The Invocation was offered by Town Manager Keith Johnson B. Call to the Public Mayor Irwin called for public comments. Ken Cail offered the following comments, “Well, naturally, I had written down a speech on my phone and it doesn’t show up. I would like to thank Mayor Irwin and the Council for this opportunity to speak to you. I wanted to speak about the dog park that we don’t have in our Town. I feel that this would be a great opportunity for us to listen to our constituents because that was the second highest item on the survey in 2023, I believe. Dog parks are one of the fastest growing entities in parks. They are being built throughout the nation. There are over 43 million households with dogs, and 38 million with children. So, it is a popular thing. Dog parks are good for dogs because it allows them to have interaction with other dogs and settle them down. They can spend a lifetime without communication with other beings. It is kind of tough or limited and I think that produces well-rounded dogs that are not going to be a problem for the Town later on. The owners of the dogs can also have a chance to speak to other people that have like-minded interests which is a good thing for the development of the Town. They will probably speak about Town issues and get support for the Council and for the community itself. You set a standard when you say we don’t have a dog park. I agree with the Council’s decision to penalize people who are going to not be responsible and allow their dogs to create unsanitary conditions on our fields. I think that is important. I wish we could have some factor that could affect the wildlife too, but that is harder, we need to be humane in that area. I would like to end with saying that Show Low provides a dog park and people know about it through the internet. When you are traveling across the country, they pick out towns that have a dog park so they can stop, and when they stop, they buy food and interact with the community. They might even come back and buy property in Show Low, because Show Low has a dog park. I have talked to people at the dog parks, and they feel like that is something that helps benefit their town. I hope that we consider a dog park. I know that we can produce a dog park that is inexpensive by testing or using temporary fencing like they do in Mesa. I have shown some Council Members these ideas and I hope that you support Minutes of the Town Council Regular Meeting. November 21, 2024. Page 3 them. I think testing is a good idea. It would be temporary, and you can see if it is a good idea. Thank you.” C. D. Business Before the Council D.1 Town of Pinetop-Lakeside Proclamation “Small Business Saturday” In the Town of Pinetop-Lakeside, Arizona, November 30, 2024. Mayor Irwin read the Proclamation and proclaimed November 30, 2024, “Small Business Saturday” in the Town of Pinetop-Lakeside. D.2 Recognition of Planning and Zoning Commissioner’s Harry Turner and Todd Fernau for their Dedicated Service on the Planning and Zoning Commission, and Accept the Resignation of their Commission Seats Effective November 21, 2024. Community Development Director Loyd stated that Harry Turner served as a Planning and Zoning Commissioner since July 21, 2022. Director Loyd shared that Mr. Turner was a valuable member of the Commission. Mr. Turner displayed his commitment to the position of Commissioner by faithfully reviewing the material received before meetings, asking great questions and making suggestions. Mr. Turner had exemplary attendance at the Planning and Zoning Meetings, he also attended numerous Town Council meetings and training sessions in order to be educated and efficient in his decisions. Mr. Turner served as Chairman of the Planning and Zoning Commission from August 24, 2023, to August 8, 2024. Director Loyd stated that Commissioner Turner ran for a seat on Town Council at the July 30, 2024, Primary Election and received a majority of votes cast, qualifying him for a seat on Town Council. Mr. Turner will take an Oath of Office as a Town Minutes of the Town Council Regular Meeting. November 21, 2024. Page 5 Council Member at this meeting, vacating his seat on the Planning and Zoning Commission effective this 21st day of November 2024. Todd Fernau was appointed to the Planning and Zoning Commission on January 5, 2023. Commissioner Fernau has been a dedicated member of the Commission and has brought a unique perspective to the Commission with his vast knowledge of the Town and its surroundings. Mr. Fernau was raised in the White Mountains and has a vested interest in the Town of Pinetop-Lakeside. Director Loyd shared that Mr. Fernau ran for a seat on Town Council at the July 30, 2024, Primary Election and received a majority of votes cast, qualifying him for a seat on Town Council. Mr. Fernau will take an Oath of Office as a Town Council Member at this meeting, vacating his seat on the Planning and Zoning Commission effective this 21st day of November 2024. Director Loyd stated that Planning and Zoning Commission terms got off-track somewhere over the years. After looking at Town Code and the Commission terms, Town Clerk Salskov requested that we appoint two Commissioners to fill the vacated Commission seats with terms ending in 2026. This will get the Planning and Zoning Commission terms back on track. Director Loyd thanked Mr. Turner and Mr. Fernau for their dedicated service on the planning and Zoning Commission and presented them with plaques of appreciation that noted their time served