial is that we have a clear plan in place, instead of someone else coming in and doing whatever they want because it is already zoned. Jeremiah went over how the project fits in line with the amendments that you all tried to do a few years ago. I don’t feel like we are asking for something too crazy. When talking to the community and the neighbors, we heard that a big concern was traffic. With about 28,000 vehicles a day on White Mountain Blvd., we would probably end up putting in a stop light at Show Low Lake Road. This would provide a break. I was talking to Donnie earlier and he said that his daughter got hit there and I could see that because it took about 5 minutes for us to be able to turn left out of there. Having a light there would ease the traffic and provide a safer way for people to turn in and out. I just went through this in Phoenix and the developer said they wanted to put in a light, and we weren’t sure, and it has been a godsend because it creates a break in traffic. This will also help with safety for those who are trying to turn left and go into town.” Chairman Turner asked if the applicant is planning on working with ADOT. Jeff Fassett responded, “Yes, we are planning on working with ADOT to see what is the safest and what makes the most sense for the community. There is some room on the corner that we could use to widen the road to make a lane to use to turn left. There is enough room that we could do that. That is totally reasonable.” Vice Chairman Kendzlic asked if the first phase will be the hotel and commercial buildings. Jeff Fassett answered, “Probably. Right now, we are leaning towards having the front pad with a coffee shop or some type of quick service place there and the hotel. We would also like to build out some of the community center because that will attract people to the hotel and the amenities and piggyback off of that. Working with a designer here in town, we will work to design the residential portion in the back. We will pre-sale those and then start building those. It will be a couple phases. The first will be the hotel and quick serve up front and then at least the groundwork for Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 6 the community center. Then we will pre-sale the townhomes and build them in three or four phases.” Vice Chairman Kendzlic said that this is nice project and it aligns with what survey takers said the town needs. Chairman Turner asked if the residential sites will be single-family homes, townhomes, or a mixture. Jeff Fassett replied that they are planning on building duplexes and focus on workforce housing. Some may be single story, and some may be two-story, depending on the land. But it is early in the process to finalize that. Chairman Turner opened the public hearing. Mina Henning stated, “Good afternoon, Chairman and Commissioners. Thank you for giving me the time to speak. As a resident who was born and raised up here, I encourage you to vote in favor of projects like this. With the increase of residents that have come to this community, and I have seen a big change in this community, the town depends on businesses for the infrastructure, the roads, law enforcement, for everything. I definitely encourage you guys to vote in favor of projects like this and businesses. With that comes a double edge sword, the more residents that we get up here the more we have to allow for businesses and new to come in. So, I definitely encourage you guys to vote in favor of this. Thank you.” Chairman Turner thanked Mina Henning for her comments and invited Eduardo Coronado to speak. Eduardo Coronado stated, “Good evening, Chairman and Commissioners. Thank you for allowing me a little bit of time to address you. We own the building that is directly across from the go-carts. It is the stand alone building and that building will be abutting the proposed project so it will directly impact our building. The objection that I have is not necessarily the business part but changing to accomadate the residential part. This would allow a change from low density to now high density. That will impact the area, the environment, the traffic, the noise levels, the character of the area and obviously I would look disingenuous if I didn’t say that that part of the project will adversely affect the value of our property. My biggest misgiving is not the commercial part of this because I think it fits but going from low density to high density because of the additional residential area. That will directly abut to our Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 7 property. The only thing that really separates us is a little marsh area between our property and the project.” Vice Chairman Kendzlic stated that finding housing is an issue for residents and that townhomes would help workers who cannot afford million-dollar homes. Eduardo Coronado continued, “I understand what you are saying. If those homes were not as condensed as what I understand they are going