HISTORIC PRESERVATION COMMISSION Special Meeting Minutes for June 26, 2023 at 6:00 p.m. City Council Chambers, Municipal Building 911 N. 7th Avenue, Pocatello, ID The meeting began at 6:00 p.m. AGENDA ITEM 1: ROLL CALL AND DISCLOSURE OF CONFLICT OF INTEREST AND EX- PARTE CONTACT Disclose who was talked to, the basic substance of the conversation, and whether the conversation had any influence. Disclose if there is anything personally or professionally that would not allow an impartial or unbiased decision. Disclose if a site visit was done, location(s) of the visit, and what was seen. PRESENT: Tabatha Butler, Ruta Casabianca, Denis Clijsters (arrived at 6:01 p.m.), Josh Pohlman (left at 6:35 p.m.), Ellen Ryan, Marty Vizcarra and Jim Young (arrived at 6:01 p.m., left at 6:16 p.m.). STAFF: Jim Anglesey and Aceline McCulla. M. Vizcarra stated he did a site visit for agenda item 3. R. Casabianca stated she did a site visit for agenda item 3. D Clijsters stated he is on the Board of the Historic Downtown Pocatello and will recuse himself from agenda item 3. J Young is on the Board of the Historic Downtown Pocatello and will recuse himself from agenda item 3. None of the other Commission members had anything to report. AGENDA ITEM 2: APPROVAL OF MINUTES The Commission may wish to waive the oral reading of the HPC minutes for the regular meeting held June 7 and the special meeting held June 21 of 2023 and to approve the minutes as written. It was moved by T. Butler and seconded by J. Young to approve the HPC minutes for the regular meeting held June 14 and the special meeting held June 21 of 2023, and approve the minutes as written. Those in favor: Butler, Casabianca, Clijsters, Pohlman, Ryan, Vizcarra and Young. Unanimous. Motion carried. AGENDA ITEM 3: CERTIFICATE OF APPROPRIATENESS FILE 23-03 Historic Downtown Pocatello Inc., represented by Nick Hottman has submitted an application for a certificate of appropriateness for a mural at 435 W. Center Street. Stephanie Palagi stated a sign permit was submitted through the City’s seamless document system and she did not hear back from the City, but she did not follow up on the status of the application. Staff let Palagi know a sign permit was not needed, but a Certificate of Appropriateness was required. Palagi completed the COA application and this special meeting is the result, so they could make their end of month deadline. It was moved by T. Butler to a approve the request from Historic Downtown Pocatello, Inc. as presented, finding the application meets the criteria for review, as well as all local and national standards, and authorize the Chair to sign the Certificate of Appropriateness. No second, Motion failed. It was moved by R. Casabianca and seconded by J. Pohlman to continue this agenda item to July 5, so the Commission may research more on this mural. Those in favor: Casabianca, Pohlman, Ryan, Vizcarra. Those against: Butler. Motion carried. Jim Young verbally resigned from the HPC and left the Council Chambers at 6:16 p.m. Clijsters stated more discussion is needed before moving to the next agenda item. The Commission ensued in discussion on agenda item 3. Clijsters noted that personal politics should not expressed on sign or mural applications that come before the HPC. An application was submitted with the required documents and the HPC Meeting 6.26.2023 Page 1 of 2 staff report states the request is compliant with Pocatello Municipal Code. The special meeting was scheduled to process the mural application according to the rules and the HPC should process applications without personal politics or livelihood. Butler noted that the application is compliant and has no issues. Anglesey explained the painting project received a STOP order until the COA is approved and signed. The application and supporting documents were submitted and this special meeting was scheduled to come before the HPC and staff has determined the application is compliant per Municipal It was moved by J. Pohlman and seconded by T. Butler to a approve the request from Historic Downtown Pocatello, Inc. as presented, finding the application meets the criteria for review, as well as all local and national standards, and to authorize the Chair to sign the Certificate of Appropriateness. Those in favor: Butler, Casabianca, Pohlman, Ryan, Vizcarra. Unanimous. Motion carried. Josh Pohlman verbally resigned from the HPC at 6:34 p.m. Chair Vizcarra asked to move the agenda items 4 and 5 to the next meeting. AGENDA ITEM 4: DISCUSS WALKING TOURS ON THIRD WEDNESDAY OF MONTH The Commission may wish to discuss walking tours on the optional Wednesday of the month. The Historic Preservation Commission is a citizen advisory group to the City Council. They are charged with making decisions concerning the exteriors of the buildings in the Downtown Historic District, make recommendations to the City Council for designation of historic properties and historic preservation and