MINUTES TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, OCTOBER 26, 2020 7:00 PM Members Present (Virtual): Mayor Jim Nass, Mayor Pro Tern Pamela B aldwin, Commissioner John Bonitz, Commissioner Jay Farrell, Commissioner Michael Fiocco and Commissioner Kyle Shipp. Staff Present (Virtual): Town Manager Chris Kennedy, Town Attorney Paul S. Messick, Chief of Police Shorty Johnson, Planning Director Jeff Jones, Senior Planner Theresa Thompson, Planner II Kayleigh Mielenz, Town Clerk Cassandra Bullock. Mayor Jim Nass called the meeting to order and asked for a moment of silence PLEDGE OF ALLEGIANCE Pledge of Allegiance was led by Commissioner Farrell. Swearing in of Police Chief Town Clerk Cassandra Bullock administered the swearing in of C.H. "Shorty" Johnson, Jr. as the Chief of Police for the Town of Pittsboro. Adoption of the Agenda Mayor Jim Nass entertained a motion to adopt the Agenda. Commissioner Fiocco made a motion to approve the Agenda, seconded by Commissioner Shipp. Vote: Aye-5 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion passed. UPDATES & COMMISSIONER COMMENTS 1. Manager Updates- Town Manager Chris Kennedy stated that he and the Police Department created a Halloween safety tip sheet including COVID-19 recommendations to ensure a safe Halloween. The tip sheet is on the Town and Police Department Facebook page in addition to placement on the Town's website. Town Manager Chris Kennedy also advised that the Town's Finance Department is going through a software conversion. Consequently, our utility billing online payments are expected to be down this week, but we anticipate that the online payments will be back up in just a few days and to call with any billing questions. 2. Mayor Updates- Mayor Jim Nass stated that he met with a Channel 17 News reporter to discuss Pittsboro water quality. 3. Commissioner Updates- • Boys & Girls Club- Commissioner Shipp advised they are still looking for people to join the advisory board, they are needing a Treasurer. They also are working with Hobbs so they can find a perfect location. The Board can accept donations now as well. • Chatham County Arts Council- Commissioner Shipp advised they are finishing Mask for Mini program, over 1500 mask were made and sold, they will donate the rest. They also have a program called CAARE which has $8500 left in grants for an artist and it has to be spent by the end of the year. • Chatham County Economic Development Corporation (EDC) None. • Climate Change - None. • Downtown None. • Fairground Association­ None. • Human Relations Committee­ None. • Main Street Pittsboro (MSPBO)­ None. • Parks and Recreation Advisory Board (PARAB)- Commissioner Fiocco advised that the PARAB appointed a new Chair, Mr. Ryan Ford. • Pittsboro Business Association (PBA) None. • Triangle Area Rural Planning Organization (TARPO) None. • Triangle J Council of Governments (TJCOG) None. • Other Commissioner Farrell stated that he attended the Water Quality feedback Town Hall meeting on Saturday, and it provided a lot of good information. Commissioner Shipp stated the he attended the Town Hall meeting as well and he is looking forward to reviewing the Water Task Force report. 2 CITIZEN MATTERS 1. Public Comment • Mr. Randy Voller asked to address the Board to bring to the attention of the Town Manager and the Planning Director that he noted three or four of the political campaign signs placed around town were larger than permitted by the Town's Code. Mr. Voller stated that he thought this would be a good time to change the Town policy on the dimensions of political campaign signs from 3' x 4' to 4' x 8' to be consistent with the policies of Chatham County. No other public comments were provided. CONSENT AGENDA 1. 2020-21 Leaf Collection Schedule 2. Town of Pittsboro Financial Reports by Month- September 2020 End of Consent Agenda. Commissioner Fiocco made a motion to approve the Consent Agenda, seconded by Commissioner Bonitz. Rezoning - REZ-2020-04 - John & Denise Mitarotondo Senior Planner Theresa Thompson presented the staff report to the Board. Ms. Thompson stated that this is a general rezoning, not a conditional district, and that the petitioners, John & Denise Mitarotondo, are requesting to rezone 3.75 acres (Parcel 6216) located at 2539 US 64 Business West from RA-2 to RA. The Board of Commissioners discussed the application and decided to proceed with placing this application in front of the Planning Board for review at their November 2, 2020 meeting. Commissioner Fiocco made a motion to send Rezoning application REZ-2020-04 to the Planning Board for review, seconded by Commissioner Shipp. Vote: Aye-5 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion passed. Preliminary Subdivision Plat - SUB-2020-01 Chatham Park Section 7.1 Residential Subdivision, Phase 1 Senior Planner Theresa Thompson presented the staff report to the Board. Ms. Thompson stated