to be, and if they were million-dollar homes, I would probably not be here. But since they are not going to be, as I said, I would be disingenuous if I said all of my motives were altruistic. Part of this is financial. Those homes will affect the property that we own. I understand what you are saying but this is not zoned for that. They are not zoned, and we are talking about rezoning. When we bought the property, we relied on the zoning. Changing the zoning changes our investments. Thank you and have a good evening.” Jeff Fassett stated that with development costs these homes will be higher end and there is a buffer that cannot be developed by the law office. The noise and traffic should not negatively impact the surrounding properties. Commissioner Stewart asked what the estimated price would be. Jeff Fassett answered that without engineering it is difficult to know but the range is $450,000-700,000. Commissioner Stewart responded that that range is not for the local workforce. Chairman Turner stated that the range is comparable to the Mountain Gate Townhomes that are nearby. Robert Ingels offered the following comments, “Robert Ingels, Penrod Lane, resident of Pinetop, resident since 1978. I served as the Planning and Zoning vice chairman in 1985. I have kind of kept an eye on things and how things have altered. I am going to stick to the agenda item. R-low that is illustrated from the Future Land Use Map. If I am correct, there is a designation on the Future Land Use Map called Planned Development. That would come on the Future Land Use Map so that we could plan what type of development could occur. That could mean that parts of it would be commercial, part could be PUD residential, and part could be neighborhood residential. At this point though, all 6 parcels are under one ownership, and they were all purchased as R-low. The desire of the owner of the property is to do planned unit development, at this point I suggest that this Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 8 Commission promptly moves ahead with the alteration of the Future Land Use Map and consider this for Planned Development at this time. The issues that seem to be coming up seem to be appropriate for the next item more so than right now. Due to the Highway 260 property frontage, I think its 422 feet of frontage which most commercial properties tie into the highway instead of side streets. Although I reside on Penrod Lane in Pinetop, it’s a little shady and cold in the wintertime. We own two properties in Show Low Lake Estates that are contingent that I like open space and trees and neighbors not right on top of me. That residential area is my future retirement area. Some of my concerns for Planned Development include safety and health and traffic and trying to maintain as much of the elements of our General Plan that ensure that our natural environment is intact. The elements that I consider Planned Development are right now and the details of what type PUD or Commercial or if it should remain R-low. But it is under one ownership, six parcels, and I think one is just over one acre in size. Thank you.” Larry McCormick stated, “By the way it is very difficult in this building to hear the comments. You have to do something about the volume. I have my hearing aids up full blast and I’m not hearing anything. At the behest of Jeremiah Loyd, the two partners involved in Lake Pointe attended a PVC meeting at my house. I wanted to point out a few things so that you know who you might be going in to bed with. First of all, they did a great presentation. I spoke to both partners on the patio of my house as they were leaving, and I told them that if Brett Cote had made a presentation like that then we would probably be staring at an RV park across the street on Vallery Lane. They came prepared. Some of these are good and some of them are bad. First of all, these two gentlemen have no experience in this area. I think they told me they have a 20-30 million dollar budget. That is a lot of money. I don’t know how you go about constructing an area like that without experience. In their presentation there seems to be a lot of ‘what ifs’ and ‘maybes.’ I think before you approve or disapprove this, you might want to meet and get an idea of what exactly they want to do. The decision is final if you approve it. I would be concerned about some of the indecisions. Some of the questions that were asked were whether or not they knew if they needed a stop light and whether or not it would be on Show Low Lake Road or on the 260. They weren’t sure at this point. I do not know where the best place is either, but I do know that they need a stop light. Other than that, the one thing that bothers me is the short cuts and the other ways to get to the property. The traffic that goes through Show Low Lake Road, there are three 90 degree turns in that area. Once you get over the street that goes to Home Depot that is kind of a sleepy area. Page 9 There are a lot