TOWN OF PITTSBORO BOARD OF COMMISSIONERS APRIL 10, 2023 REGULAR MEETING MINUTES PAGE 1 OF 5 TOWN OF PITTSBORO The Pittsboro Board of Commissioners met in Regular Session on Monday, April 10, 2023, at 7:00pm in the meeting room at the Chatham County Agriculture and Conference Center with Mayor Pro Tern Pamela Baldwin presiding. The meeting was called to order at 7:00pm. Mayor Pro Tern Baldwin requested a moment of silence with the recitation of the Pledge of Allegiance following led by Commissioner Farrell. ELECTED TOWN OFFICIALS PRESENT: Mayor Pro Tern Pamela Baldwin, Commissioners John Bonitz, Jay Farrell, Kyle Shipp, and James Vose. ELECTED TOWN OFFICIALS ABSENT: Mayor Cindy Perry. TOWN STAFF PRESENT: Interim Town Manager/Director of Engineering Kent Jackson, Town Attorney Paul S. Messick, Chief of Police Shorty Johnson, Finance Director Heather Meacham, Public Information Officer/Emergency Management Coordinator Colby Sawyer, HR Director Jennifer Eakes, Acting Planning Director/Planner II Janie Phelps, Project Engineer Morgan DeWit, Water Plant SuperintendenUORC Cory Saulsbury, Project Manager Molly Boyle and Town Clerk Carrie Bailey. Swearing in of Police Officer Christopher David Oakley was performed by Town Clerk Carrie Bailey. ADOPTION OF THE AGENDA Mayor Pro Tern Baldwin called for a motion to either approve or modify the agenda as proposed. Commissioner Shipp made a motion to move Miscellaneous item #2 to April 24 th Regular BOC meeting and approve the amended Regular Agenda, seconded by Commissioner Bonitz. Vote: Aye-5 Nay-0 Motion carried unanimously. Commissioner Shipp made a motion to enter Closed Session pursuant to N.C.G.S. . § 143-318.11. (a)(3) to consult with Town Attorney, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. CLOSED SESSION 1. The Board of Commissioners held a Closed Session pursuant to N.C.G.S. § 143-318.11. (a)(3) to consult with Town Attorney. CITIZEN MATTERS 1. Interim Manager Updates Interim Town Manager/Director of Engineering Kent Jackson shared that the Downtown Rabbit Hunt event scheduled for April 8th was postponed due to inclement weather and is rescheduled for April 22 nd . Jackson shared staff are working with DOT for a new street scape project which will be adding six (6) new LED lights to be installed by April 27th and existing downtown streetlights will be changed out within a few months. 2. Mayor and Commissioner Updates and Concerns Mayor and Board members gave updates on the committees and boards on which they serve. 3. Public Comment None. CONSENT AGENDA Mayor Pro Tern Baldwin called for action on the Consent Agenda . The Consent Agenda contained the following items: 1. Minutes of March 27, 2023 Special Meeting of the Board of Commissioners 2. Minutes of March 27, 2023 Regular Meeting of the Board of Commissioners 3. Town of Pittsboro Municipal Contract with the Board of Elections Commissioner Shipp made a motion to approve the Consent Agenda, seconded by Commissioner Farrell. Vote: Aye-5 Nay-0 Motion carried unanimously. PUBLIC HEARINGS Commissioner Farrell made a motion to enter Public Hearing, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. 1. Pittsboro Land Use Plan Update Jake Petrosky, Stewart Inc. presented the overview of the updated Future Land Use Plan . 2  TOWN OF PITTSBORO BOARD OF COMMISSIONERS APRIL 10, 2023 REGULAR MEETING MINUTES PAGE 3 OF 5 Commissioner Shipp made a motion to close Public Hearing, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. Commissioner Shipp made a motion to approve the Pittsboro Land Use Plan Update with updates as indicated and change Chatham Forest to infill category, seconded by Commissioner Farrell. Vote: Aye-5 Nay-0 Motion carried unanimously. OLD BUSINESS 1. Town of Pittsboro System Development Fee Ordinance Interim Town Manager/Director of Engineering Kent Jackson reviewed information presented at prior meetings to address questions and comparisons of neighboring jurisdictions as guidance to formulate a new SDF rate . Staff offered the Board two fee options, exhibit B-1 in the amount of $26,353.50 and exhibit B-2 in the amount of $10,638.00 as a more moderate fee option for consideration. Commissioner Shipp made a motion to set the combined total per service unit for system development fees of eleven thousand ($11,000.00) on July 1, 2023, seconded by Commissioner Farrell. Vote: Aye-4 Nay-1 Commissioner Vose Motion carried. Commissioner Shipp made a motion to look at alternative methods for commercial in addition to just by meter size by July 1, 2023, seconded by Commissioner Bonitz. Vote: Aye- 5 Nay-0 Motion carried unanimously. NEW BUSINESS 1. American Rescue Plan Act (ARPA) Grant Application Project Manager Morgan DeWit presented the ARPA Grant Application information for Board consideration . Commissioner Bonitz made a motion to approve, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Motion carried unanimously. 