HISTORIC PRESERVATION COMMISSION Minutes for January 17, 2024 at 6:00 p.m. City Council Chambers, Municipal Building 911 N. 7th Avenue, Pocatello, ID The meeting began at 6:00 p.m. AGENDA ITEM #1: ROLL CALL AND DISCLOSURE OF CONFLICT OF INTEREST AND EX- PARTE CONTACT Disclose who was talked to, the basic substance of the conversation, and whether the conversation had any influence. Disclose if there is anything personally or professionally that would not allow an impartial or unbiased decision. Disclose if a site visit was done, location(s) of the visit, and what was seen. PRESENT: Tabatha Butler, Ruta Casabianca, Josh Pohlman (arrived at 6:13), Ellen Ryan, Marty Vizcarra and Jim Young. STAFF: Jim Anglesey and Aceline McCulla. None of the members had anything to disclose. AGENDA ITEM #2: Approval of Meeting Minutes. The Commission may wish waive the oral reading of the special meeting minutes held December 6, 2023, and to approve the minutes as written. It was moved by T. Butler and seconded by J. Young to approve the HPC meeting minutes as written from December 6, 2023. Those in favor: Butler, Casabianca, Ryan, Vizcarra and Young. Unanimous. Motion carried. AGENDA ITEM #3: Preservation Projects & Assignments. The Commission may wish to discuss preservation projects and updates on assignments. Action Item • Community Engagement & Outreach o Preservation Month in May • Brady Chapel Casabianca stated the Chapel will be open on Memorial Day, the RFP is ready to go out for bids, with a project start date of April 2024. There will be a ground-breaking ceremony and will reach out to Marlise, City PIO to assist with outreach. • Additional Projects • Design Standards Public Engagement Meeting and Draft Review Anglesey stated the HPC was going to review the design standards in the work session, but our consultant had a death of a family member, so was unable to deliver the draft as scheduled. The Art Walk should be scheduled around the design standards draft and obtain input from Downtown businesses and public. Schedule the Public Engagement Event on March 1,, during the Art Walk, this will provide time to review the draft in February and publicize the Public Engagement Event on the first draft with Irby, City’s PIO. Vizcarra recommended moving the March meeting until March 20, to allow time to review the public comments and then make changes accordingly. The HPC was in agreement. Triangle Informational project meeting had 40 attendees to assist with documenting the HPC Meeting 1.17.2024 Page 1 of 3  neighborhood. There was press to advertise the event, but no press attended. With no other business, Vizcarra closed the meeting at 6:12 p.m. and moved the Commission into the work session. * * * Work Session * * * Vizcarra called the work session to order at 6:19 p.m. Annual Training on Open Meeting Laws and Policies. Anne Nichols will provide training to the HPC on open meeting laws and policies. Anne Nichols, City of Pocatello Chief of Staff emailed all HPC members and staff an updated memo with highlights, and current version of Answers to Commonly Asked Questions: A Policy Guide for Members of City Boards, Commission and Committees (v2021). Attendance Policy: excused and unexcused absences, more than three (3) of excused or unexcused absences causes quorum issues, and both may be a cause for removal. Proxy Voting is not allowed, per State Code, you must be present to provide your input and vote on an agenda item. So not discuss any agenda item with other members or public. Call Staff regarding questions on agenda items prior to the meeting, before 5 p.m. on the meeting date. Elections for Chair and Vice Chair should be held annually. The Chair or Vice Chair is responsible to maintain order of the meeting, and must know the agenda items, and the procedures for a public hearing. Do not discuss items on the agenda, not on the agenda, or under the HPC’s purview at a meeting with HPC members, staff, or the public. Direct the public to Anglesey or McCulla to reach out to the public to address their inquiries. Open public meetings allow the public to attend, but no public comment is allowed, except during a public hearing agenda item, and then only in the public comment segment of that public hearing. Violations are found on page 6 and 7 of the Policy Guide, each member and staff will be fined: a $200 fine for first offense for those who do not-know they violated the law; you all are aware and would be fined $1,500 for violating the law; and second offenders within a year period of the first offense are fined $2,500. Read more on criminal violations in the Policy Guide. Avoid receiving information from the public on any agenda item, direct them to contact staff to get information on the agenda item. McCulla has business cards on hand to provide to the public during the meetings. Private or Small Meetings consisting of two or more HPC members are not allowed, you are violating open meeting laws. Subcommittees can be established, but they must comply with all requirements, agendas, minutes, public notices. Public Records Requestable Items, be aware that your phone texts and emails, if used during a meeting, may be record requestable. The public may view this as two members colluding on an agenda item. HPC Meeting 1.17.2024 Page 2 of 3 Communication with the Public, do not have any discussions with the public about current or future items that may come before the HPC as an agenda item, direct the public to staff with their questions. Email Response, never “reply all” to HPC business emails to avoid serial meetings, because if you reply with your person remarks, others have seen the information and may not unsee your , and people may be biased by the information. HPC Document Records, members must keep all meetings, emails, and texts for five years and ask staff for help on records retention. Members’ personal information, less the Chair, are protected, The Chair’s name, email, and phone number are provided to the public so they may reach out to the Chair to request to be placed on an agenda. Public Releases/Outreach, please reach out to the Marlise Irby, City’s PIO for assistance with public releases or interview preparation. You may also have the media contact Vizcarra or Anglesey directly. Draft Review of the Pocatello Downtown Historic Design Standards. Staff and the Commission will review a working draft of the Pocatello Downtown Historic Design Standards. Anglesey stated this item will be moved to a future meeting.
