Any prayer/invocation that may be offered before the start of regular Council business shall
be the voluntary offering of a private citizen, for the benefit of the Council and the citizens

previously reviewed or approved by the Council, and the Council does not endorse the
religious beliefs or views of this, or any other speaker. A list of volunteers is maintained by
the Town Clerk’s Office and interested persons should contact the Town Clerk’s Office for
further information.
B. Call to the Public Mayor
This is a business meeting of the Town Council. The Town values and welcomes public
input. Please address the Council as a whole and not individual Council Members. Do not
address staff or members of the audience. Council action on items brought up in Call to the
Public is limited by the Open Meeting Law. The Council may direct staff to study the matter
and reschedule for further consideration at a later date. Items on the agenda will not be heard
or discussed in Call to the Public. Individuals are limited to three (3) minutes.
C. Consent Agenda Mayor
All items listed in the Consent Agenda are considered routine matters and will be enacted
by one motion of the Council. There will be no separate discussion of these items unless a
Member of Town Council requests that an item or items be removed for discussion. Council
Member may ask questions without removal of the item from the Consent Agenda. Items
removed from the Consent Agenda are considered in their normal sequence as listed on the
agenda, unless called out of sequence.

Town Manager Johnson presented Town Council Organization and Procedure and
duties of the Town Manager.
Town Clerk Salskov presented duties of the Clerk’s Department, a general overview
of duties of the Board of Adjustment, Consolidated Fee Schedule, Parliamentary
Procedure, Open Meeting Law, You as a Public Official, Guide to Preparing and
Adopting Local Laws and Anatomy of a Council meeting.
Community Services Director Alba presented an overview of the Community
Services Department. Marketing Coordinator DeRosier and Creative Services
Hephner offered comments. There was discussion regarding the White Mountain
Balloon Festival.
Community Development Director Loyd presented duties of the Community
Development Department and the Planning and Zoning Commission.

Finance Director Rodolph presented duties of the Finance Department, the 2018
Purchasing Policy, and Home Rule.
Public Works Director Patterson presented duties of the Public Works Department
and gave an update of accomplishments from 2024 as well as upcoming projects.
Library Director Peck presented duties of the library staff and shared updates on
upcoming Library events.
Police Chief Barnes presented duties of the Police Department and updates.
Town Manager Johnson encouraged all to read and study the information in the
Town Council Manual that has been put out by the League of Arizona Cities and
Towns.
Mayor Irwin thanked staff for their work and all for attending the Work Session.

Mayor Irwin read the Proclamation and proclaimed February 2025, Black History
Month in the Town of Pinetop-Lakeside.

D.5 Discussion and Consideration of Resolution No. 25-1767,
Approving an Increase of Town Council Compensation for the
Performance of Official Duties.
Town Manager Johnson shared that Council Members receive compensation for their
service on Town Council. A.R.S. 9-232.01 provides that the common council may by
ordinance or resolution prescribe a daily compensation or salary to be paid to the
mayor, council members, and administrative board members for the performance of
official duties. The Arizona League of Cities and Towns has published “What all
Elected Officials Need to Know”, which states that a council may not increase its
own compensation, therefore any approved salary increases do not take effect until

