The following is the official agenda of the Hearing Examiner. Discussion and action will be limited to those items on the agenda.

internal lit signs 1) Eight-foot by twenty-seven-foot (8’x27’) located at the front of the building and 2)
Seven-foot, one-inch by twenty-four-foot sign (7’.1”x24’) on the back of the building for the property
located at 1732 Hurley Drive, the former Bed, Bath & Beyond.

RECOMMENDATION & CONDITIONS:
Staff finds that the proposal is not compliant with any applicable standards of City Code 15.20.270. A full analysis is detailed
within this staff report. Should the Hearing Examiner approve the request, staff recommends the following conditions:
1. All applicable standards of the City of Pocatello Municipal Code Title 15.20 “Sign Code” not herein listed and
applicable shall apply; and
2. The applicant shall be required to be approved for a sign permit prior to sign construction.
REQUEST & BACKGROUND: Grocery Outlet, represented by Kenyon Crouch of Sign Pro requests a sign exception to allow for
an increase to the sign allowance for a multiuse commercial/professional plaza development.
NOTIFICATION (15.20.260): All property owners and tenants that share a common boundary line, including across the public
right-of-way, with the subject property have been provided notice of the public hearing in order that they may provide
comment on the application. All notices herein described have been provided at least fifteen (15) days prior to the public
hearing or as otherwise required by Idaho State Code. At the time of completion of this report, no written comment from the
public has been received neither in support nor in opposition to the application.
HEARING EXAMINER AUTHORITY TO GRANT (15.20.260):
The Hearing Examiner has the authority to approve signs with or without special conditions concerning sign size, design,
illumination, height, width, landscaping, placement on site, or any other condition it deems pertinent for sign enhancement.
The hearing examiner shall only approve signs and sign structures that are consistent with the purpose set out in section
15.20.010 of this chapter and with the Comprehensive Plan of the City. Any aggrieved party may, within ten (10) days of the
decision, appeal a decision to the City Council which shall hold a public hearing on the matter.

Staff Review Grocery Outlet is located within a Commercial General (CG) zoning district. More

located. This development has no unique physical characteristics that would warrant
a sign exception.
15.20.270.B The applicant shall have taken all reasonable steps to comply with the strict terms
of the ordinance from which he or she requests an exception.
Staff Review All reasonable steps were not taken to comply with the strict terms of the ordinance.
Due to the location being in a multiuse commercial development within the CG zone,
the applicable standards are the “multiuse commercial/professional plaza”
(15.20.200). Each business receives a maximum sign allowance of one and one-half
(1.5) square feet for each linear foot of business frontage. The business frontage is
☐ ☒ ☐ one hundred twenty-one (121’) feet, which makes the maximum sign allowance for
the front of the business one hundred eighty-one and one-half (181.5) square feet. In
addition, each business shall also be allowed one sign on a side or rear wall occupied
by the business with a sign allowance for one (1) square foot for each linear foot of
business frontage with a maximum of seventy-five (75) square feet. Each business also
shares common pole or ground signage. All other businesses and previous businesses
within this complex have met the strict terms of the sign standards. Therefore, it is
reasonable to adhere to the sign allotment.
15.20.270.C The circumstances surrounding the request shall be extraordinary as related to the
applicant's land and the reasonable use thereof.
Staff Review The request is to allow an increase to the sign allowance. Without the sign exception,
Code section 15.20.200 would allow for one hundred eighty-one and one-half (181.5)

common pole or ground sign. The sign allowance formula has provided sufficient
allowance for the property to advertise and make known where they are located.
Previous and current tenants have demonstrated the sign allowance formula has been
sufficient for the reasonable use and advertisement of the property.
15.20.270.D The applicant should show that, absent an exception, no reasonable identification
of the subject land remains.
Staff Review The request is to allow an increase to the sign allowance. Without the sign exception,

common pole or ground sign. The proposed signage is two-hundred sixty (260) square
feet in the front and one-hundred seventy (170) square feet. The proposed signs
would be substantially bigger than what surrounding businesses have been allotted.
15.20.270.F The proposal must be in conformance with the purpose set forth in this chapter.
Staff Review The purpose of the Sign Code is to promote the public health, safety, and general
welfare by regulating existing and proposed signage. It is intended to protect and
enhance the physical appearance of the community, reserve the scenic and natural
beauty, provide an enjoyable and pleasing community, protect property values, and
create an attractive economic and business climate. It is further intended to reduce
sign or advertising distractions and obstructions that may contribute to traffic

accidents, reduce hazards that may be caused by signs overhanging or projecting over
the public right-of-way, provide more open space, and curb the deterioration of
natural beauty and the community environment.
Increasing the sign allowance would hinder the purpose of the title 15.20. Increasing
sign allowance for the front by 43% and for the rear by 126% causes unnecessary
attention for drivers and takes away from the physical appearance of the community.

Written Narrative
When choosing a sign size, one must consider the message and audience that message is trying to reach.
Having a letter size too small makes the message confusing or hard to read, while too big makes the
message look cluttered and considered distractive. For this reason, letter sizes charts have become a
Sign Industry Standard when recommending letters sizes used for advertising. Unique to this property is
the large open space West of the Main Entry at 354 feet. This computes to an average open space of
177’ (354’/2 or 177’), or the distance from the sign face for the average shopper parking in the parking
lot. For a sign to be affective, it must be easily readable to its intended and targeted audience.
When considering the average open space of 177’ (calculated above) and referring to industry charts,
the letter size that offers easy readability is an 18” letter. An 18” letter has a maximum viewable
distance at 450 feet, the distance for easy readability at 180 feet, and a Distance for maximum impact at
90 feet. This makes an 18” letter set ideal under these settings.
The signage proposed for Grocery Outlet consists of two main components. Channel letters mounted on
a backer pan installed in two sections and (5) individual letter sets directly mounted to the wall. For the
letter sets, using the above-mentioned information makes an 18” the ideal size for readability. It is
visible to the road in front and easily read by those in the parking lot. This size also works well with the
given storefront space allowing ample space between letter sets furthering the easy readability.
The remaining portion of this signage is the pan mounted channel letters. While the pan in this case is
considered a sign and the overall dimensions used in calculating the sign area, this method exaggerates
the overall square footage of the letters. The Sign Copy as defined by code would be considerably
smaller. The same look could effectively be accomplished by installing letters on a painted wall instead.
The pan is used to help lower the required install time making the install more efficient.
Using the Sign Copy definition for the front sign, the proposed signage footage calculates to 193 SF or 12
SF over the allowed 182. This accounts to just 6.5% over the allowed limit and is what is requested in
this variance. If the storefront could be extended by 8’, this request would not even be necessary.
For the rear of the building, using the same definition of Sign Copy, the proposed sign comes to 117 SF.
Code calls for an allowance of 1SF/linear foot (121’ for this location) capped however at 75 SF. The
proposed sign shows a smaller letter of 16 ½” with a target audience of those driving on W Quinn Rd.
With a line drawn at a 45-degree angle from the proposed sign location (a readable angle), drivers on W
Quinn are 400’ out. This reaches the maximum readability of a 16” letter. Anything smaller would not be
readable.