2. Standard Specifications and Details-Development Permitting and Project Acceptance Project Manager Morgan DeWit presented the last section of the Standard Specifications and details for Board consideration. 3  TOWN OF PITTSBORO BOARD OF COMMISSIONERS APRIL 10, 2023 REGULAR MEETING MINUTES PAGE 4 OF 5 Commissioner Shipp made a motion to approve the recommendation update, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. 3. Lead and Copper Rule Revision Grant Application Project Manager Morgan DeWit presented the Lead and Copper Rule revision for the Board consideration. DeWit shared the EPA has recently changed their Lead and Copper rule. All municipalities must now identify any utility lines that are lead or copper. Per EPA, location of lead and copper materials are to be determined by October 2024 and a replacement plan must be created. In 2021, the asset inventory and assessment found thirteen hundred (1300) unidentified segments which require analysis of lead and copper in these areas . Commissioner Bonitz made a motion to approve the resolution, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. 4. Water Treatment Updates Interim Town Manager/Engineering Director Kent Jackson reviewed advanced treatment loans for the water treatment plant in the amount of five million six hundred eighty-million-dollar ($5,680,000.00) principal forgiveness SRF loan toward PFAS treatment implementing Phase II of the GAC system . The Town was also awarded a twelve million two hundred twenty-four thousand ($12,224,000.00) loan for additional advanced treatment of 1,4 Dioxane using ultraviolet advanced oxidation process. Staff have had positive on-going discussions with the North Carolina Division of Water Infrastructure (NCDWI) to use the twelve-million-dollar loan to build infrastructure to bring potable water into Pittsboro from the Sandford Water Plant expansion project. Jackson stated that in March 2023 EPA introduced draft maximum contaminate levels for PFOA and PFAS. Water Plant Superintendent/ORC Cory Saulsbury shared on March 29, 2023, EPA introduced new contaminate levels for PFOA and PFAS that will become in effect in late 2023 to early 2024. The new rule for PFOS and PFAS maximum contaminant level (MCL) will become four parts per trillion (ppt). The new rule for PFNA, PFHXS, GenX and PFSB maximum contaminant level (MCL) will be an average of one or below. Saulsbury shared the current GAC treated water results for PFOA is non-detect, PFOS is at 1.1 ppt and the average of PFNA, PFHXS, GenX and PFSB are at .0055 ppt so the Town water is well below the new EPA standards that will be finalized at the end of the year. Once the new EPA rules become in effect, municipalities will have three to five years to comply. MISCELLANEOUS 1. Town of Pittsboro Water Conservation Policy Interim Town Manger/Director of Engineering Kent Jackson gave a brief overview of staff formalization of a water conservation policy for discussion . Jackson shared a formal policy to address water conservation that had not been previously implemented for the Town of Pittsboro 4  TOWN OF PITTSBORO BOARD OF COMMISSIONERS APRIL 10, 2023 REGULAR MEETING MINUTES PAGE 5 OF 5 residents. Jackson did share there was an increase in irrigation system requests in the past few months. Mayor Pro Tern Baldwin was concerned about the penalty fees that were suggested and the process for administering fees. 2. Pittshoro Boys & Girls Cluh Report This item was moved to the BOC Regular Meeting Agenda for 4/26/2023. FINAL BOARD COMMENTS Commissioner Shipp requested staff to look at Affordable Housing incentives in UDO particularly around to System Development Fees (SDF) and the financial implications of the policy will be after July 1, 2023.