after the next regular election. For example, if this increase is approved, only the
council members that are elected during the 2026 election will be eligible for the
increase on December 1, 2026. Council Members that are elected during the 2028
election will be eligible for the increase starting December 1, 2028. Town Manager
Jonson stated that Council Compensation for Pinetop-Lakeside has not been
increased since 1997. An analysis of surrounding cities and towns of a similar size
shows that our Council compensation is substantially lower than surrounding
municipalities, several of which were recently increased. Town Manger Johnson
shared that Council Members not only attend two regularly scheduled Town Council
Meetings a month, but they also participate in work sessions, budget sessions, act as
liaisons for multiple boards and committees, attend Town events, and attend benefits
and charity events. Town Council Members also dedicate time to perform service
within our community such as serving lunch at the White Mountain Community
Center and participates in ADOTs Highway Adopt a Mile roadside clean-up. Town
Manager Johnosn shared that the Pinetop-Lakeside Town Council is one of the
busiest Councils he has worked with.
Town Citizen, Jim Snitzer offered the following comments, “Good evening Mayor,
Council, and members of the public. I am Jim Snitzer, and I live in Lakeside. I would
like to speak in support of Resolution No. 25-1767. I feel that I am in a uniquely good
position to comment on this. Until last November’s election, I was on this Council.
So, I know what the job entails. I am no longer on this Council, so I have absolutely
no conflict of interest in speaking on this item. I think of all of the people on the
Council I am the most active volunteers in this Town. Luckily I am in this age of
computers. I put all of my activities on a calendar which made it easy for me at the
end of last year to report the time I spent to one of the organizations that I volunteer
for. When it came to the Council, because I was so active on all of the other
organizations I believe I spent less time on Council activities than any other Council
Member. So, I am the lowest common denominator, I did my calculation of hours for
a 10-month period while on Council. I counted 159 hours. That is the kind of
commitment it takes. I don’t know that Council even realizes how many hours they
spend. I am certain the public doesn’t know the time spent. So, if you figure the
amount of time that the Council spends, I am not sure it is even minimum wage.
Probably not. So, I think a raise for Town Council Members is long overdue. I know
from being on the Council how hard everybody works to support this Town, and I
encourage the passage of this Resolution, Thank you.”
Mayor Irwin thanked Mr. Snitzer for his comments and asked for Council discussion.

Mayor Irwin offered the following comments, “I will start by saying, I know we did
put it in the budget for this year, but clearly we missed the time frame to be able to
do that. This should have come before us a long time ago. I have spoken out against
this because when I ran for Council I never expected to get paid, it was just my service
back to the community. I prefer not to get a raise. I would prefer to put the money
towards our employees or towards other things in the community.”
Council Member Turner offered the following comments, “Last year when we were
putting the budget together for this year, I think everyone that was a part of the budget
process knows that I was against it also. It is a privilege to sit here on this Council
and do the things that we are doing for the Town, at the best of our ability, and we
are not doing it for money. I am against the raise. I think there are a lot of people in
our community that are not doing that well out there and I just can’t see, for a
volunteer like me, representing the people to accept a raise or even support a raise
for anyone here. It is a relatively small amount of money. I know there is a dollar
amount here of $37,000. Dollars. I didn’t bring my numbers with me, but I think it’s
like an extra $8,000 or $9,000 out of our budget. It is not a question of the money; it
is a question of the privilege and the optics of it.”
Vice Mayor Beus offered the following comments, “I am very much in support of
this increase. I agree with you; it is a privilege to serve on Council. I do not know of
any of us who do it for the money. But I do believe that while I have been on Council,
we do try continually to keep our staff at least on the same par with all the other
communities around as far as what they are getting paid and in some cases better
than the surrounding communities. I think it is appropriate to do that for the small
stipend that goes to Council as well. Again, it will be almost 30 years by the time this
will take effect because it would not take effect for another two years for some of the
Council. I think it is very appropriate to have an increase. Some of us will never see
that, and that is fine. I still think, again, it is an appropriate thing to do. It is bringing
us up on the same par with the communities around us, who, in most cases, have
made quite a bit more than we have over the last few years.”
Council Member Heisler offered the following comments, “I will share that I was
opposed this in the Study Session when we discussed it, and I am no less opposed to
it today. I think the Council does a very good job managing the Town where it is, but
I think every year when we are talking about whether or not we are going to give the
Town Employees raises, I cannot support a place where we give ourselves a raise
yet, we haven’t even discussed whether or not we are going to do that for our
employees this year. I do not think it is a good use of money and I for one was very
surprised when I got on the Council that I got any money at all because that was not
the point. I also feel for all the things that the Council does, we can use a Town
vehicle, and the Town pays for the fuel. I also agree that I put in a lot of hours with
Council, but I do that because I choose to, not because I am mandated to. The special