promote historic preservation in the city. The Commission also plays a vital role in the City’s downtown revitalization efforts. All meetings of the HPC are recorded for record retention and transcription. Butler and seconded by E. Ryan to approve the HPC May 3, 2023, meeting minutes with the correction of Tews name in Agenda item three (3). Those in favor: Butler, Casabianca, Clijsters, Pohlman, Ryan and Vizcarra. Unanimous. Motion carried. AGENDA ITEM #3: HPC ELECTIONS The Commission may wish to elect a Chair and Vice Chair for the next year. Butler nominated Marty Vizcarra for Chair. Casablanca nominated Tabatha Butler for Vice Chair. It was moved by J. Pohlman and seconded by R. Casabianca to appoint Marty Vizcarra as Chair and Tabatha Butler as Vice Chair. Those in favor: Butler, Casabianca, Clijsters, Pohlman, Ryan and Vizcarra. Unanimous. Motion carried. AGENDA ITEM 4: DISCUSS WALKING TOURS ON THIRD WEDNESDAY OF MONTH The Commission may wish to discuss walking tours on the optional Wednesday of the month. June 21 - ISU Quad tour is set for 6:00 p.m. July TBD - Red Light Tour or Presentation. Ryan will contact Arlen Walker on a preference for a tour or a presentation, and then Ryan will let staff know for a July date and possible location. August 16 – ISU Library Special Collections Tour with Ellen Ryan for 6:00 p.m. September 20 – TBD AGENDA ITEM 5: PRESERVATION PROJECT ASSIGNMENTS The Commission may wish to discuss preservation projects and updates on assignments. Butler and Vizcarra had a discussion with Mayor on an option and present ideas to City Council in an Executive Session for direction on possible preservation projects. It was moved by T. Butler and seconded by E. Ryan to approve Butler and Ryan to research the Federal Building and other buildings in the downtown area; Clijsters, Pohlman, and Young to research and report on HPC Meeting 1.4.2023 Page 1 of 2 economic impacts if the City offices were to locate to downtown; Vizcarra will provide a feasibility report on specific buildings that would accommodate a City Hall, and Casabianca will research ADA accessibility of historic buildings downtown, and all findings will be presented to the Commission during the July 5 meeting. Those in favor: Butler, Casabianca, Clijsters, Pohlman, Ryan and Vizcarra. Unanimous. Motion carried. Ryan is on the Board of the Bannock County Historic Museum and was asked by Lynn Murdoch to get the Fort Hall Replica Building on the National Historic Registry, so Ryan volunteered her services to get that done. Murdoch has spoken to the Mayor about placing this building on the National Historic Register. Ryan has been working with SHPO on the process and has submitted the Preliminary Eligibility Questionnaire (PEQ) to get the determination of eligibility done. Clijsters asked if there was anything the HPC could do to preserve the Monarch Building. Vizcarra noted it is in the Historic District. Anglesey noted the building is on the National Registry, and tax credits could be used to rehab the building, but money needs to be available upfront to rehab the building because it is only a tax credit. Ryan noted tax credit projects need to go through SHPO. Anglesey noted he told the owners about this option over a year ago, and has not spoken with them since. The owners need to find investors. Vizcarra will ask the owners to give an update on the Monarch Building before the HPC, possibly the July meeting. Casabianca stated the Brady Chapel Memorial Day Open House was successful and they raised over $800 in donations. No other business was conducted. Center Street CITY STAFF ASSIGNED: Jim Anglesey, Long-Range Senior Planner RECOMMENDATION & CONDITIONS: Staff concludes that the application for a certificate of appropriateness is compliant with Pocatello Municipal Code Section 17.04.210. OPTIONAL MOTIONS: 1. Approval of the Application: “Move to approve the request from Historic Downtown Pocatello, Inc. as presented, finding the application meets the criteria for review as well as all local and national standards, [insert any conditions of approval] and authorize the Chair to sign the Certificate of Appropriateness.” 2. Denial of the Application: “Move to deny the request from Historic Downtown Pocatello, Inc., finding the application does not meet the criteria for review, finding that: [cite findings for denial].” REQUEST: Historic Downtown Pocatello, Inc., represented by Nick Hottmann, has submitted an application for a Certificate of Appropriateness for a mural on the west side of the building at 435 W. Center Street. BACKGROUND: 435 W. Center Street (known as the Bangs Building) was built in 1940 and is included in and compatible to the local historic district. The building is not listed on the National Register of Historic Places. This building’s design is typical of a Mid-Century store front and the most locally iconic feature is that of the Bangs neon sign atop the building. DESIGN GUIDELINES FOR POCATELLO’S DOWNTOWN HISTORIC DISTRICT: Staff finds the following standards identified in the design guidelines for the downtown historic district to be applicable to this application: 1. Exterior alterations and changes should be kept to a minimum. 