Call to the public Mayor Irwin called for public comments. Larry Mccormick offered the following comments "Gooc7 ei;e77z.72g, Coc477cz./. Tonight, I would like to talk to you briefly about the Overlook Trail. September to October Of 2021, the trail has been closed. I've heard from certain people that it will be open soon, I've heard that it will be a long while, I have also heard "1'11 talk to the Town Manager about it. " Today, I haven't heard a word, or I don't think there's been anything in the paper or anything online about the length and time that it'll be shut down. You know, while our tourist season is soon upon us, the Overlook Trail is going to be closed. A week, two weeks ago, we had a festival at the Nature Center, and I cornered John Orona who was a speaker there and well, he didn't want to commit to a certain date and time. His words were "it's going to be a while, a long while. " The f;orest thinning process that 's being undertaken out there is immense. It is 340 acres, it is a rough terrain, and it is going to take a long time. Initially, there were two, f;our-man crews from Escondilla. Now, they've been called off and John Orona has brought in convicts to speed the process along. I understand the thinning process, I agree with it, and I encourage it being done. The problem is, how long do we want to let one Of our beautiful trails be shut down? It doesn't appear in talking to people and I 've canrvassed a lot of people within the Town, and we haven't heard a word. Does anybody care? I am hoping that the Town Council can take the time to try and nail down what is going on and how long until we can have our trail back open. I think it is important to the community and it is certainly important to the tourists. If you have ever been out there yourself you should know that there is a steady stream Of cars when it is open. So, hopefully, you as members Of the Council, can speed that process along and speak to the owners of the property and let us lanow what is going on. Thank you. " C. Consent Agenda Mayor Irwin announced consideration of the Consent Agenda and explained that all items listed would be acted upon by a single vote of the Council, unless a member of the Council asked that specific items be removed from the Consent Agenda, discussed, and voted upon separately. Vice Mayor Smith moved for passage of the Consent Agenda. C.1 Consider approval of the Minutes of the Town council Meeting held on March 17, 2022. By a unanimous vote under the Consent Agenda, Town Council approved the minutes of the Town Council Meeting held on March 17, 2022. C.2 Consider approval of the Town check Register for the period February 1 through 28, 2022 By a unanimous vote under the Consent Agenda, Town Council approved the Town Check Register for the period February 1 through 28, 2022. C.3 Consider approval of Transfer of ownership for Liquor License #00709001826 from Broadcast Intelligence, Inc. to Wine Mountains, LLC. By a unanimous vote under the Consent Agenda, Town Council approved Transfer of Ownership for Liquor license #00709001826 from Broadcast Intelligence, Inc. to Wine Mountains, LLC. D. Business Before the council Mayor Irwin announced that Public Comment will be taken at the beginning of each agenda item, after the subject has been announced by the Mayor and explained by Staff. Any citizen, who wishes, may speak one time for five minutes on each agenda item before or after Council discussion. Questions from Council Members, however, may be directed to staff or a member of the public through the Mayor at any time. Minutes of the Town Council Regular Meeting -April 7, 2022 Page 4 D.1 Presentation and update of the upcoming fire season, and the Ready, Set, Go program. Navajo County Emergency Manager, Catrina Jenkins presented. Chief Jim Morgan shared that July 30, 2022, will be the annual Firewise event. Chief Morgan stated that this will help educate the community on our wildfire risk. Council Member Beus stated that the rains are anticipated for July and asked if it would make more sense to have the annual Firewise event in June. Chief Morgan responded that they had experienced this with the Cedar Fire in 2016 and that they almost had to cancel the event because they did it earlier in the season. Morgan explained that a conscious effort was made to change the date so that it would happen during monsoon season. Morgan added that they have a more captive audience in the summer months due to the influx of summer visitors as well as the availability of schools. D.2 Consider the appointment of Timothy Kendzlic to the planning and Zoning Commission with a term to end July 2024. Community Development Director Loyd stated that there were two applicants for the Planning and Zoning