MINUTES TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, AUGUST 13, 2018 6:00 PM Mayor Cindy S. Perry called the meeting to order and asked for a moment of silence. PLEDGE OF ALLEGIANCE Pledge of Allegiance was led by Commissioner Jay Farrell. ATTENDANCE Members present: Mayor Cindy S. Perry, Mayor Pro Tern Pamela Baldwin, Commissioner John Bonitz, Jay Farrell and Michael Fiocco. Commissioner Bett Wilson Foley was absent. Staff present: Manager Bryan Gruesbeck, Clerk Alice F. Lloyd, Chief of Police Percy Crutchfield, Planning Director Jeff Jones, Planner II Victoria Bailiff, Engineer Elizabeth Goodson and Parks Planner Paul Home. Attorney Paul S. Messick, Jr. was absent. Motion by Commissioner Fiocco seconded by Commissioner Baldwin to approve the regular I agenda as submitted. Vote Aye-4 Nay-0 CONSENT AGENDA Motion made by Commissioner Fiocco seconded by Commissioner Baldwin to approve the consent agenda as submitted. The Consent Agenda contains the following items: 1. Approve Minutes of the July 27, 2018 regular meeting. 2. Set an Evidentiary Public Hearing for SUP request from Matthew McClory for property located at 136 Fayetteville Street (SUP-2018-04) for August 27, 2017 at 7:00 pm. Vote Aye-4 Nay-0 REGULAR MEETING AGENDA CITIZENS' MATTERS Elaine Chiosso - 1076 Rock Rest Road, Pittsboro - stated she noticed in the agenda packet that CP Stormwater Element will come before the Board again on August 27, 2018 with Staff and Chatham Park presenting. She asked that HydroStructures also be allowed to present at the meeting. August 13, 2018 Minutes Page 1 Ms. Chiosso asked if the Town had responded to the letter from NC Division of Water from May 3, 2018 (where they discussed Pittsboro's need to follow up and commit to having larger riparian buffers). If the Town has responded she would like the letter and NC Division of Water reply to be made available for public view. Ms. Chiosso also spoke about the recent flooding in Pittsboro. Melanie York - 90 Cobble Ridge Road, Pittsboro - stated Judy Betterton has a power point to be presented night and she would like to yield her time to Ms. Betterton and if time is left at the end she would like to address a couple things. Judy Betterton- 615 Millbrook Drive, Pittsboro - read her written comments which can be found at: https://pittsboronc.gov/index.asp?Type=B BASIC&SEC={ 4DD4D0A9-D93B-4E92- 8B2B-1BAC76976EB0}&DE={A6E6B59A-A0C0-4BE4-8491-85EED0F3467B} (Judy Betterton written comments 081318) Jeffrey York- 90 Cobble Ridge Road, Pittsboro - said he applaud the developer of Mosaic on a thoughtful Master Plan. He said that because a lot of things in Powell Place has changed from the Master Plan (example: Village Center, School). At prior meetings it has been stated that the apartments were a part of the Master Plan and the apartments had to be built. But changes are made to Master Plans all the time. Mr. York said something that hasn't been talked about alot is the effect on pedestrians. Bonnie Thompson - 277 Millbrook Drive, Pittsboro - wanted to piggy back on what Judy Betterton said. She said she lives on the bottleneck. When her and her neighbors brought their house it was not disclosed to them that they could not park in front of their house. There is nowhere else to park on that stretch of Millbrook. Ms. Thompson said the current problem is speeding on Millbrook Drive. There is only one speed limit sign and that is at the entrance of Powell Place. She would request more speed limit signs and police presence in the area. Alice Wertheimer- 58 Wickham Drive, Pittsboro - has concerns about the health and safety of the residents. Concerned about stress from the traffic situation. Concerned about emergency vehicles being able to get in an out with there being only one way in and one way out. She asked if a study had be done by Chatham County Department of Health and maybe we should ask the State Division of Health. Request that the Board take another look at this. Melanie York - 90 Cobblestone Drive, Pittsboro - wanted to mention the Senior Independent Living Community in the development. They use their wheelchairs to get around in the neighborhood as well as utilizing Piedmont Health Services and Chatham Transit. Mayor Perry said