MUNICIPAL GOVERNMENT COMPLEX – ZOOM
6:00 P.M. – TUESDAY, JULY 14, 2022
TO ORDER
At approximately 6:00pm Chair Person David Fishback called the meeting to order. The
Introductory Statement of BZA Duties were outlined as well as the order of business to
be followed. Meeting conduct procedures were reviewed and those in attendance
were sworn in. All present were asked to stand and raise their right hand. The Chairman
administered an oath to all present to testify before the BZA asking them to swear or
affirm to tell the truth, and to acknowledge their intent to abide by the oath
administered by stating, “I do” or “opposed”. All present stood and took the oath to tell
the truth with all persons present stating “I do”.

MEETING MINUTES
Approval of the minutes from the July 26, 2022 Board of Zoning Appeals Meeting were
approved by voice vote.
NEW BUSINESS
RESOLUTION BZA 14-22 – REMOVED FROM AGENDA
A resolution to appeal the decision of the enforcing official regarding a fence at 903
Candlewood Boulevard
Staff explained that this item was removed from the agenda, as the issue was resolved
prior to the meeting date.
RESOLUTION BZA 15-22
A resolution requesting a variance to deem a front yard a rear yard for through lot N44-
023690, with staff guidance requested for all similar cases
Kyrsten French, City Planner, provided the staff report. It was noted that the applicant
has requested a variance to place a shed in the front yard of his property at 626 Wood
Street. Because the lot is a through-lot, staff has recommended an application for an
expanded request to treat the north side of the property as a rear yard rather than a
front yard, with the condition of the installation of a privacy fence. Without variance
from the Board, a privacy fence is also not currently allowed in this area of the yard, so
the expanded request relieves both code restrictions.
The applicant has agreed to construct a privacy fence along the rear of the property,
and with that condition, staff recommends approval of the variance request.

The board discussed and agreed that this solution is appropriate for utilizing the full lot.
There were no additional comments from the public.
After no further public comment or deliberation, Wayne Davey made a motion to
approve resolution BZA 15-22 and Shannon Brandon seconded the motion. Resolution
BZA 15-22 was approved with a 4-0 vote.
RESOLUTION BZA 16-22
A resolution requesting a variance to reduce the minimum distance required from a
principal structure to an accessory shed structure
Kyrsten French, City Planner, provided a staff report. It was noted that the applicant
wishes to place an 8’x8’ shed in the rear of his property with no setback from the house.
She explained that the zoning code requires a 10’ separation from the home and a 5’
separation between two accessory structures. The Ohio Building Code requires a 5’
separation between structures where those structures otherwise require a building
permit. Sheds less than 200 SF in area do not require a building permit.
In the rear of all the residential lots on Westview Drive, a berm was constructed which
provides visual screening from the adjacent commercial properties. There is very little
room in the rear of the property that is level enough to place a shed on, and though it
may be permitted by the code, it would not be visually as appealing to see the shed
placed on top of the berm. Staff is supportive of the request to vary from the code
requirement to allow placement of the shed closer than 10 feet from the home.
David Hitchings, applicant, came forward to speak on the item. He reiterated that
there is limited space to place a shed on the lot. He also noted that he was told that
there is a high pressure gas line running through the property and expressed that he
would like to know if this was true.
Staff noted that contacting OUPS to mark all of the utilities, or the private gas company
(CenterPoint Energy) would be the best way to find out if this is the case.
The board deliberated on what size shed currently requires a permit. It was also
discussed that Code Piqua will provide clearer standards on this matter and will allow
for an accessory structure to be 5’ from other structures.
There were no additional comments from the public.
After no further public comment or deliberation, Wayde Davis made a motion to
approve resolution BZA 16-22 and Shannon Brandon seconded the motion. Resolution
BZA 16-22 was approved with a 4-0 vote.

