MINUTES OF SPECIAL CALLED SESSION PIPERTON BOARD OF MAYOR AND COMMISSIONERS November 8, 2019, 3:30 P.M. The Piperton Board of Mayor and Commissioners met in a special called session on November 8, 2019, at 3:30 p.m. at City Hall, with Board members: Mayor Henry Coats, Commissioner Preston Trotter, and Commissioner David Crislip present. City Manager Steve Steinbach, City Attorney Gerald Lawson and City Recorder Beverly Holloway were also present. Vice-Mayor Mike Binkley and Commissioner Hugh Davis were absent. John Henszey, William and Ruby Meacham were also present in the audience Agenda item 1. Call to order, establish quorum Action taken: Mayor Henry Coats called the meeting to order at 3:30 p.m., and established that a quorum was present. Agenda item 2. Resolution No. 19-213, to overturn and enjoin the adequate facilities tax increase by Fayette County Government Mayor Coats stated they want to go from $.60 to $1.00, they are getting the money from new house starts and it may slow house building down and the City doesn’t see a cent of the adequate facilities tax and Piperton builders have paid over $200,000.00 in adequate facilities taxes in the last 3 years, Piperton is the number one contributor, and there is also supposed to be a trail where this money is spent and the Cities don’t see that either so there are six cities (Oakland, Piperton, LaGrange, Rossville, Galloway and Somerville) that have passed or are passing similar resolutions and a brief discussion ensued. Mayor Coats stated to modify the last line of paragraph one by removing “and for commercial/industrial construction from $.25 to $.25 per square foot of construction” because this is dealing with residential only. Gerald Lawson, City Attorney, stated commercial did not go up just residential. John Henszey inquire what the money was spent for. Mayor Coats stated there is not a clear trail of the money. Mr. Lawson stated the original act, what the money is supposed to be spent on or the purpose of such tax is to insure the persons responsible for new development share in the burdens of growth by paying their fair share of the cost of new and expanded public facilities made necessary by such development and the concern is that the money is not being spend on new and expanded public facilities that are made necessary by development but it is just being allocated throughout the County’s budget and supplements the County’s budget in other areas such as infrastructure, the Cities have received no significant impact or money from this revenue even though they are the majority of the ones generating it and the essential part of this too is the County made this without any notification to any of the cities on how they are or may be spending this and there is a question to whether they are complying with the act itself on how they are allocating the money. Commissioner Crislip stated it is actually at 67 % increase. Action taken: Commissioner Preston Trotter moved to approve Resolution No. 19-213 with the modification as indicated by scratching out the last line in the first paragraph, seconded by Commissioner David Crislip. The Motion received all affirmative votes. Agenda item 3. Adjournment. 1  Action taken: Commissioner Trotter made a motion to close this meeting, seconded by Commissioner Crislip.