on the Planning and Zoning Commission. Mayor Irwin thanked Harry Turner and Todd Fernau for their service on the Planning and Zoning Commission. Vice Mayor moved to approve the resignations of Harry Turner and Todd Fernau from serving on the Planning and Zoning Commission effective November 21, 2024. November 21, 2024. Page 6 D.3 Recognition and Appreciation of Council Member’s Lynn Krigbaum and Jim Snitzer for their Many Dedicated Years of Service on the Pinetop-Lakeside Town Council. Mayor Iwin offered the following comments for Council Member Snitzer, “This is a bittersweet evening because we have worked with these two individuals for a number of years. Councilor Snitzer was elected in 2016 and has served on Town Council for eight (8) years. I know there is a little bit of background in the packet, but I also wanted to say a few words. Jim, I have really enjoyed serving with you these past eight years. You have such a way with words. You can tell everyone exactly how it is with a smile on your face, and they still consider you a friend. I truly wish that I had a way with words, like you. I think we can all learn from that. Your life experiences have brought so much to this Council, and your historical perspective has really enlightened all of us. You know so much about what has happened in our community over the years. I know you were absent for a lot of years, but I know you still kept us close. Thank you for your service. You will be missed as a member of the Council, but I know it is not goodbye because as Kristi wrote in the packet, you worked with Tracks, the Nature Center of the White Mountains, and the Irrigation District, just to name a few. I know we will continue to see you around Town. We thank you for everything that you have done.” Council Member Phillips said he appreciated all of the stories Councilor Snitzer shared with him. Town Manager Keith Johnson offered the following comments, “I remember the election of 2016. I had just been hired as the Town Manager. Jim and Jerry were part of the original group that was elected to Town Council when I started with the Town. This Council provided stability which was lacking at that point. That stability spread throughout the whole Council. So, we were able to get a lot accomplished. I appreciate the opportunity I had to work with Jim.” Council Member Smith offered the following comments, “Jim, we really appreciate all of your expertise and your way with words. You certainly have shown us a great person on the Council. We will always remember the election of 2016. That will go down in the history books as a one time coup. Five of us ran together and unseated the previous Council. Good job, Jim.” Mayor Irwin offered the following comments for Council Member Krigbaum, “Lynn was elected in 2018. When she ran for office, she made it no secret that her reason for running was to secure Woodland Lake Park for the Town. That was her whole purpose. Lynn, through your passion and persistence, we have done that. We will continue to work towards obtaining the rest of it. Along the way, Lynn’s Minutes of the Town Council Regular Meeting. November 21, 2024. Page 7 horizons were broadened to many additional things and more concerns that also became a passion. Your love of the outdoors and our beautiful environment have guided you along the way. You also picked up some skills that I am not really sure you expected to gain at this point in your life. I know Matt and our Public Works crew appreciates your assistance in operating the paver. We really appreciate that. I went out and inspected your work and you did a really good job. Your steadfast service is much appreciated, and I know our paths will continue to cross. You and David are important members of our community. You are leaving us quite a legacy.” Council Member Jerry Smith offered the following comments, “Lynn, only six years? It seems like you came in with us. We have always appreciated your perspectives of the trails, outdoors, forest and of wildfires. You have always had a great insight into what is great about Pinetop-Lakeside and what makes it so wonderful.” Town Manager Keith Johnson offered the following comments, “Even before Lynn was elected in 2018, she served on the Advertising and Promotion Committee. I do not think a lot of people know the work she did behind the scenes for this Town. I know we talk about Save our Park and acquiring Woodland Lake Park, and she did, she saved the Park. Lynn would take a table out to the Park to greet people and hand out information. She has also been a goodwill ambassador with the businesses. She would come to Town Hall every week for copies of flyers to take to all the businesses, hotels and restaurants in Town. These are just a few of the many things that she has done to benefit the community. Very few people know that she did that. I am grateful for all that you have done for our community.” Mayor Irwin presented Council Member Krigbaum and Council Member Snitzer with clocks that were engraved with their dates of service on the Pinetop-Lakeside Town Council. Mayor Irwin also presented them with a book of remembrance that included photos and notes from staff. A short video commemorating both Council Member Krigbaum and Council Member Snitzer was shown. D.4 Presentation of Certificates of Election and Administer the Ceremonial Oath of Office to Council Members Elect Harry Turner, Todd Fernau, Jerry Smith, and Jeffrey Phillips. Town Clerk Salskov presented Council Members Elect Harry