Approval of the minutes from the July 14, 2022 Board of Zoning Appeals Meeting were
approved by voice vote.
NEW BUSINESS
RESOLUTION BZA 12-22
A resolution requesting a variance to reduce the side yard set back for an accessory
structure at 613 Broadway
Kyrsten French provided a staff report. Kyrsten noted that the applicant, Linda Peltier,
has applied for a variance to reduce the side yard setback from the property line to a
proposed garage on the south side of the site, and the property line to a driveway on
the north side of the site, from 3’ in each case to 1.5’.
The proposed garage would be constructed in the rear of the property. In order to fit
the requested dimension of the garage (a 24’ x 24’ garage) and a gravel pad used as
an additional parking space, it was requested to reduce the side yard setback of the
south property line. Staff recommended proposing to correct the existing nonstandard
condition on the north side of the property line of having gravel laid without a setback
along with the request.
It was shared that one comment was received related to this resolution.

Greg Monte, 613 Broadway, came forward to speak on behalf of the applicant. He
explained that the proposed setback would maximize the use of the property. It was
also noted that drainage would be redirected to the alley, rather than towards the
neighboring property.
Sarah Deavours, 428 W. North St. came forward to speak on the item. She asked for
clarification on what is being proposed and more details on the overhang.
The board deliberated and discussed that though the lot is narrow, and not out of
character for the neighborhood, reasonable adjustments could be made to create
livable and comfortable accommodations for the landowner where it would not
impact the adjacent neighbors. The board asked for clarification on what the code
update will have for setback requirements.
The board deliberated and noted that approving this variance may create conditions
to make the current or future neighbors unhappy. A 3 foot setback on the South side
and gravel up to the lot line, bordered on the North side was proposed by Shannon
Brandon.
The board discussed further that although there was no indication that the current
neighbors are unhappy with the proposal, issues may arise with neighbors in the future.
No one else came forward to speak on the item.After no further public comment or
deliberation, Wayne Davey made a motion to amend resolution BZA 12-22 to keep the
3 ft setback on the south side of the garage and remove the setback requirement for
the gravel area on the north side of the garage. and Shannon Brandon seconded the
motion. The amended Resolution BZA 12-22 was approved with a 3-0 vote.
RESOLUTION BZA 13-22
A resolution to appeal the decision of the enforcing official regarding design standards
of an accessory structure at 613 Broadway
Kyrsten French provided a staff report and discussed this item alongside 12-22. Kyrsten
explained that the applicant has also proposed a garage structure that has a black
metal roof, and has requested to appeal the review decisions of the City Planner.
The property owner proposed to construct a metal roof on the new garage. Staff’s
procedures on evaluating the “match or compliment” language of § 154.122 has been
very consistent, and has not thus far included accepting a a standing seam metal roof
for an accessory structure where the principal has an asphalt shingle roof. Staff has had
discussion with the applicant, and points have been made which are worth
considering.
As the applicant would prefer a metal roof, they have sought to appeal and seek
clarity from the BZA on the “shall match or compliment” language of the code, and
staff welcomes the discussion.

Linda Peltier, Applicant, came forward to discuss the proposal. She explained that it is
her interest to upgrade the property to invest in Piqua and that she feels that the
upgrades are quality and complementary with the neighborhood.
The board discussed their interpretation of the design standard language and what
“complement” means. All three members present determined that they considered the
term to be broad in scope. They discussed and agreed that it is unfortunate that those
constructing new garages need to receive permits and so are burdened by code
language for design standards, but those who are not required to seek a permit would
unknowingly come out of compliance but nevertheless be allowed to keep a new
metal roof.
The board talked through the options for voting on this item and thought that a metal
roof particularly can compliment a principal structure, whether the principal structure’s
roof is metal or some other material, so long as it matches the principal roof’s color.
They agreed that this should not pertain to siding, since siding is a lot more visible on a
structure, metal buildings vary in quality and could be said to not complement a
principal structure in the sense that they may not elevate the property’s appearance
without further design requirements. Re-roofing can take place without a zoning permit,
so there are many cases of metal roofs on garages where homes don’t have them, or
vice versa. Without strict enforcement, the burden to comply falls on new builds only,
and this is rarely a problem for siding.
No one else came forward to speak on the item.
After no further public comment or deliberation, Shannon Brandon made a motion to
amend resolution BZA 13-22 to direct staff to allow metal roofs to be a material type
meeting the “match or complement” design language of the code, and Wayne Davey
seconded the motion. Resolution BZA 13-22 was approved with a 3-0 vote.