events I can attend, I do. If I can’t attend some, I don’t. Other than that, I come to
council meetings and for the little stipend we get right now, $250.00 dollars per
month, I feel like I get compensated pretty well for that and that is my opinion.”
There was no further discussion. Mayor Irwin called for a motion.
Vice Mayor Beus moved to adopt Resolution No. 25-1767 approving an increase in
Town Council compensation for the performance of official duties to become
effective on December 1, 2026 for Council Members elected during the 2026
election; and December 1, 2028 for Council Members elected during the 2028
election. Council Member Phillips seconded the motion.
With a motion and a second, Mayor Irwin asked if there was any further discussion.
Vice Mayor Beus offered the following comments, “I might just bring up, we did
discuss this at a Work Session with the former Council and in fact we came to a
consensus in that meeting to move forward with it, and realistically this should have
been brought before that Council. But anyway, it is being brought now.”
There being no further discussion.
Mayor Irwin continued. With a Motion and the second on the table Mayor Irwin
asked for a show of hands and the following vote was recorded:

D.6 Discussion and Consideration of Resolution No. 25-1766, Authorizing
An Intergovernmental Agreement (IGA) with Navajo County for the
Provision of Providing Election Services to the Town of Pinetop-Lakeside
For a Term of Four (4) Years, Expiring on January 1, 2029.
Town Clerk Salskov explained that Navajo County handles voter registration, ballot
preparation, election day operations, and election results tabulation. Town Clerk
Salskov shared that the Intergovernmental Agreement was reviewed by Attorney

Sims and found the terms acceptable. Town Clerk Salskov said she has a great
working relationship with Navajo County and asked that Council approve the IGA
with Navajo County for the provision of election services with a term end date of
January 1, 2029.
Council Member Heisler moved to adopt Resolution No. 25-1766 authorizing an
Intergovernmental Agreement between Navajo County and the Town of Pinetop-
Lakeside for the provision of election services for the Town of Pinetop-Lakeside for
a term of four years to expire on January 1, 2029. Vice Mayor Beus seconded the
motion and by show of hands the following vote was recorded:

D.7 Discussion and Consideration of Resolution No. 25-1768, Approving
and Authorizing the Town Manager to Enter into an Agreement Between
the Town of Pinetop-Lakeside and the Washburn Trust for the
Purchase of 2.08 + Acres located at 141 W. White Mountain
Blvd. Lakeside, Arizona 85929.
Pursuant to A.R.S. §38-431.03(A)(3)(7) the Council may vote to enter into
Executive Session for the following purpose:
A. Upon a public majority vote of the members constituting a
quorum, a public body may hold an executive session but only
for the following purposes:
3. Discussion or consultation for legal advice with the
attorney of the public body.
7. Discussions or consultations with designated
representatives of the public body in order to consider its
position and instruct its representatives regarding
negotiations for the purchase, sale or lease of real property.
Discussion regarding the purchase of Real Property.
No action will be taken in Executive Session.

