PLAINFIELD BOARD OF ZONING APPEALS
July 21, 2016

CALL TO ORDER
Mr. Monnett: I will now call to order the Plainfield Board of Zoning Appeals
for July 21, 2016.
ROLL CALL/DETERMINATION OF QUORUM
Mr. Monnett: I will now ask our Board Secretary for a roll call for
determination of a quorum.

PLEDGE OF ALLEGIANCE
Mr. Monnett: Would you please rise for the Pledge of Allegiance.
APPROVAL OF MINUTES (June 20, 2016)
Mr. Monnett: I will entertain a motion for approval and or amendments to our
meeting June 20, 2016.
Mr. Gibbs: I move that we accept as written.
Mr. Cavanaugh: Second.
Mr. Monnett: I have a motion and a second, all in favor say aye, thank you.
OATH OF TESTIMONY
Mr. Monnett: I will ask our Board Secretary our Town Manager, Mr. Klinger if
he would please administer the Oath of Testimony.
Mr. Klinger conducted the Oath of Testimony.
PUBLIC HEARINGS
Mr. Klinger reviewed the Guidelines Governing the Conduct of Public Hearings.
PETITIONS FOR PUBLIC HEARING
Mr. Monnett: Tonight BZA-16-017, Scotty’s Brewhouse.
Mr. Berg: BZA-15-017 is the special exception request to serve alcoholic
beverages at the Scotty’s Brewhouse. Three suites and an outdoor patio at

Plainfield Village, which is right about here, Main Street, Andy Mohr
Chevrolet, Andy Mohr Ford, Westgate, Whitehouse Storage and hotel just to get
you up to date on the location. It is zoned General Commercial and it is
within the Gateway Corridor. To be exact the suites are 189, 191, and 195
which are over here on the east side of the building. Like I said I will
keep this kind of quick, does this special exception pose any problems or
concerns that are more present than any other in the general area? Of course
we have our typical condition on there that the approval is only for Scotty’s
Brewhouse and is non-transferable to a subsequent business owner or operator
at the same location. The applicant is here so if there are any other
questions I will be happy to turn the podium over.
Mr. Intermill: Good evening, Alex Intermill with Bose McKinney and Evans Law
Firm. 111 Monument Circle, Suite 2700, Indianapolis, Indiana here on behalf
of Scotty’s. Mr. Berg covered it quite well. What Scotty’s is looking to do?
I don’t want to tell you anything that you already know. Scotty’s is pretty
established in the Indianapolis area, 20 restaurants give or take, excellent
compliance record for serving alcohol, very thorough training. Their policy
on carding is they card everyone that wants to purchase alcohol and they have
a zero tolerance policy for their employees for anyone that sells to a minor
has a violation of ATC or other Indiana Law for alcohol. I will take any
questions I can go into their operations or what they plan to do, their floor
plan or anything that you would care to hear. I see that you have the
floorplan, it was part of the application. There is a patio area for the
restaurant as well, that will be part of it.
Ms. Duffer: I just have one quick question, what is the average percentage
of alcohol sales versus food sales? Do you know?
Mr. Intermill: I don’t know the exact percentage, I do know that in order,
they have limited separation so the bar area is separate from the family
dining area, and to do that they have to have at least $100,000.00 in food
sales non-alcohol sales per year, they never have a problem coming close,
that is never an issue. I would hate to venture a guess but I do know they
are very food forward establishment, they have an extensive menu. Sorry I
don’t have a better answer for you.
Ms. Duffer: That is quite alright. I do have another question. Children
allowed up until closing time or is there a specific time that, like it is
9:00 and it is adults only?
Mr. Intermill: No it is children are allowed in the restaurant area until
closing time.
Mr. Monnett: I will close it to the public since there is no public, and
open it up to our board for discussion or a possible motion.
Ms. Duffer: Well I for one am very excited that this is coming to town.
Mr. Cavanaugh: I think this certainly, I have similar restaurants and
petitions that we have approved, and I certainly don’t have any problems with
it. I move to approve Board of Zoning Appeals BZA-16-017 as filed by Bose,
McKinney & Evans LLP for Scotty’s Brewhouse, requesting a Special Exception
to allow the serving of alcohol at 160 Plainfield Village Drive, an
established retail center, on a parcel zoned General Commercial (GC) within a
Gateway Corridor, subject to the following condition:

1. Approval is only for Scotty’s Brewhouse and is nontransferable to a
subsequent business/owner/operator at the same location.
Ms. Duffer: I will second.
Mr. Monnett: I have a motion by Mr. Cavanaugh and a second by Ms. Duffer.

Mr. Klinger: Ms. Duffer- yes

BZA-16-017 is approved 4-0.
OLD BUSINESS/NEW BUSINESS

Mr. James: No that is all we have for tonight.
Mr. Monnett: We are on track for August?
Mr. James: No, I am glad to tell you, there will be no meeting in August.
We don’t have any petitions filed.
