MINUTES TOWN OFPITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, NOVEMBER 23, 2020 7:00PM Members Present (Virtual): Mayor Jim Nass, Mayor Pro Tern Pamela Baldwin, Commissioner John Bonitz, Commissioner Jay Farrell, Commissioner Michael Fiocco and Commissioner Kyle Shipp. Staff Present (Virtual): Town Attorney Paul S. Messick, Chief of Police Shorty Johnson, Town Clerk Cassandra Bullock, Planning Director Jeff Jones, Senior Planner Theresa Thompson and Planner I Kayleigh Mielenz, Finance Director Heather Meacham. Call to Order- Mayor Nass Mayor Nass called the meeting to order. Invocation- Moment of Silence Mayor Nass asked for a moment of silence. Pledge of Allegiance Pledge of Allegiance was led by Commissioner Farrell. Adoption of the Agenda Mayor Nass entertained a motion to adopt the Agenda. Commissioner Bonitz asked that the Chatham Park amendment, Consent Agenda item #6 be considered for removal to the main agenda. Mayor Pro Tern Baldwin made a motion to approve the Regular Agenda with the change of moving Consent Agenda item #6 to New Business item #2, seconded by Commissioner Bonitz. UPDATES & COMMISSIONER COMMENTS 1. Manager Updates: Town Manager Chris Kennedy mentioned the PBA's holiday tree lighting event was held on Sunday, November 22, and that it was a great way to start off the Holiday Season. Mr. Kennedy advised the Board that he made a decision to cancel the Christmas Parade due to the complicating factors surrounding the health of everyone involved due to the COVID-19 pandemic. Mr. Kennedy stated that he and the Town researched traditional formats, reverse parades and other options before coming to the conclusion that a parade conducted in a safe manner was just not f�asible this year. Town Manager Chris Kennedy invited everyone to come out this weekend to Small Business Saturday to support local business around town. Mr. Kennedy stated that he is partnering with the PBA and he will be wrapping gifts Saturday Morning at the new Welcome Center and invited anyone needing giftwrapping to come out. Town Manager Chris Kennedy reminded the Board that Consent Agenda item # 6 has now been moved to New Business item #2 to entertain conversation on the item. Town Manager Chris Kennedy advised the Board that should the Board proceed with the remainder of the Consent Agenda as listed, staff will forward the Board appointment recommendation for the Planning Board ETJ-Alternate to the County Commissioners as they consider appointing Ms. Mize. Town Manager Chris Kennedy advised that the Pittsboro Wastewater Improvements, which includes the Sanford force main project, ER-EID is back on the Consent Agenda to re-set the required public meeting due to presumed issues with the legal advertising. The Town has spoken with the State officials, and while appear to be in the clear, out of an abundance of caution we are choosing to hold the public meeting again to be on the safe side. 2. Mayor Updates Mayor Nass spoke about the PBA's holiday tree lighting event and how it was very different this year, but that he was happy it was able to take place. Mayor Nass thanked the volunteers for making the show very special. 3. Commissioner Updates • Boys & Girls Club Commissioner Shipp stated that the Pittsboro Boys & Girls Club is making good progress and the Board has five (5) new members. Also, donations are beginning to come in, but much more 2  fundraising is needed to open the Club. Commissioner Shipp also stated the Pittsboro Boys & r Girls Club has identified a location and the Board hopes to share that location soon. • Chatham County Arts Council l • Chatham County Economic Development Corporation (EDC) • Climate Change- Commissioner Bonitz advised that he heard that the State has requested proposals for rebates on the electric vehicle charging stations and if anyone has questions, they may contact him in his professional capacity. • Downtown • Fairground Association • Human Relations Committee • Main Street Pittsboro (MSPBO) • Parks and Recreation Advisory Board (PARAB) • Pittsboro Business Association (PBA) • Triangle Area Rural Planning Organization (TARPO) • Triangle J Council of Governments (TJCOG) • Other CITIZEN MATTERS 1. None. OLD BUSINESS #1 1. Subdivision - SUB-2019-01 I Special Use Permit - SUP-2019-02 Griffin Farms Townhomes - ODG 97, LLC Town Manager Chris Kennedy provided an overview of the progress made recently in this application. Discussion ensued amongst the Commissioners, Planning staff, and the private development team as the group discussed the fee in lieu for the proposed sidewalks, parking spaces and parking demand, and secondary ingress and egress concerns. Planning staff provided an overview of the updated resolutions to assist in the Board's deliberation. Commissioner Fiocco advised he was not able review the resolutions in a timely manner with staff's most recent updates to the resolutions coming earlier in the day and ask for more time to review before making a decision. Commissioner Fiocco made a motion to table any decision on these applications, SUB-2019-01 and SUP-2019-02, to the December 14, 2020 Board of Commissioners Regular Meeting, seconded by Commissioner Shipp. Vote: Aye-5 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion passed. 4 r 2. Rezoning - REZ-2020-04 - John & Denise Mitarotondo Planning staff provided an overview of the rezoning request and the staff report for this application. Commissioner Bonitz made a motion to adopt the approval of the proposed Consistency Statement, seconded by Commissioner Fiocco. Report from Town Manager on Town of Pittsboro Sewer Capacity and Allocation Status. Town Manager Chris Kennedy provided an update on the Town's Sewer Capacity and Allocation status. Mr. Kennedy went through a timeline the Town is working from the proposed work the Town should be working toward. To reiterate the rationale for previous decision-making, Mr. Kennedy advised the Board that it still makes more sense to go to Sanford with our sewer flow in the immediate future compared with upgrading our existing plant due to gains in flow and the EPA's standards that our plant cannot achieve without substantial investment. Town Manager Chris Kennedy also ask the Board if they wished to continue authorizing the sewer allocation for an amount up to 110% of our existing plant capacity. 