that several of them (Board members) have been involved in discussions to try to address the traffic problem the residents have mentioned. They can be found at: https://pittsboronc.gov/index.asp?Type=B BASIC&SEC= {4 DD4 D0A9-D93 B-4 E92- 8B2B-1BAC76976EB0} &DE={A6E6B59A-A0C0-4 BE4-8491 -85EED0F3467B} (Updates 8.13.18) Mayor Updates - Mayor Perry stated about two weeks ago her and Commissioner Fiocco had the pleasure of taking a ride in a helicopter. It was a fantastic view of Pittsboro and the 3M facility from above. She also attended: • Couple of meetings regarding Powell Place parking and safety issues. • Conference call regarding the 1, 4 dioxane in the Upper Cape Fear and Haw River. • Transportation meeting in Sanford. • EDC • RPO • Fairground Association • PBA/Downtown - Commissioner Fiocco said he has heard back that the downtown improvements will be fully funded by NCDOT. Utility work to be completed by the end of the year and construction will start in February and completed in November, 2019. • Triangle J Council of Governments - Commissioner Baldwin stated they have recessed for the summer and will start back in August. She passed out information/registration for the 2 nd Economic Summit which will be held at the Dennis Wicker Center in Sanford. • Main Street • Climate Change OLD BUSINESS SUBDIVISION PLAT REVIEW - MOSAIC A (SUB-2017-01) Victoria Bailiff, Planner II stated this proposal is being presented to the Board of Commissioners as a Preliminary Subdivision Plat for approval. The plans have been reviewed in accordance with the Town's applicable development ordinances by the appropriate departments. The proposal is to subdivide 44.18 acres into 20 lots designated for mixed use. The subdivision will utilize private drives in place of public streets with access points off both Russet Run and US 15-501. The developer is applying for annexation of the property as it is currently located in the ETJ. The Chatham Park Master Plan states that Section 6.4.B.4 of the Subdivision Ordinance applies to the Chatham Park PDD. This section states: "A comprehensive multi-family, group housing, or other unified and planned development, including unified design and construction of units together with necessary drive and way of access, may be approved by the Town Board of Commissioners upon recommendation by the Planning Board, even though the design may depart from the foregoing standards for streets and lots and subdivision arrangements, if the design meets the general intent of the ordinance." August 13, 2018 Minutes Page 3 The following are subdivision standards that have not been met by this preliminary plat. o All lots must front a public street. o Sidewalks must be provided on both sides of the street; the Board of Commissioners may grant exceptions to allow sidewalk on one side of the street. o Sidewalks serving mixed use and commercial areas shall be eight (8) feet in width unless accepted by the Commissioners. Ms. Bailiff stated this subdivision plat was reviewed by the Planning Board at their meeting on July 9, 2018. In a vote of 6-0, the Board recommended approval of the plat. Ms. Bailiff Staff is recommending approval of the preliminary plat. After discussion a motion was made by Commissioner Fiocco seconded by Commissioner Baldwin to approve the subdivision plat for Mosaic A (SUB-2017-01). Vote Aye-4 Nay-0 SUBDIVISION PLAT FOR MOSAIC A (SUB-2017-01) IS ON FILE IN THE PLANNING DEPARTMENT PROPOSED ANNEXATION A-2017-08, RUSSET RUN (MOSAIC A) Motion made by Commissioner Fiocco seconded by Commissioner Baldwin to approve the Ordinance Extending the Corporate Limits of the Town of Pittsboro, inserting the dates of publication in the ordinance. Vote Aye-4 Nay-0 AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF THE TOWN OF PITTSBORO IS RECORDED IN THE BOOK OF ORDINANCES NUMBER ONE, PAGES 105-108 PARKS AND REC PLAN UPDATE (PAUL HORNE) Paul Horne, Parks Planner stated Mr. Barth made the presentation to the Parks & Rec board last Wednesday, there was no quorum for the meeting but he made the presentation to all those in attendance. He is here to make the presentation to the Town Board tonight. Mr. Barth asked if they had any thoughts or questions to please forward them