of walkers and a lot foot traffic and a lot of fishermen so I don’t know how that would effect things long term. I know there is one homeowner on Show Low Lake Road has signs out that say “children, slow down.” You know how that goes, especially last weekend, 4th of July weekend. It was a mad house around here. But anyway, that is all that I have.” Chairman Turner closed the public hearing. Commissioner Williams stated that he thinks the front portion should stay commercial and the rest should be planned development, instead of the whole thing being planned development. Community Development Director Loyd stated that is what the applicant requested. Commissioner Salskov stated that having commercial in the front is advantageous for the applicant to build what is proposed. Commissioner Williams made a motion to recommend Zoning Amendment Z-89 to the Zoning Map of the Town of Pinetop-Lakeside, thereby amending the Zoning Map for approximately 32.3 gross acres for the following APNs: 212-01-019A, 212- 01-019B, 212-01-020, 212-01-021A, 212-01-022C, 212-01-022D from R-Low to Commercial in the front and PUD for the rest to the Town Council. Vice Chairman Kendzlic seconded the motion. The motion was rescinded since the proposed motion pertained to D.3 and not D.2. Commissioner Williams made a motion, recommending approving a Minor Amendment to the General Plan Land Use Element, amending the Land Use Element from Low Density to Commercial for the front portion and Planned Development for the rest, totaling 32.3 ± gross acres on the southeast corner of Show Low Lake Rd and White Mountain Blvd. to the Town Council. Page 10 Timothy Williams X Chairman Turner declared the motion passed with a 6-0 vote. D.3 Public Hearing, Discussion and Legal Action regarding Z-89, a Zoning Amendment changing from R-Low to PUD for APNs 212-01-019A, 212-01- 019B, 212-01-020, 212-01-021A, 212-01-022C, 212-01-022D. Community Development Director Loyd reviewed the staff report and stated that this item is to recommend zoning that will follow the land use designation. The request is to recommend to the Town Council to zone the residential portion Planned Unit Development (PUD) and the front portion, along White Mountain Blvd., Light Commercial (C-1). Chairman Turner opened the Public Hearing. Eduardo Coronado stated, “Thank you again. This will be short since I have the same objections. The objections that I have I covered in D.2 and they are the exact same so I do not want to take up any more time. Everybody heard what my objections were. Thank you.” Commissioner Williams stated that the developer will have to come back to Planning and Zoning to have their site plan approved. Eduardo Coronado replied, “I understand that and that is part of my concern. There is not a definite plan and that concerns me.” Commissioner Pence asked what the buffer is between this project’s property and Mr. Coronado’s property. Community Development Director Loyd stated that there is one commercial property between them. Eduardo Coronado answered that the buffer is still miniscule. Robert Ingels stated, “Thank you Chairman and Commission. I am sorry if I get impatient sometimes. The first step now that your recommendation for the future land use map will show planned development. The second step is that the applicant provide a request to rezone the 6 individual parcels to PUD. Is there an application that the Commission has in front of them for PUD? Or is the only application that was submitted was for C-1? Moving ahead into requesting a zone change, there is an application process that gets filled out. I only see the one in the packet that I picked up yesterday that says a request for C-1 zoning.” Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 11 Community Development Director Loyd stated that there were two applications and one was digital and one was a paper copy. Robert Ingels continued, “So there were two applications. I only got the one in the packet for C-1.” Community Development Director Loyd stated that both requests can be completed with one application. The zone change application has a section to provide details if the zone change requires a minor amendment. Robert Ingels continued, “That’s what I read in here, ‘C-1 to match neighbors. No special entitlements are requested.’ Then on the map that I have a large copy and that has been on the screen. I look at the commercial depth of the adjoining properties, and this has been talked about by the Commission before, it is usually several hundred feet in from the highway frontage. This is kinda where the strip of commercial zoning is. So to have a project that is talking about having a more centered intensity with the recreation areas and all seems to be a good direction to be moving in. I’m still discomforted in having the ingress/egress onto Show Low Lake Road. This is very narrow, like I heard said, and there are several 90 degree turns past this development. As I drive on to Show Low Lake Road I look to the south where this proposed development is and to see a building, that large L-shaped building, that close to the highway. There are some nice trees there and a slope, that would be the perfect area to have a trail go along there. I would have to say that at this phase of recommending this particular project, has a forester even been on site to try to identify if there are certain trees or geological features that are referenced in our General Plan that would be desired and maintained? I have heard about a lot of intentions. I don’t see that on the drawing. Buffering and planned development sometimes has a requirement if you are permitted, to double the intensity and setbacks and buffering that is required on adjoining property in the planned development area. So I guess tonight, I would caution recommending that this is the PUD buildout without having certain conditions. Those conditions I thought might be discussed. Is there a commitment if this project is built to contribute to traffic safety? Is fire evacuation for existing residents, if there is an accident on the 260 and for Camp Tatiyee area and Camp Grace? With that comment, right now there is a 35 acre commercial property directly across the highway that was referenced in the application that already has a drive way constructed there. The ability of that to provide many of the similar needs on 35 acres and not have the concern of how much rock is on the property and what kind of preservation and conservation Minutes of Planning and Zoning Commission Regular Meeting – July 11, 2024. Page 12 concerns might be involved with the PUD. If this should be approved, and this is conceptual at this time.” Vice Chairman Kendzlic stated that ADOT will decide if a traffic light is necessary. Robert Ingels added, “If this ties in to Matt Patterson’s Public Works road why would ADOT be involved?” Vice Chairman Kendzlic stated that people will only go all of the way down Show Low Lake Road if they are making a short cut to Home Depot. Robert Ingels continued, “The proposal that I see shows the main ingress/egress right onto Show Low Lake Road and that there was only a 30’ wide access on to the 260 and that was not going to be the main entrance.” Community Development Director Loyd responded to Robert Ingels and stated that his concerns are valid, but they will be addressed during subdivision and site plan review and not during zoning. Jeff Fassett responded that it is too early in the project to have a forester come to the project. They have the intent of putting in a turn lane and potentially a light on Show Low Lake Road. Most of the traffic will turn into the development before hitting the 90 degree turns that resident are concerned about. Jeff Fassett ended by saying they are wanting to work with the Commission’s recommendations throughout the process. Nancy Baldwin stated, “I know I am supposed to be addressing you, but I also want to address these people. We have lived up here for 47 years and live down the street on Apache, close to Stephanie. 4 years ago, we sold that and bought a one level house because the other was three levels, but we still live here. Jeff is our son in law, and we have known them for over 20 years, and they have been a part of our family. They are the most honest people we know, and they help us with everything we need. So, I trust them, and I know many of you trust me because I taught your children. Some of them I taught preschool and some of them I taught junior high and high school at Blue Ridge and Alchesay as well. I am still substitute teaching and my husband is still working and living in a little community up by Pinetop Country Club. Very small but inexpensive community where he can walk to Pinetop Country Club. We have been invested in this town for many years. It is the best place ever. Our children were born and raised here. You should trust the Baldwins when we say that this is good. So, I just wanted to speak on behalf of the people of Pinetop-Lakeside as somebody who has lived here all of these years and knows everyone and your children and I think this is a really good plan. I just wanted to bring that up. Thank you.” Chairman Turner closed the Public Hearing. Commissioner Pence asked how much of the project will be C-1 and how much will be PUD. Jeff Fassett responded that approximately half will be C-1 and half will by PUD, the dotted line on the map roughly shows the difference. Community Development Director stated that the Commission can make a motion similar to the previous motion, however the applicant will need to provide more specific numbers before this is presented to the Town Council. Commissioner Williams made a motion to recommend approving Zoning Amendment Z-89 and change the zoning of the approximately 32 acres of R-low to the front half being zoned C-1, Light Commercial, and the back be PUD for 212-01- 019A, 212-01-019B, 212-01-020, 212-01-021A, 212-01-022C, 212-01-022D to the Town Council.