5 r The Board responded in the affirmative after discussion of the topic. Commissioner Bonitz asked for a graphical depiction of the sewer mapping performed by the Town Manager with existing information and future projects listed. Town Manager Chris Kennedy agreed and stated that he will provide a graph of the timeline and a list of options attached to graph. Mr. Kennedy further stated that if he is able, he would like to bring this back to the Board for review at the December 14, 2020 meeting and the January 11, 2021 meeting. Commissioner Fiocco made a motion to take a five-minute break, seconded by Commissioner Bonitz. Sewer Allocation Request-Eco CP Partners, LLC & Eco Northwood MUPD, LLC Town Manager Chris Kennedy provided an overview of this request and discussed how this item was continued since its introduction on a Board agenda in September 2020. Mr. Kennedy reminded the Board that consideration on this request has been continued for the last few meetings to allow staff to proceed with and complete the sewer mapping project. Now that the initial phase of the sewer mapping is complete, staff contends that the Board is prepared to render a decision on this sewer allocation request. Commissioner Fiacco made a motion to approve the Sewer Allocation Request of 23,110 Gallons Per Day (GPD) to the Eco CP Partners, LLC and Eco Northwood MUPD, LLC, seconded by Commissioner Bonitz. After the vote, Commissioner Shipp added that he would suggest that the Board and staff review our sewer allocation policy for the approximate 17 ,000 gallons per day remaining in our capacity. NEW BUSINESS 1. Site Plan Review - SP-2020-05 Mosaic Cruizers - Holmes Oil Company Planning staff presented the staff report and provided an overview of the application for the Board. Commissioner Fiocco made a motion to approve Site Plan SP-2020-05, seconded by Commissioner Bonitz. Vote: Aye-5 Nay-0 Mayor Nass: NIA r Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell : Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion passed. 2. Amendment to Chatham Park Planned Development District Master Plan to Change the Provisions Pertaining to the 5 % Threshold for Residential Development from 1,100 Lots Submitted for Site Plan or Preliminary Plat Approval to 1,100 Lots Final Plat Approved Town Manager Chris Kennedy discussed why this amendment is being presented to the Board. Mr. Kennedy stated that Chatham Park cannot exceed the 5% threshold, or 1,100 units, until the Small Area Plan is approved and Chatham Park completes each of the twelve (12) elements . Town staff has stated that a development agreement and the Small Area Plan must be approved first. Mr. Kennedy advised the Board that he and Town Attorney Paul Messick have been working on the Development Agreement and that the Small Area Plan was resubmitted to the Town for review in September. The last remaining element is the affordable housing component of the project. Mr. Kennedy stated that Chatham Park has waited on the Town to adopt an affordable housing ordinance and feels that they cannot achieve this element until such ordinance is adopted. Chatham 7  Park Investors is requesting this amendment to allow for more units to be constructed to allow the r Town to prepare an affordable housing ordinance without unnecessarily stalling development. I Discussion ensued amongst the Board, staff and the applicant. Commissioner Fiacco proposed that the Town amend the language from 5% to 8% to work with the concerns presented tonight. All other language and requirements will remain the same, however the maximum numbers of units to be constructed before all the elements are complete and the Small Area Plan and Development Agreement are approved moves from 1,100 units to 1,760 units. The applicant, represented by Mr. Chuck Smith with Preston Development, agreed to that amendment language proposed by Commissioner Fiacco. Commissioner Fiacco made a motion to allow the Town Manager Chris Kennedy to amend the language from 5% to 8% and to make correction to correct a typographical error, from Subsection P to Subsection Q, seconded by Mayor Pro Tern Baldwin. Final Board of Commissioner Comments & Adjournment Commissioner Shipp commented about how nice the PBA's holiday Tree Lighting Ceremony went. Commissioner Shipp also mentioned that he liked how Town Manager Chris Kennedy moved the Consent Agenda after Citizen's Matters so there is an opportunity to for the public to discuss a Consent Agenda item before they are approved, and that he is very happy with that agenda improvement. Commissioner Shipp stated that vehicular speeding is a concern on Thompson Street and that we may need to review our Traffic Calming policy for concerns within Powell Place. Town Manager Chris Kennedy advised the Board that he will be work with our Police Department to assess those concerns . 8  Commissioner Fiocco wanted to echo the good sentiments of the PBA's holiday Tree Lighting, { that he enjoyed the Mayor's reading during the video, and the Santa in a Snow Globe portion of the event. I Commissioner Fiocco was happy to report that the Welcome Center was up and running for the PBA's holiday Tree Lighting and this is also where the gift wrapping will take place for Small Business Saturday. Commissioner Bonitz questioned Town Manager Chris Kennedy about the measures the Town has in place pertaining to COVID-19 virus. Town Manager Chris Kennedy advised that the Town has a basic policy in place at this time , but that our response is everchanging with the current information provided at the Federal and State levels and we continue to adjust the policy as issues or conflicts arise.