Commission seat and with a vote of 3-1 Timothy Kendzlic was recommended to the Council for appointment to the Planning and Zoning Commission. Timothy Kendzlic introduced himself to Town Council and shared the following Lhiorrrrzrdon, " I 've been here 4 years. We develop and build homes here in the White Mountains and own a foooring company in Show Low. My wife and I have flour grandchildren and two sons. " Mayor Irwin stated that it is her understanding that the Planning and Zoning Commission had asked Mr. Kendzlic, should he be appointed to the Planning and Zoning Commission would he still be running for a Town Council seat. Mayor Irwin then asked Mr. Kendzlic if he had turned in his packet to run for a Town Council seat. Mr. Kendzlic answered, "Yes, I did." Minutes Of the Town Council Regular Meeting -April 7, 2022 Page 5 Mayor Irwin shared that Mr. Kendzlic had informed the Planning and Zoning Commission that he wasn't going to run for Council seat if a recommendation were made to appoint him to the Planning and Zoning Commission, and it seems now that he is. M:I . K!endzho res;ponded " I didn't say that. I said that the paperwork had to be in by Monday, April 4th and today is Thursday, April 7th. Okay? So, if I didn't get appointed to the Planning and Zoning, then I wouldn't have been able to run fior Council either. So, I'm covering myself: Mayor Irwin asked Mr. Kendzlic if he intends to not run for Town Council if he is appointed to the Planning and Zoning Commission tonight. Mr. Kendzlic responded "/feczf z.s rm); /feowgfe/ ". Council Member Beus moved to approve the appointment of Timothy Kendzlic to the Planning and Zoning Commission with a term ending July 2024. Vice Mayor Smith seconded the motion and by a show of hands the following vote was recorded. D.3 Consider adopting the Town of pinetop-Lakeside pension Funding Policy for Arizona Public Safety Personnel Retirement System. Finance Director Kevin Rodolph stated that in 2018 the legislature passed House Bill 2097 which requires the Town to publish on the website, a policy to fund our Tier 1 and Tier 2, Police Department personnel. Rodolph explained that the latest policy that is on the website is our 2019 policy. Rodolph added that over the last Minutes of the Town Council Regular Meeting -April 7, 2022 Page 6 year the Town has been working with bond advisors on how the Town would fund its unfunded liability. Rodolph stated that during that time, he didn't bring forth an updated policy because it was not clear what we were going to do. Rodolph explained that the during the audit presentation the only finding was that the Town did not have this updated policy on the website. Rodolph stated that the language and the policy comes from a model that the League puts out with the Town's figures for assets, accrued liability, and the unfunded liability, which comes from actuarial reports from PSPRS. Rodolph asked the Council to consider approving the policy for the year-ended June 30, 2021, which does not reflect the bonds the Town took out as of July 1, 2021. Rodolph shared that when the calculations are updated, he will bring a new policy to Council. Mayor Irwin asked if this would be annual and what time of year? Director Rodolph stated that it will be yearly, but the time is predicated on when the Town gets the valuation reports from PSPRS. Council Member Watson asked if Director Rodolph had an idea of what the Town's funding ratio will be when we receive the updated numbers. Director Rodolph stated that he anticipates that we will maintain 100 percent funded status. Council Member Beus moved to adopt the Town of Pinetop-Lakeside Pension Funding Policy for Arizona Public Safety Personnel Retirement System. Council Member Heisler seconded the motion and by a show of hands the following vote was recorded. AYES NAYS ABSTAIN Mayor Irwin X Vice Mayor Smith X Council Member Krigbaum X Council Member Snitzer X Council Member Watson X Council Member Beus X Council Member Heisler X Mayor Irwin declared the motion passed with a 7-0 vote. Minutes of the Town Council Regular Meeting -April 7, 2022 Page 7 D.4 Consider approving the proposal Agreement with American pavement Preservation for Type 2 slurry seal of 94,435 square yards of roadway within the Town of Pinetop-Lakeside Town Limits. Assistant to the Public Works Director Malaina Spillman explained that this proposal is for 94,435 square yards of sluny seal, which is the average of what the Town does annually. Spillman added that the Town has a five-year plan that rotates which roads get slurry sealed. Spillman explained that the County had already gone out to bid so the Town was fortunate enough to piggy-back off that contract. Mayor Irwin asked if this would occur in the