PUBLIC COMMENT: 1. At this time, the general public is invited to address the Planning Commission concerning any items that are not listed on the agenda, which are not public hearings, or other items under the jurisdiction of the Planning Commission. Comments from the public of any nonagenda items will be limited to three (3) minutes in accordance with City policy. Any applicant or member of the public wishing to speak on any item that is listed on the agenda is requested to adhere to the following protocol procedures/guidelines: a) When called upon, the person shall state his /her name and address for the record, and, if speaking for an organization or other group, identify the organization or group represented. Whenever any group of persons wishes to address the Planning Commission on the same subject matter, the Chairperson may, at his /her discretion, request that the group choose a spokesperson to address the Commission. b) All remarks should be addressed to the Planning Commission as a whole, and not to individual Commissioners . Questions, if any, should be directed to the presiding Chairperson who will determine whether, or in what manner an answer will be provided. Speaker Times: After the public hearing is opened, the chair will first call upon the applicant or their representative (s) to speak. The applicant has up to eight (8) minutes to address the Commission. After the Applicant has had an opportunity to speak, the Chair will call upon any members of the public wishing to speak on the item. Each person speaking either in favor or in opposition shall be allowed to speak for not more than three (3) minutes, provided that, due to the number of speakers, the Chair, with the consensus of the Commission, may reduce the time each speaker is allowed to speak. After all speakers have had an opportunity to speak, the Applicant shall have up to five (5) minutes for rebuttal of any opposition raised. The Planning Commission may permit the applicant to exceed the preceding time limits if the Commission determines that the proposed project's complexity requires additional time for the applicant to make an adequate presentation. 3. CONSENT CALENDAR: All items listed on the Consent Calendar may be enacted by a single motion without separate discussion. If a discussion or a separate vote on any item is desired by a Planning Commissioner, that item may be removed from the Consent Calendar and considered separately. All remaining items not removed from the Consent Calendar by a Planning Commissioner shall be voted on prior to discussion of the item(s) requested to be pulled. 1. Approval of Draft Planning Commission Action Minutes meeting of November 10, 2021. Attachments: PC Action Minutes 11-10-2021 2. Finding of General Plan Conformity (GPC 17348-2021) for proposed alley vacation located between Palomares Street and Linden Street. Attachments: Staff Report Attachment 1: Draft Planning Commission Resolution Attachment 2: Exhibit A: Map of Proposed Alley Vacation G. PUBLIC HEARING: 1. Conditional Use Permit (CUP 15779-2021), Parcel Map (PARCELMAP 15780- City of Pomona Page 3 Printed on 12/3/2021 Planning Commission Regular Meeting Agenda December 8, 2021 2021), Variance (VAR 11849-2019), and Environmental (ENV 9676-20118) (Request to continue to January 12, 2022) Project Address: 1561 Via Estrella Project Applicant: Ecoprana Investments, LLC Project Planner: Vinny Tam, Senior Planner Council District: CC District No. 6 A request to develop and subdivide a 2.69 acre hillside property with two (2) detached, two story, single-family residential units located within the Mountain Meadows Specific Plan area. In compliance with the California Environmental Quality Act (CEQA) guidelines, an Initial Study has been conducted to determine the potential environmental impact of the proposed development. Staff has determined that the project could have potential environmental impacts to biological resources, cultural resources, noise, and tribal cultural resources, however, the impacts would be less than significant with the incorporation of mitigation measures. Therefore, staff is recommending the Planning Commission adopt a resolution certifying the Initial Study/Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program including adoption of environmental findings pursuant CEQA. Recommendation: Staff recommends that the Planning Commission adopt the attached draft resolutions approving Conditional Use Permit (CUP 15779-2021), Parcel Map (PARCELMAP 15780-2021), Variance (VAR 11849-2019), and Environmental (ENV 9676-20118), subject to conditions. General Plan Amendment (GPA 17271-2021) Project Address: Citywide Project Applicant: City of Pomona Project Planner: Ata Khan, Planning Manager Council District: Citywide Recommendation to City Council to approve “Pro Housing Pomona,” the Sixth Cycle Housing Element Update to the Pomona General Plan. The proposed project is exempt under State CEQA Guidelines §15061(b)(3) common sense exemption. Recommendation: Staff recommends that the Planning Commission recommend City Council approval of Pro Housing Pomona, the City’s sixth cycle Housing Element update to the Pomona General Plan. The Planning Commission will consider adopting a Categorical Exemption in compliance with Article 19, Section 15301, Class 1 (Existing Facilities) in that the project would enable an addition to an existing structure. Recommendation: The Planning Division recommends the Planning Commission adopt the attached draft resolutions approving Variance (VAR 17049-2021), subject to conditions. The Planning Commission will consider adopting a Categorical Exemption in compliance with Article 19, Section 15304, Class 4 (Minor Alterations to Land) in that the project would involve minor public alteration within the existing public rights-of-way. Recommendation: The Planning Division recommends the Planning Commission adopt the attached draft resolutions approving Major Oak Tree Permit (MAJOTP 17277-2021), subject to conditions.