If Council votes to enter into Executive Session, they will reconvene to the Open
Meeting to vote on item D.4.
Town Manager Johnson shared that the Town has an opportunity to secure 2.08 +
acres next to Town Hall. Town Manager Johnson stated that purchasing the property
would preserve the aesthetics of Town Hall and prevent businesses that may not be
compatible in nature. Manager Johnson said it is important to be forward looking in
the event that future expansion of Town Hall is needed. The original owner of the
Town Hall building placed deed restrictions on the property limiting who can develop
or what type of business could be developed on the property, which makes it difficult
for the owner to sell. Town Staff recommended that Council move forward with the
purchase of the 2.08 + acres located next to Town Hall.
Town Citizen, Jeff Stearns offered the following comments, “Good evening, Mayor,
Vice Mayor, Council, Staff, and members of the public. So, I read the CDR associated
with this. It confuses me. As I see it; I don’t see any justifiable business case or benefit
to the Town for this Resolution. So, let’s go through it. It is basically requesting the
Town to convert a liquid asset, capital, cash , however we want to call it, to very
much a non-liquid asset, real estate. The property would become, in my opinion, a
liability and an expense to the Town because the Town would have to have
appropriate insurance on it, maintain it, I don’t know how taxes work with the
property, but there will be expenses associated with it. The Town, as was pointed out
already, possesses the potential position that we can limit development options. So,
when the statement is made that it provides the Town the ability to limit the businesses
that may be coming onto that property, well, we already have that, and at no expense.
We are in an optimal position at this point in time, and there is no cost currently to
the Town for that position. So, why convert actual liquid capital to something that
has no return on investment associated with that capital? The only challenge that this
Resolution mitigates is to the seller, and frankly, that is their challenge, and they
should have thought about that at the time that the transaction took place. Why make
the seller’s problem the Town’s problem? There is no need for this whatsoever. And
further, I really don’t want the Town in the commercial real estate business. I do feel
very strongly about this. If it does pass, and the capital is spent, it is my opinion that
this warrants an investigation into potential misuse of Town capital. Mayor, I have
one additional request if I could. I would like you to consider a roll call vote
associated with this Resolution. Thank you very much for our time and listening to

Navajo County citizen, Larry McCormick offered the following comments, “Madam
Mayor, I specifically asked to talk after the presentation.”
Mayor Irwin said that Town Manager Johnson did present the item.

Larry McCormick continued, “okay, well, I guess. My name is Larry McCormick.
Everybody probably knows, I live in the County. It seems recently that the last two
proposed transactions, one of Planning and Zoning and one of Council have brought
about a new way of doing business, and that is to work on a project for a year and a
half and then with a week’s notice it hits the agenda and is voted on. No time for
public input, very little time for public input as the gentleman before me did, and I
was pleased to hear that by the way. So, in any case, it just bothers me that you don’t
seem to care about public input, and they are not given an opportunity even if, I
don’t know what the email list looks like when the agendas go out. So even fewer
people are seeing it, and obviously fewer people attend our meetings. It is certainly
not illegal to do this, but it certainly smacks of politics in my eyes. My personal
opinion is that we should all be given proper notice and time to have our opinions
heard. I don’t think I have heard any numbers. I saw that Dr. Washburn had the
property listed at like $395,000. dollars, and I heard a rumor, right or wrong, that
the sales price was around $320,000. dollars. Certainly that’s a lot of money to keep
people from wanting to build a business that doesn’t fit the Town’s liking. So, you
know, that was accomplished quite well with the dollar store or whatever it was,
Dollar General, restrictions were put on the purchase, and they backed out. They
didn’t have to spend $300,000. and some odd thousand dollars, approximately, to
get that accomplished. So, I mean there is a lot of things in Town. I remember
attending a meeting on Forest Lane a few years ago. I sat next to Keith, and they
were concerned about the traffic flow coming from Woodland Lake Rd. They were
using a shortcut through Forest Lane, a rather sleepy little street about two blocks
long and they wanted to do certain things to derail the traffic. The main thing was to
get a stop light on probably one of the worst intersections in Town. The response
from the Town Manager was, I’m not naming you specifically, Keith, was, “we don’t
have the money”. Now we have got the money, where is it better spent? Serving a
large portion of the community, or to save two acres?, not save it, but control it for
however long deemed necessary. So, anyway, that’s what I got for you tonight.”
Town Manager Johnson addressed Mr. McCormick’s comment regarding Woodland
Lake Road stating that a Warrant Study was done on the aforementioned intersection
and ADOT would not put a light in.
Town Manager Johnson said that an appraisal is not in the paperwork, but it is
mentioned in the Contract that an appraisal will be performed. If the property does
not appraise for the purchase amount agreed upon then the Town can back out of the
Contract.