on to him. ADDITIONAL ELEMENTS - PUBLIC FACILITIES August 13, 2018 Minutes Page 4  Planning Director Jeff Jones said Chatham Park has revised the Public Facilities Element to address the Parks section. Ken Eagle submitted a list of changes made to the Public Facilities Element from July 9, 2018. Mr. Jones said staff has yet to fully review these changes because they received them on Tuesday afternoon. Mr. Jones said Chatham Park is here tonight to discuss parks and the additional elements. Mr. Smith handed out some supplemental information to the Board. He wanted to give the Board a complete picture for Chatham Park's parks. Commissioner Fiocco said he went over them as has comments/questions/suggestions. Commissioner Fiocco's comments/suggestions (redlined version): Page 3, Objective 5 (a)- delete the word "arterial" so that it will read "primary roadways". I Page 7, Objective 4 - 1st paragraph- "(which term includes Pittsboro Fire-Rescue or other provider of fire protection services for Chatham Park at the applicable time" - Commissioner Fiocco said that Attorney Messick is working on tightening that language. Page 7, Objective 4 (1)- last paragraph "restricting use" suggestion is to include a duration of restriction be identified. Page 13, Objective 2 - be changed to read that reservation is approved at Small Area Plan submittal. Page 14, paragraph after "Total Sewer Reservation" last sentence be changed to read ... Town or another provider that renders the capacity as not necessary. Page 20 - Objective 1 - delete (a) "Adopt NRP A facility guidelines in order to be consistent with standards employed by other municipalities in the region." Page 22 - top of page - after Park PDD - add as approved by the Town. Page 23 (2) - questioned this. Page 24 -wanted to add that reclaimed water lines will be stubbed to property. August 13, 2018 Minutes Page 5 Page 27 - last paragraph on page - value should be three instead of two - Attorney Eagle said he would review this. Page 29 - last paragraph - impervious surface not to be less than 70% of parcel where it is going to be developed. Attorney Eagle said he would have to check with Hunter on this. Commissioner Baldwin questioned #5 on the summary of major revisions to the Parks section of the Additional Elements and said she would have to think about that. Mr. Smith said any future fee increases by the Town would not meet what they are currently providing (they are exceeding it). Commissioner Farrell said on Page 5 of the redlined version- need to change seven minutes to add minutes and to add somewhere NFP 1710. Attorney Eagle said he would look at the regulations. He had concerns about only three fire stations as well. NEW BUSINESS - (none scheduled) ADDITIONAL UPDATES AND REPORTS COMMISSIONER CONCERNS Commissioner Farrell stated he just wanted to thank staff for the great job they did doing the flooding. Commissioner Fiocco said we had a presentation by the Highway Patrol and we were told to let them know we are interested in getting our SCADA system included in their design of the tower, he doesn't want us to miss such a great opportunity. Commissioner Baldwin stated some residents on Honeysuckle Drive would like to have traffic calming devices similar to what's on Springdale Drive. There was a discussion. Manager Gruesbeck said several years ago the board started discussion on a policy on rationale for installing traffic calming devices. Commissioner Baldwin said maybe posting more speed limit signs will help. Commissioner Baldwin said she was asked if someone is on property that they own can they sell vegetables. Mr. Jones asked that she have them contact him. Commissioner Baldwin said we have a Vape Shop in Pittsboro can they move to another location in Town. Mr. Jones said when the Overlay District was approved it was prohibited. They can stay where they are now but cannot relocate. Commissioner Bonitz echoed Commissioner Farrell's praise for town staff during the recent flooding. He said with the flooding issues we had maybe the way they look at the Stormwater Element and UDO might change. August 13, 2018 Minutes Page 6 Mr. Jones said a number of things will need to be cleaned up regarding stormwater because of legislation.
