B. Call to the Public: Chairman
This is a business meeting of the Planning and Zoning Commission. The Town values and
welcomes public input. Please address the Commission as a whole and not individual
Commission Members. Do not address staff or members of the audience. Commission action
on items brought up in Call to the Public is limited by the Open Meeting Law. The
Commission may direct staff to study the matter and reschedule for further consideration at a
later date. Items on the agenda will not be heard or discussed in Call to the Public. Individuals
are limited to three (3) minutes.

C.1 Consider approval of the minutes of the Regular Meeting and Deputy Town Clerk
the Work Session of the Planning and Zoning Commission
held on August 8, 2024.
D. New Business:
Public comment will be taken at the beginning of each agenda item,
after the subject has been announced by the Chairman and explained
by staff. Any citizen, who wishes, may speak one time for five (5)
minutes on each agenda item before or after Commission discussion.
Questions from Commission Members, however, may be directed to
staff or a member of the public through the Chairman at any time.

17.128.025 Approval of Residential Zoning Applications. Development

Chairman Turner called the meeting to order at 6:00 p.m.
Chairman Turner led the Pledge of Allegiance.

Vice Chairman Kendzlic moved to approve the minutes of the Regular Meeting
of the Planning and Zoning Commission held on July 11, 2024. Chairman
Turner seconded the motion and by show of hands the following vote was
recorded:

Chairman Turner declared the motion passed 7-0.
D. New Business
D.1 Select Planning and Zoning Commission Chair and Vice Chair for
2024-2025.
Chairman Turner asked the Commissioners to state if they are interested in being
Chair or Vice Chair. Commissioner Pence and Vice Chair Kendzlic stated that they
were interested in being Chair.
Commissioner Stewart stated that she thought both members would make a great
Chair but is leaning towards Kendzlic for Chair because he has lived in the area and
has been on the Commission longer.
Commissioner Stewart made a motion to appoint Tim Kendzlic for Chair and Jack
Pence as Vice Chair. Commissioner Fernau seconded the motion and by a show of
hands the following vote was recorded:

1. Review and Discussion of the Planning and Zoning Manual.
Marketing Coordinator Annie DeRosier gave the Commission tips on how to speak
to be picked up on the microphones better. This will help ensure that the audience,
in person and online, can hear what is being said.
Deputy Town Clerk Mackenzie Valichnac reviewed Open Meeting Law and
parliamentary procedure.

Community Development Director reviewed Chapter 17.116, which outlines the
rules and responsibilities of the Planning and Zoning Commission. Director Loyd
discussed the General Plan and how it should be used when making decisions, since
this was approved by the citizens. Director Loyd also discussed State Statutes and
best practices that the Commission should follow.
Discussion between staff and Commission occurred while discussing the topics
above. Robert Ingels offered comments.
Chairman Kendzlic adjourned the meeting around 7:20 p.m.

DISCUSSION:
9-462.10. Residential zoning; amendment; applications: deadline; extensions;
applicability
A. ON OR BEFORE JANUARY 1, 2025, A MUNICIPALITY SHALL ADOPT AN AMENDMENT TO THE
MUNICIPALITY'S ZONING ORDINANCE THAT REQUIRES THE MUNICIPALITY TO DETERMINE WHETHER A ZONING
APPLICATION IS ADMINISTRATIVELY COMPLETE WITHIN THIRTY DAYS AFTER RECEIVING THE APPLICATION.
IF THE MUNICIPALITY DETERMINES THAT THE APPLICATION IS NOT ADMINISTRATIVELY COMPLETE, THE
MUNICIPALITY SHALL FOLLOW THE PROCEDURES PRESCRIBED IN SECTION 9-835, SUBSECTION E UNTIL THE
APPLICATION IS ADMINISTRATIVELY COMPLETE. THE MUNICIPALITY SHALL DETERMINE WHETHER A RESUBMITTED
APPLICATION IS ADMINISTRATIVELY COMPLETE WITHIN FIFTEEN DAYS AFTER RECEIVING THE RESUBMITTED
APPLICATION. AFTER DETERMINING THAT THE APPLICATION IS ADMINISTRATIVELY COMPLETE, THE
MUNICIPALITY SHALL APPROVE OR DENY THE APPLICATION WITHIN ONE HUNDRED EIGHTY DAYS.
B. NOTWITHSTANDING SUBSECTION A OF THIS SECTION, THE MUNICIPALITY MAY EXTEND THE TIME
FRAME TO APPROVE OR DENY THE REQUEST BEYOND ONE HUNDRED EIGHTY DAYS FOR EITHER OF THE FOLLOWING
REASONS:
1. FOR EXTENUATING CIRCUMSTANCES, THE MUNICIPALITY MAY GRANT A ONETIME EXTENSION OF NOT
MORE THAN THIRTY DAYS.
2. IF AN APPLICANT REQUESTS AN EXTENSION, THE MUNICIPALITY MAY GRANT EXTENSIONS OF
THIRTY DAYS FOR EACH EXTENSION GRANTED.
C. THIS SECTION DOES NOT APPLY TO LAND THAT IS DESIGNATED AS A DISTRICT OF HISTORICAL
SIGNIFICANCE PURSUANT TO SECTION 9-462.01, SUBSECTION A. PARAGRAPH 10 OR AN AREA THAT IS
DESIGNATED AS HISTORIC ON THE NATIONAL REGISTER OF HISTORIC PLACES OR PLANNED AREA DEVELOPMENTS.
RECOMMENDATION:
Staff recommends that the Commission recommend to the Town Council to comply with SB 1162
by creating§ 17.128.025 Approval of Residential Zoning Applications.
The Community Development Director or their designee shall determine whether a zoning
application is administratively complete within thirty days after receiving it. If it is dete1mined that
the application is not administratively complete, the procedures prescribed in ARS section 9-835,
subsection E, shall be followed until the application is administratively complete. The Community
Development Director or their designee shall determine whether a resubmitted application is
administratively complete within fifteen days after receiving the resubmitted application. After

RECOMMENDATION:
Staff recommends that the Commission suppo1t the approval of Zoning Amendment Z-90 by the
Town Council, a proposed amendment to the Town of Pinteop-Lakeside's zoning map. Adopting
C-2 zoning would maximize development potential and ensure optimal use of the 70-acre parcels
being annexed.

Council.
