CITY ATTORNEY REPORT ON CLOSED SESSION ITEMS City Attorney Alvarez-Glasman stated that the City Council convened into Closed Session at 5:40p.m. and that the items listed on the agenda had been announced prior to recessing into Closed Session, that Judith St. John spoke on Closed Session Item No. B, and reported the following: Item A: A briefing was provided and direction was given; however, no final action was taken and there is nothing further to report. Item B: A briefing was provided and direction was given; however, no final action was taken and there is nothing further to report. Item C: A briefing was provided and direction was given; however, no final action was taken and there is nothing further to report. Item D: This item was not discussed. The City Council recessed from Closed Session at 6:45p.m. MAYOR/COUNCILMEMBER COMMUNICATIONS Councilmember Escobar announced "Take 5 in District 5" community meetings which will be held on the second and fourth Mondays of every month at various locations. Councilmember Gonzalez announced a community cleanup at Kennedy Park which will be held on Saturday, February 18, 2017 and a neighborhood watch meeting which will be held on Thursday, City of Pomona Page 2 Printed on 5/8/2017 City Council Meeting Minutes - Final February 13, 2017 March 2, 2017 at 6:00p.m. CITY MANAGER COMMUNICATIONS City Manager Lowry had nothing to report. PUBLIC PARTICIPATION There were no speakers under Public Participation. STUDY SESSION 1. Discuss F-Zone land uses Development Services Manager Johnson delivered a presentation on the land uses of the F Zone. Jose Vadi, Regina Mundekis, and Mario Ramos presented arguments in favor of suspending, reviewing, and amending or revoking the F zone. Miguel Santana, Fairplex President and CEO, presented arguments in opposition to suspending, reviewing, amending, or revoking the F zone and demonstrated the Fairplex's willingness to collaborate and cooperate with the City. The City Council conceded to limit each speaker's public comments to 2 minutes. Councilmember Gonzalez spoke in favor of the Fairplex; suggested that the City Council create a subcommittee including Mayor Sandoval and Councilmember Torres to review the F zone. City of Pomona Page 4 Printed on 5/8/2017 City Council Meeting Minutes - Final February 13, 2017 Councilmember Torres clarified that he is not opposed to the Fairplex; expressed that there are issues that need to be resolved; opined that the City Council should have control over what the Fairplex is allowed or not allowed to do; expressed support for the subcommittee proposed by Councilmember Gonzalez; and stressed the importance of the City Council overseeing the Fairplex's operations. Councilmember Escobar spoke in favor of the Fairplex and reviewing the F Zone but indicated that she is opposed to suspending or revoking the F Zone; and expressed support for working with the Fairplex to improve the F Zone. Mayor Sandoval spoke in favor of the Fairplex and proposed a 3-member subcommittee to meet with Staff and receive public input on proposed amendments to the F Zone. Councilmember Carrizosa stated that the City should be receiving a larger portion of revenues from the Fairplex so that the City can mitigate issues with streets, trash, and lawsuits; and opined that the F Zone needs to be reviewed and modified. Vice Mayor Robledo agreed that the City should be receiving a larger portion of the Fairplex's revenue and suggested that the City converse with the Fairplex Board of Supervisors. Councilmember Ontiveros-Cole spoke in favor of the Fairplex; and noted that she agrees that the City Council should oversee the Fairplex's operations. Councilmember Torres reiterated that the City Council should oversee the Fairplex's operations. Mayor Sandoval suggested that the City Council consider creating an Ad -hoc Committee to review the F Zone and provide a recommendation to the City Council; and inquired and Assistant City Attorney Jared advised of the different types of committees the City Council has the option of creating, noting that the committee would be subject to the Brown Act. MOTION BY COUNCILMEMBER TORRES, SECOND BY COUNCILMEMBER ESCOBAR to direct Staff to collaborate with the Fairplex and provide a report to the City Council with suggested amendments to the F Zone which provide an avenue for City Council approval and public input, within 60 days. AMENDED MOTION BY COUNCILMEMBER TORRES, SECOND BY COUNCILMEMBER ESCOBAR, CARRIED 7-0 directing Staff to coordinate a joint meeting of the City Council and the Fairplex Board of Directors to review the Zoning Ordinance pertaining to the F Zone and recommend amendments which will provide an avenue for City Council approval and public input and a process that fosters a collaborative effort with the Fairplex. MATTERS INITIATED BY CITY COUNCILMEMBERS Councilmember Escobar requested that Staff remove a pile of dirt on North Ranch Road and the 71 Freeway. Mayor Sandoval announced that he and Chief Capraro will have a gathering at Mi Cafecito on Main Street on Wednesday, February 15, 2017 from 8:30-10:30a.m. and District Cleanups on Saturday, February 18, 2017.