WHEREAS, the owner and applicant of the property located at 903 Candlewood
in the City of Piqua, Ohio, have appealed the decision of the enforcing official
concerning the fence requirements in the zoning code; and
Whereas, Chapter 154.123 states
(A) Side and rear fences. Fences constructed within a side or rear yard shall not
be higher than six feet except as provided herein.
(B) Plantings, fences, and walls in front yard. No fence, wall, or hedge shall rise
over 42 inches in height on any required front yard, except as otherwise provided in the
lot and area requirements for specific districts. No fence, wall, or hedge planting shall
interfere with visibility from a driveway or public right-of-way. The enforcing officer is
empowered to cause all obstructions to be removed in the interest of public safety.
Whereas, Chapter 150.105 (PM 111.1) of the City of Piqua Code of Ordinances
states an application for appeal shall be based on a claim that the true intent of this
code of the rules legally adopted thereunder have been incorrectly interpreted, the
provisions of this code do not fully apply, or the requirements of this code are
adequately satisfied by other means; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Zoning Appeals of the City of
Piqua, Miami County, Ohio, the majority of all members appointed thereto concurring,
that the Board of Zoning Appeals hereby affirms the decision of the Code Compliance
Officer.

I’m glad you found us J If you ever need the zoning office in the future, my direct
number is below. Here is the link to our fence requirements that we discussed. (6’ in
the rear yard, 42” in the front.) At this time, we do not require a permit for fencing.
I also like to note that the fence may be up to, but not on or over the property lines.
This is just to avoid any issues with neighbors in the future. Please let me know if you

WHEREAS, Eric Yamaguchi, owner and applicant, has requested a variance
from § 154.005 to allow consideration to deem a front yard a rear yard for through
lot N44-023690; and,
WHEREAS, the Piqua Code of Ordinances 154.005 states
YARD. An open space on the same lot with a main building, unoccupied, and
unobstructed by structures from the ground upward, except as otherwise provided in
this chapter. See Exhibit C at the end of this section.
(1) FRONT YARD. An open space extending in full width of the lot, the
depth of which is the minimum horizontal distance between the front lot line and the
nearest point of the main building.
(2) REAR YARD. An open space extending the full width of the lot, the
depth of which is the minimum horizontal distance between the rear lot line and the
nearest point of the main building. See Exhibit C at the end of this section.
(3) SIDE YARD. An open space between a main building and the side lot
line, extending from the front yard to the rear yard, the width of which is the
horizontal distance from the nearest point of the side lot line to the nearest point of

The applicant, Eric Yamaguchi, has requested a variance to place a shed in the front August 23, 2022
yard of his property at 626 Wood Street. Because the lot is a through-lot, staff has
recommended an application for an expanded request to treat the north side of the
property as a rear yard rather than a front yard, with the condition of the installation of

allowed in this area of the yard (§ 154.123 Fences), so the expanded request relieves both BZA 15-22
code restrictions.
STAFF CONSIDERATIONS SITE ADDRESS
There are roughly 60 through lots in the city jurisdiction. N44-023690 is defined as a 626 Wood Street
through lot because it has frontage on two streets. This means that the area in the
front and back of the house are considered front yards. Because of the difficulties that
through lots can create for property owners and lack of code language throughout the
zoning code to guide and support the use of through lots, the Subdivision Code § 151.56 PARCEL ID
notes “Lots fronting on two streets, other than corner lots, shall be discouraged.” N44-023690
From the perspective of a private property owner, lack of a private space and lack of a
designated area to place accessory structures are the main difficulties of the through lot
arrangement. Because it is a natural tendency of any single-family homeowner to create
a backyard setting somewhere in the yard, that activity will start from the back door on. ZONING
From the public right-of-way, it is not desirable to see some of the content of a typical R1 - One Family Residential
backyard without some organization - furniture, toys, parked cars, trash cans, storage
of landscaping materials - these items need to go somewhere, but they generally should
be hidden from view.
Staff has recommended following the example of Indian Ridge, where lots front Sioux SURROUNDING ZONING
Drive and N. Co Rd 25A. Along the south of these properties, a berm was constructed R1 - One Family Residential
and landscaping planted to allow a private space for occupants, and these areas of the B- General Business
lots are considered rear yards. The applicant has agreed to construct a privacy fence I1 - Light Industrial
along the rear of the property, and with that condition, staff recommends approval of
the variance request.
