MINUTES TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, MARCH 8, 2021 7:00PM Members Present (Virtual): Mayor James Nass, Mayor Pro Tern Pamela Baldwin, Commissioner John Bonitz and Commissioner Kyle Shipp. Members Absent: Commissioner Fiocco Staff Present (Virtual): Town Attorney Paul S. Messick, Chief of Police Shorty Johnson, Town Clerk Cassandra Bullock, Interim Planning Director Theresa Thompson, Planner 1 Kayleigh Mielenz, Director of Engineering Kent Jackson. Call to Order-Mayor James Nass Mayor Nass called the meeting to order. Invocation - Moment of Silence Mayor Nass asked for a moment of silence. Pledge of Allegiance Pledge of Allegiance was led by Commissioner Farrell. Adoption of the Agenda Mayor Pro Tern Pamela Baldwin made a motion to approve the Adoption of the Regular Agenda, seconded by Commissioner Benitz. Vote: Aye-4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Benitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Absent Commissioner Shipp: Aye Motion Passed. \ UPDATES & COMMISSIONER CONCERNS 1. Manager Updates None. 2. Mayor Updates Mayor Nass, on behalf of Town Manager Kennedy, advised the Board that the staff memorandum pertaining to UDO updates placed on the Board's SharePoint and on the Town website was not to be considered this evening, it is support material for the discussion to be had at the March 22 Regular Meeting. 3. Commissioner Updates ■ Boys & Girls Club Commissioner Shipp provided a general update and advised that advisory board will be sending out a survey out to school-aged students and their parents concerning their interest in signing up and if they would like Pittsboro Boys & Club updates. ■ Chatham County Arts Council ■ Chatham County Economic Development Corporation (EDC) ■ Climate Change ■ Downtown ■ Fairground Association ■ Human Relations Committee ■ Main Street Pittsboro (MSPBO) ■ Parks and Recreation Advisory Board (P ARAB) Commissioner Farrell stated that he will be attending the PARAB meeting on this Wednesday, March 10. ■ Pittsboro Business Association (PBA) ■ Triangle Area Rural Planning Organization (T ARPO) ■ Triangle J Council of Governments (TJCOG) ■ Chatham County Affordable Housing Commissioner Shipp stated that the Chatham County Affordable Housing committee met last week, and after reviewing the request for funding applications submitted last year, there is money left over. The committee is currently considering options to distribute this unused money to organizations this year, before next year's funding cycle. CITIZEN MATTERS 1. Public Comment None. 2 CONSENT AGENDA 1. Set Public Hearing for REZ-2020-05 Rezoning - Petitioner: Graham Scott Oldham 2. Budget Amendment for a Public Water Main Size Betterment for the Town of Pittsboro 3. Board Appointments - Board of Adjustment End of Consent Agenda. Commissioner Shipp made a motion to approve the Consent Agenda, seconded by Commissioner Farrell. Vote: Aye-4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Absent Commissioner Shipp: Aye Motion Passed. PUBLIC HEARINGS Mayor Pro Tern Baldwin made a motion to go into Public Hearing, seconded by Commissioner Bonitz. Vote: Aye-4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Absent Commissioner Shipp: Aye Motion Passed. 1. Zoning Text Amendment - ZT A-2021-02 Nightclubs, Bars, Taverns Interim Planning Director Theresa Thompson presented the staff report for ZTA-2021-02. Ms. Thompson stated that staff is requesting to amend the zoning ordinance to permit Nightclubs, Bars, Taverns, as defined in the zoning ordinance, as a by-right land use C-2 (Highway Commercial) and the C-4 (Central Commercial) zoning classifications. As part of this request, Ms. Thompson inquired about any supplemental standards the Board may wish to apply to the land use, if necessary, since this land use is currently deemed a special use. The current proposal includes no 3 additional conditions or standards, however, if they are added, the supplemental standards would likely be added as table notes to the Permitted Use Table set forth in Section 5.2.1. Discussion ensued amongst the Board members about whether to attach additional standards as supplemental conditions to the land use. These discussion points will be introduced to the Planning Board for further consideration. Commissioner Shipp made a motion to close the Public Hearing, seconded by Commissioner Bonitz. Vote: Aye-4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Absent Commissioner Shipp: Aye Motion Passed. Commissioner Shipp made a motion to forward the request to the Planning Board, seconded by Mayor Pro Tern Baldwin. Vote: Aye-4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Absent Commissioner Shipp: Aye Motion Passed. OLD BUSINESS 1. None. NEW BUSINESS 1. None. MISCELLANEOUS 1. None. Final Board of Commissioner Comments & Adjournment 4 Commissioner Farrell stated that as the Board and staff considers the forum for the Board of Commissioners Budget Retreat, that he preferred to hold in the Budget Retreat in person instead of Zoom. Mayor Pro Tern made a motion to Adjourn, seconded by Commissioner Bonitz at 7:39pm.