that the proposed subdivision will be age-restricted and will include 110 single-family units and 44 two-family residential lots. The minimum lot size is 4,200 square feet with an average lot size 4 of 6,176 square feet. The subdivision will utilize public roads with access points off Grant Drive. The Planning Board met on October 5, 2020 and unanimously recommended approval of the request. Alicia Albini, with Withers Ravenel and on behalf of the petitioner, discussed the project's planned amenities and she confirmed that the project will be age-restricted to clients 55 years of age and older. Commissioner Fiocco made a motion to approve the Preliminary Plat and the resolution pertaining to this request sent to the Board via email from Town Attorney Paul Messick, seconded by Commissioner Shipp. Vote: Aye-5 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion passed. 2. Memorandum of Understanding - Town of Pittsboro, Chatham County & Chatham County Schools Town Manager Chris Kennedy provided an overview of the proposed Memorandum of Understanding and entertained questions from the Board. Commissioner Fiocco stated that he would like to suggest rewording the language under the fifth "Whereas". Commissioner Fiocco stated that he would like to remove the inclusion of the non­ profits in favor of tax-generating eqtity language. The idea behind this Memorandum of Understanding is that this vacancy created on the property is replaced with tax-generating businesses that provide a base of employees that will shop and dine in our downtown. Commissioner Fiocco also stated that he would like to suggest adding the "Development Community" and "Main Street Pittsboro" to the list of partners. Commissioner Bonitz stated that he would support the inclusion of mixed-use development where the Property could be used for Residential and Commercial uses as well. Mayor Pro Tern Baldwin asked if the Town knew what other services and/or departments the County intended to move out to its Renaissance Drive location on the western part of Town, just outside of Pittsboro' s jurisdiction. Town Manager Chris Kennedy advised he will speak with the County Manager about what their plans. Mr. Kennedy stated that if the Board is okay with him making the suggested changes and 5 allowing him to provide the changes to the County for review and approval, he will bring the updated Memorandum of Understanding back to the Board at a future meeting. The Board directed the Town Manager Chris Kennedy to prepare a new draft of the Memorandum of Understanding and to speak with the County Manager about planned relocation strategies for the County's Renaissance Drive campus and to follow back up with the Board at the November 9, 2020 or November 23 Regular Meeting of the Board of Commissioner. MISCELLANEOUS 1. Report from Town Manager on Town of Pittsboro Sewer Capacity and Allocation Status Town Manager Chris Kennedy advised the Board that the sewer capacity and allocation mapping project is progressing, however there will be no formal presentation of numbers this evening. Mr. Kennedy stated that he planned to have something to present at the November 23, 2020 Regular Meeting of the Board of Commissioners. h OLD BUSINESS 1. Annexation - A-2020-03 Chatham Park Section 7.1 Residential Subdivision, Phase 1 Town Manager Chris Kennedy advised the Board that a legislative public hearing was held on September 28, 2020. Pursuant to the State requirements that we allow a 24-hour comment submittal period following the closing of a legislative public hearing, we held and closed the public hearing on September 28, 2020 but we did not ask for any vote that evening to allow for the comment period. The Town received no comments during the 24-hour comment period following the closing of the public hearing, so staff is recommending that the Board approve A-2020-03 this evening. Commissioner Bonitz made a motion to approve the Annexation Petition A-2020-03, seconded by Commissioner Fiocco. Sewer Allocation Request-Eco CP Partners, LLC & Eco Northwood MUPD, LLC Town Manager Chris Kennedy stated that he would like to continue any conversation or action on this item until he can present the findings of his sewer capacity and allocation project to the Board. It is unlikely that the report will be ready for the November 9, 2020 Regular Meeting of the Board of Commissioners, but in case it is, Mr. Kennedy asked for the Board to entertain a motion to continue this request to the November 9, 2020 Regular Meeting of the Board of Commissioners where the Board can then continue again to the November 23, 2020 Regular Meeting of the Board of Commissioners should the report not be ready on November 9, 2020. Commissioner Bonitz made a motion to delay action and to continue the discussion of this item to the November 9, 2020 Regular Meeting of the Board of Commissioners, seconded by Commissioner Farrell.
