MINUTES TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, JULY 26, 2021 7:00 PM Members Present (In-Person): Mayor James Nass, Commissioner John Bonitz, Commissioner Jay Farrell, Commissioner Michael Fiocco and Commissioner Kyle Shipp Members Absent: Mayor Pro Tern Pamela Baldwin Staff Present (In-Person): Town Manager Chris Kennedy, Town Attorney Paul S. Messick, Town Clerk Cassandra Bullock, Planning Director Theresa Thompson Call to Order - Mayor Nass Mayor Nass called the meeting to order at 7:00pm. Invocation - Moment of Silence Mayor Nass asked for a moment of silence. Pledge of Allegiance Pledge of Allegiance was led by Commissioner Jay Farrell. Adoption of the Agenda Prior to the adoption of the Agenda for the July 26, 2021 Regular Meeting of the Board of Commissioners, Mayor Nass described the format and anticipated brevity for the evening's meeting. The Board decided to meet in-person for a Regular Meeting for the first time since the start of the COVID-19 pandemic. However, in the last few days, spikes in COVID due to the emergence of the Delta variant have shifted the Board's thoughts towards meeting in an in-person forum. Since the Town had already published and posted notice for the public hearings, and for fear that a short notice shift in venue to virtual would confuse matters more, the Board has decided to come together in-person this evening to vote on the Consent Agenda and to continue all other matters to ,the next regularly scheduled Regular Meeting, which will be held in a virtual forum via Zoom for the benefit of increased safety. Therefore, while public hearings slated on this agenda will be opened, the Mayor requested votes to immediately continue them to the August 9, 2021 Regular Meeting of the Board without discussion or additional comment. Commissioner Bonitz made a motion to move the following listed agenda items to the August 9, 2021, Regular Meeting of the Board, seconded by Commissioner Shipp. 111 Resolution of Sympathy Recognizing the Passing of Mr. Brian Taylor 111 Old Business Item #1, Small Area Plan- Chatham Park North Village- Chatham Park Investors, LLC 111 Miscellaneous Item #1, Main Street Pittsboro Quarterly Report - April 1, 2021 - June 30, 2021 Vote: Aye- 4 Nay-0 Mayor Nass: N/A Mayor Pro Tern Baldwin: Absent Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion Passed. UPDATES & COMMISSIONER CONCERNS 1. Manager Updates Town Manager Chris Kennedy advised the public that the Town will be pushing all Public Hearings listed on the agenda tonight to the Board's August 9, 2021 Regular Meeting. Town Manager Kennedy also reminded the Board and the public that the Town's next Special Session of the Board to discuss Water Quality will be held August 18, 2021, in a virtual forum at 5:30pm via Zoom. The Town welcomes written feedback or comments and those may be submitted to the Town Manager or the Town Clerk. 2. Mayor Updates None. 3. Commissioner Updates Boys & Girls Club 111 Commissioner Shipp shared that the Pittsboro Boys & Girls club will hold a Pancake Breakfast Wednesday at 8:00am at the Chatham County Ag Center. 111 Chatham County Arts Council 111 Chatham County Affordable Housing Advisory Committee (AHAC) 111 Chatham County Economic Development Corporation (EDC) 111 Climate Change 111 Downtown 111 Fairground Association 111 Main Street Pittsboro (MSPBO) 2 Commissioner Fiocco advised that MSPBO is finalizing the final touches on a facade grant for downtown Pittsboro and that the MSPBO design committee has chosen an artist for a downtown mural. 11 Parks and Recreation Advisory Board (P ARAB) 11 Pittsboro Business Association (PBA) 11 Triangle Area Rural Planning Organization (TARPO) 11 Triangle J Council of Governments (TJCOG) 11 Other CITIZEN MATTERS 1. Public Comment None. CONSENT AGENDA 1. A-2021-04 Mellott Tract- 1108 Russet Run (PARID 7146, 75037), 15-501 East LLC 2. Set Public Hearing for A-2021-02 Northwood MUPD- US Highway 15-501 (PARID 72825), ECO Northwood MUPD, LLC 3. Set Public Hearing for REZ-2021-04 - 879 & 881 Hillsboro Street - R-10 to 01 (PARID 6622), David Mang 4. Resolution Accepting American Rescue Plan (ARP) Act Funds 5. Board of Commissioners Future Agenda Item "Look Ahead" Tentative Schedule End of Consent Agenda. Commissioner Fiocco made a motion to approve the Consent Agenda, seconded by Commissioner Bonitz. Annexation - A-2021-03 Corbett Landing (fka Rexford Landing) - Old Graham Road (PARID 6580, 69515) - The Rexford Group, Ltd. Commissioner Fiocco made a motion to open the Public Hearing, seconded by Commissioner Shipp. Vote: Aye- 4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Absent Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion Passed. Commissioner Fiocco made a motion to continue the Public Hearing for A-2021-03 to the August 9, 2021 Regular Meeting of the Board, seconded by Commissioner Shipp. Vote: Aye- 4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Absent Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion Passed. 2. Chatham Park Development Agreement Commissioner Fiocco made a motion to open the Public Hearing, seconded by Commissioner Shipp. Vote: Aye- 4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Absent Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion Passed. 4 Commissioner Fiocco made a motion to continue the Public Hearing for the Chatham Park Development Agreement to the August 9, 2021 Regular Meeting of the Board, seconded by Commissioner Bonitz. Commissioner Fiocco made a motion to continue the Public Hearing for REZ-2021-03 to the August 9, 2021 Regular Meeting of the Board, seconded by Commissioner Bonitz. Commissioner Fiocco made a motion to continue the Public Hearing for SUP-2021-02 to the August 9, 2021 Regular Meeting of the Board, seconded by Commissioner Bonitz. Vote: Aye- 4 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Absent Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion Passed. Final Board of Commissioner Comments & Adjournment Commissioner Shipp stated for the benefit of those in the audience that the next Board meeting will be held in a virtual forum via Zoom and not in-person. Mayor Nass further explained why the Board elected to move each of the Public Hearings to the next meeting and advised that doing so was in the best interest of the public with the escalation in COVID numbers. # Commissioner Farrell asked the Town Clerk to deliver printed copies of the public comments for the Chatham Park North Village Small Area Plan and the Chatham Park Development Agreement.
