CITY OF POCATELLO, IDAHO CITY COUNCIL EXECUTIVE SESSION SEPTEMBER 13, 2018 An Executive Session of the City Council was called to order by Mayor Brian Blad at 12:07 p.m. in the Paradice Conference Room at City Hall. Council members present were Heidi Adamson, Roger Bray, Rick Cheatum, Jim Johnston, Linda Leeuwrik and Beena Mannan. A motion was made by Ms. Adamson, seconded by Mr. Cheatum, to convene into Executive Session in accordance with Idaho Code Sections 74-206(1)(f) to communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement. Upon roll call, those voting in favor were Adamson, Cheatum, Bray, Johnston, Leeuwrik and Mannan. In addition to the Mayor and Council members, Ruth Whitworth, City Clerk; Jared Johnson, City Attorney; Kirk Bybee, Chief Civil Deputy Attorney; Jeff Mansfield, Public Works Director; Justin Armstrong, Water Superintendent; and Anne Nichols, Assistant to the Mayor. Sarah A. Klahn, Esquire representing Somach, Simmons and Dunn; joined the meeting by telephone. Conference call with Ms. Klahn began at 12:25 p.m. and ended at 12:50 p.m. Council discussed various issues within the parameters of the above statutes.