Turner, Todd Fernau, Jerry Smith, and Jeffrey Phillips with their Certificates of Election. Magistrate Judge Higgins performed the ceremonial Oaths of Office. Page 8 D.5 Consideration of Resolution No. 24-1759, Electing a Vice Mayor to Serve a Term of Two (2) Years (2024-2026) and Perform the Ceremonial Oath of Office for the Elected Vice Mayor. Town Clerk Salskov stated that a Vice Mayor shall be elected every two years at the first Town Council meeting after newly elected officials are sworn- in and seated, in even numbered years, by Council Members from their membership. Town Clerk Salskov shared that Sterling Beus was elected to serve as Vice Mayor on December 1, 2022, by the sitting Council, and has served for the full two year term (2022-2024). Council must elect a Vice Mayor to serve for the next two year term (2024-2026). Magistrate Judge Higgins will administer the Ceremonial Oath of Office for Vice Mayor. Council Member Smith moved to adopt Resolution No. 24-1759 electing Sterling Beus to serve as Vice Mayor for the Town of Pinetop-Lakeside for a term of two (2) years (2024-2026). D.7 Consideration of Resolution No. 24-1760, Approving the Updated Code of Conduct for Elected and Appointed Officials. Town Clerk Salskov explained that after a thorough review of the Town Council Manual an update to the Code of Conduct for Elected and Appointed Officials was needed. Town Clerk Salskov stated if Council approves the updates made to the Code of Conduct, the Town Council Manual will be updated and will be reviewed with Council at the January Town Council Orientation. Vice Mayor Beus moved to approve Resolution No. 24-1760 adopting the updated Town Council Code of Conduct for Elected and Appointed Officials as presented. D.8 Information, Discussion, and Consideration of Resolution No. 24-1761, Awarding a Bid Contract to Olney Construction for Concrete Work and Installation of ADA Ramps and Curbing at Mountain Meadow Recreation Complex. Public Works Director Patterson said that the new ADA Path at Mountain Meadow Recreation Complex will intersect with the road in a few areas. Every area where the Path intersects with the road will need ADA Ramps. The Ramps are fairly large, measuring approximately 12ft. by 15t., and require a lot of concrete, which is why the cost is so high. Director Patterson shared that this Project is grant funded. The Town received a Grant in the amount of $104,000 from Arizona State Parks. The remaining $22,000 will be paid for by the Town. This project will also include new curbing and gutters to help prevent flooding to the parking lot. Director Patterson offered the following comments regarding the Bid process and Purchasing Contracts. “We talk a lot about going to bid and following those processes. It seems like sometimes there is controversy over how we purchase things here at the Town, especially because I use a lot of contracts or IGA’s. I just want you to realize that with the bid process for this ADA Ramp Project, we reached out to all the contractors that we possibly could, yet, we still only received one bid. I believe this is a competent and acceptable bid from a good contractor. But, it is the frustration of only having one bid come in. As you guys have seen in the past, I tend to present Purchase agreements or a National Purchasing IGA. I wanted to bring that to your attention. For this Project, we went through the bid process, which is a very long process, and we still cannot get the local contractors to bid on our work. I believe it comes down to all the additional things that the State requires, such as the different types of insurance and the liabilities. So, we are going to continue to march forward on a JOC Contract which will be more of a five or six year contract that will have these things in it, and we will approve one job at a time. I wanted you to know the reasons we are working towards those JOC Contracts. Almost all municipalities are leaning towards the JOC’s for the same reasons.” Minutes of the Town Council Regular Meeting. November 21, 2024. Page 11 Mayor Irwin asked when the work is projected to be completed. Director Patterson said they are hoping to be completed by the spring. Council Member Phillips asked if the $22,896. that is not covered by the Grant is in the budget for next year. Director Patterson stated that the funds are in this current Fiscal Year Budget as the Mountain Meadow Improvement Capital Plan, which is in the Capital portion Council approved for this year. These funds will cover a portion of this Project as well as a portion of the Water Tank that will be installed at Mountain Meadow. Vice Mayor Beus asked about other developments that may go in the front portion of Mountain Meadow where some of the new curbing is to be done. Director Patterson said there are two vacant lots in the front of Mountain Meadow Recreation Complex, off of Woodland Road that are slotted for development. Director Patterson said he believes that there is approximately 27,000 ft available, adding that an inclusive playground requires approximately 14,000 ft. A retention pond will be required for a portion of land located on the south side. Council Member Heisler moved to approve Resolution No. 24-1761, Accepting the Bid and Awarding Mountain Meadow Recreation Complex (MMRC) ADA Ramp and Curbing Project No. 23-002 Contract to Olney Construction in an amount not to exceed $126, 896.36; and authorize the Town Manager to execute all documents necessary to complete this transaction.