2. The building should conform to surrounding buildings and other street features. 3. Every effort should be made to maintain and preserve the building’s original materials and colors. 4. Original and distinctive architectural details should be retained or restored. 5. Signs should be architecturally compatible with the design of the original or proposed building. THE SECRETARY OF THE INTERIOR’S STANDARDS FOR THE TREATMENT OF HISTORIC PROPERTIES: Staff finds the following standards identified in the Secretary of the Interior’s Standards for the Treatment of Historic Properties to be applicable to this application: “Rehabilitation is defined as the act or process of making possible a compatible use for a property through repair, alterations, and additions while preserving those portions or features which convey its historical, cultural, or architectural values.” Standards for Rehabilitation: 1. A property will be used as it was historically or be given a new use that requires minimal change to its distinctive materials, features, spaces and spatial relationships. 2. The historic character of a property will be retained and preserved. The removal of distinctive materials or alteration of features, spaces and spatial relationships that characterize a property will be avoided. 3. Each property will be recognized as a physical record of its time, place and use. Changes that create a false sense of historical development, such as adding conjectural features or elements from other historic properties, will not be undertaken. 4. Changes to a property that have acquired historic significance in their own right will be retained and preserved. 5. Distinctive materials, features, finishes and construction techniques or examples of craftsmanship that characterize the restoration period will be preserved. 6. Deteriorated historic features will be repaired rather than replaced. Where the severity of deterioration requires replacement of a distinctive feature, the new feature will match the old in design, color, texture and, where possible, materials. Replacement of missing features will be substantiated by documentary and physical evidence. 7. Chemical or physical treatments, if appropriate, will be undertaken using the gentlest means possible. Treatments that cause damage to historic materials will not be used. 8. Archeological resources will be protected and preserved in place. If such resources must be distributed, mitigation measures will be undertaken. 9. New additions, exterior alterations, or related new construction will not destroy historic materials, features, and spatial relationships that characterize the property. The new work will be differentiated from the old and will be compatible with the historic materials, features, size, scale and proportion, and massing to protect the integrity of the property and its environment. 10. New additions and adjacent or related new construction will be undertaken in such a manner that, if removed in the future, the essential form and integrity of the historic property and its environment would be unimpaired. ATTACHMENTS: A. Application & Supporting Materials REVIEW CRITERIA (17.04.210.I) Compliant City Code and Staff Review Yes No N/A Code Section Analysis 17.04.210.I.1 Adverse impacts to the historical integrity of the property or structure shall be minimized. Staff Review The proposed work includes a mural on the west exterior wall of the building. Appropriate application of murals, in accordance with the recommendations of the national preservation standards, would require said murals to avoid being applied to historically significant features of a building (e.g. building façade and other features) as well as raw, unpainted brick. Painting raw brick accelerates the degradation of the ☒ ☐ ☐ brick material. This is caused by water being possibly trapped between the brick and paint layer, subjecting the brick to water damage including but not limited to freeze/thaw cycles. The brick wall was painted previous to the current building owner, thus the inclusion of a mural on this wall will not increase the degree of impact to the structure of the building related to the degradation of building materials. The building was built one year after the period of significance, is not listed on the national register and the proposed changes will not affect the potential historic integrity of the property. 17.04.210.I.1.a Changes to the defining characteristics of the building or site shall be minimized. ☒ ☐ ☐ Staff Review The proposed work will not change the defining characteristics of the building. ☒ ☐ ☐ 17.04.210.I.1.b Removal of historic materials and features of the building or site shall be avoided.