Mayor Irwin stated that the original asking price was approximately $500,000.
dollars. Mayor Irwin said she understands the comments made but feels this is a
forward-looking move on the part of the Council, to have room for expansion, should
it be needed or if other opportunities arise. Mayor Irwin said she feels this is a good
investment for the community.
Council Member Heisler shared that he also feels this is a good investment, adding
that there are many cities and towns that are buying commercial property and looking
for growth opportunity all over the State, including our neighbors here in the White
Mountains. Council Member Heisler stated that he is in favor of purchasing the
property and believes it is a good purchase for the Town. A few points that Council
Member Heisler shared are Real estate prices continually go up and if the Town ever
needed to sell it, they could do so. This property could easily be used if the Town
needed space to grow in the future.
Council Member Smith shared that he feels it is very important for the Town to plan
for the future. Council Member Smith said the Town did not have the opportunity to
bring the Justice Court to Town Hall due to space and parking issues and reminded
all that the Court Building is in a different location from Town Hall. Having the lot
adjacent to Town Hall could be a benefit to the Town in the future if growth is needed.
Council Member Turner shared that he feels the price of the property is a good deal
but said he is concerned about the proposed Bill HCR2021 that if passed by the
Legislature, the Town could possibly loose up to $1,000,000. dollars in revenue.
Council Member Turner also mentioned the possible acquisition of the Woodland
Lake Park Tract that will cost the Town approximately $100,000. dollars annually to
maintain. Lastly, Council Member Turner voiced concern over salaries of the Police
Department and of the Public Works Department.
Council Member Fernau stated that he is in favor of the purchase of the property
adding that the Town holds the card to the deed restrictions. As a value-prospect, the
Town can change the deed restrictions once we own the property, thus adding value
to the property, potentially making it a very profitable acquisition. Council Member
Fernau also shared that there is a well on the property and with the central location
of the property in the Town, the potential for the well to produce water is of great
value to the Town.
Vice Mayor Beus stated that he is in support of this purchase and feels it will be an
asset to the Town for the purpose of expansion if needed.

Council Member Heisler moved to adopt Resolution No. 25-1768 approving and
authorizing the Town Manager to enter into an agreement between the Town of
Pinetop-Lakeside and the Washburn Trust for the purchase of 2.08 + acres located at
141 West White Mountain Blvd. Council Member Smith seconded the motion and
by show of hands the following vote was recorded:

A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF
PINETOP-LAKESIDE, ARIZONA, RESCINDING RESOLUTION 91-253 AND ALL
SUCCEEDING RESOLUTIONS FORTHE PURPOSE OF ESTABLISHING REVISED
ROAD MAINTENANCE POLICIES BASED ON THE PROPOSED NEW TOWN CODE
CHAPTER 12.26 “TOWN OF PINETOP-LAKESIDE ROAD MAINTENANCE.”
WHEREAS, Public Works Department staff has drafted a Road Maintenance Policy to be added
to Town Code Title 12 as Chapter 26 “Town of Pinetop-Lakeside Road Maintenance”; and
WHEREAS, Resolution 91-253 and succeeding Resolutions categorizing roads within the
incorporated boundaries into Category I, II, and III need to be rescinded for the purpose of
implementing a new road classification system providing a method of prioritizing services based
on road function and Pavement Condition Index (PCI) as proposed in Town Code Title 12 Chapter
26 “Town of Pinetop-Lakeside Road Maintenance”; and
WHEREAS, rescinding Resolution 91-253 and succeeding Resolutions categorizing roads into
Category I, II, and III will allow the Town to provide road construction and maintenance services
in an equitable and objective manner based on proposed Town Code addition of Title 12 Chapter
26 Town of Pinetop-Lakeside Road Maintenance.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Town Council of the Town of
Pinetop-Lakeside as follows:
Section 1: Resolution No. 91-253 and all succeeding Resolutions categorizing roads into Category
I, II, and III is hereby repealed.
Section 2: This Resolution No. 25-1769 is hereby enacted and shall become effective
upon the execution hereof.