current budget year. Spillman answered, "yes", and explained that slurry sealing typically starts in June. Vice Mayor Smith moved to approve the Proposal Agreement with American Pavement Preservation for Type 2 slurry seal of 94,435 square yards of roadway within the Town of pinetop-Lakeside Town Limits. Council Member Beus seconded the motion and by a show of hands the following vote was recorded. D.5 Information and public Hearing regarding the proposed amendments to Title 16 Chapter 16.24.08 Stieet Design and creating a new Chapter 12.24 Street Design in Title 12 STREETS, SIDHWALKS AND PUBLIC PLACES Resolution No. 22-1611, declaring as Public Record a Certain Document Filed with the Deputy Clerk and entitled "Town Code Amendments to Title 16 Subdivisions and Title 12 STREETS, SIDEWALKS AND PUBLIC PLACES": and Ordinance No. 22-447 Adopting the Town Code Amendments to Title 12 by adding chapter 12.24 Street Design Minutes of the Town Council Regular Meeting -April 7, 2022 Page 8 Community Development Director Loyd explained that after discussion regarding roads with Public Works Director Patterson they had come to the same conclusion. Loyd shared that street design is currently in Title 16 Subdivisions. Both Loyd and Patterson feel that moving street design to Title 12 Streets, Sidewalks, and Public Places and adding Chapter 12.24 Steet design, will allow Public Works to create new standards for roads. Malaina Spillman added that when it comes to private roads that may eventually have subdivided properties, the Public Works Department wants to ensure that those roads are held to a standard and by moving Chapter 16.24.08 Street Design to Title 12 and adding Chapter 12.24 Street Design it will allow the Town to adopt and maintain roads in the future. Mayor Irwin declared the Public Hearing open. No comments were offered. Mayor Irwin closed the Public Hearing. Council Member Beus moved to approve Resolution 22-1611 and adopt Ordinance 22-447 amending Title 16 by deleting Chapter 16.24.08 Street Design and creating a new Chapter 12.24 Street Design in Title 12 STREETS, SIDEWALKS AND PUBLIC PLACES. Council Member Heisler seconded the motion and by a show of hands the following vote was recorded. AYES NAYS ABSTAIN Mayor Irwin X Vice Mayor Smith X Council Member Krigbaum X Council Member Snitzer X Council Member Watson X Council Member Beus X Council Member Heisler X Mayor Irwin declared Ordinance 22-447 and Resolution 22-161 1 approved, passed, and adopted with a 7-0 vote. Minutes Of the Town Council Regular Meeting -April 7, 2022 Page 9 D.6 Consider the approval of Resolution No. 22-1612 for the naming of two private Casements to be named Wyoming Lane and Wild Lane. Director Loyd explained that the owner of this property came to him wanting to build a home, but there was not proper access to the property and the Town was unable to grant him an E911 address or a building permit. Director Loyd added that this also caused the landowner to have issues with the County in obtaining permits for septic. Loyd stated that the landowner and neighbors have signed a road maintenance agreement stating that these are private easements and private roads and that the Town will not be responsible for the maintenance of these roads. Director Loyd added that it is the property owner' s request to name the two private easements Wild Lane and Wyoming Lane. Council Member Krigbaum shared that she had been out to see the property and where the roads were going to be and was impressed with the new road that is going ln. Council Member Watson asked if the signage would be done by the property owners. Director Loyd responded that the road maintenance agreement states that signage and road maintenance are the responsibility of the property owners. Council Member Watson recommended that the property owners install a sign that clearly states, Wild Lane and Wyoming lane are private roads that are not maintained by the Town of Pinetop-Lakeside. Director Loyd directed the question to Mr. Greg Sarchet, the property owner, who was present. Mr. Sarchet agreed to install a sign stating that the roads are not maintained by the Town of Pinetop-Lakeside. Vice Mayor Smith asked if the road maintenance agreement has been recorded against the property. Director Loyd stated that it has been recorded in perpetuity. Loyd added that if the property sold, Mr. Sarchet would be responsible until it is recorded by the new Owner. Council Member Krigbaum moved to approve Resolution No. 22-1612 for the naming of two private easements to be named Wyoming Lane and Wild Lane. Minutes Of the Town Council Regular Meeting -April 7, 2022 Page 10 Council Member Beus seconded' the motion and by a show of hands the following vote was recorded.
