CALL TO ORDER: The meeting was called to order at 9:30 a.m. in the Council 2 Chambers, 4300 S. Atlantic Avenue, Ponce Inlet, Florida. APPROVAL OF THE MINUTES: 14 15 A. May 18, 2026 - Special Magistrate Berryman approved the May 18, 2026, meeting 16 minutes as presented. 17 18 3. Case # 2026-255 23 Robert & Augustina Dockendorf 24 4495 S. Atlantic Ave. #106 25 Alleged Violation: Rental without permit 26 27 Mr. Hooker provided an update on the case, which was previously heard by Special Magistrate 28 Berryman on May 18, 2026. At that hearing, the property was found in violation of the applicable 29 Town Code provisions and a deadline for compliance was established. The Special Magistrate 30 ordered payment of a $250 administrative fee by June 17, 2026. The Respondent paid the $250 31 administrative fee on June 15, 2026 and staff verified that the property is now in full compliance. 32 Staff requested an Order of Compliance and closure of the case. 33 34 Special Magistrate Berryman found the property to be in compliance and ordered the case to be 35 dismissed. 36 37 B. Case #2026-070 38 Gerald Ramming 39 4752 S. Atlantic Ave. Apt. #4 40 Alleged Violation: Rental without permit Code Magistrate Hearing Minutes June 22, 2026 Page 1 of 3 41 Mr. Hooker presented an update on this case, which was previously heard before Special 42 Magistrate Berryman on May 18, 2026. At that hearing, the property was found in violation of the 43 applicable Town Code provisions and a compliance deadline of May 26, 2026, was established. 44 The property owner obtained a rental permit on June 17, 2026. Although compliance was achieved 45 after the established deadline, the property owner paid the required $250 administrative fee. Staff 46 verified compliance with the order and requested an Order of Compliance and dismissal of the 47 case. 48 49 Special Magistrate Berryman found the property to be in compliance and ordered the case to be 50 dismissed. 51 52 5. NEW BUSINESS: 53 A. Case # 2026-263 54 Colbert Consulting Inc. Trust 55 c/o Donald Colbert 56 4535 South Atlantic Avenue Apt. #2102 57 Alleged Violation: Rental without permit 58 59 Mr. Hooker presented testimony of the alleged violation for failure to obtain a Town-issued rental 60 permit. On April 1, 2026, Staff identified the property as being offered for rent without a valid 61 rental permit. A courtesy letter and rental permit application were mailed to the property owner 62 advising that compliance was required by April 14, 2026. On April 24, 2026, Staff verified that 63 the property remained in violation. As a result, a Notice of Violation and Notice of Hearing were 64 mailed to the property owner, establishing a compliance deadline of May 8, 2026. The certified 65 mail receipt was signed and returned to the Town on April 29, 2026. As of the date of the hearing, 66 the property owner had not obtained a Town-issued rental permit and the property continued to be 67 advertised for rent. Mr. Hooker presented supporting documentation and photographs showing the 68 property listed on multiple rental websites. Staff recommended that the Special Magistrate find the 69 property in violation, order the property owner to obtain a Town-issued rental permit within 14 70 days, on or before July 6, 2026 and assess a $250 administrative fee. Special Magistrate Berryman 71 inquired whether the property owner would need to just apply for a rental permit or actually obtain 72 the permit to achieve compliance. Mr. Hooker advised that the owner must submit a rental permit 73 application and complete the required rental inspection. He stated his belief that compliance could 74 be achieved by July 6, 2026. 75 76 Special Magistrate Berryman found the property to be in non-compliance; ordered a compliance 77 date on or before July 6, 2026, or be brought back for further adjudication at the July 27, 2026, 78 hearing; and assessed the $250 administrative fee. 79 80 B. Case # 2026-503 81 7-Eleven Inc 82 c/o Tax Department 34039 83 4618 South Atlantic Avenue 84 Alleged Violation: Florida Fire Prevention Codes 85 Code Magistrate Hearing Minutes June 22, 2026 Page 2 of 3 86 Mr. Hooker presented testimony and evidence of the alleged Florida Fire Prevention Code 87 violations. During the annual fire inspection conducted on March 26, 2026, Staff identified 88 multiple fire code violations and advised the on-site employee of the required corrective actions. 89 After several unsuccessful attempts to contact a local representative and the franchise owner, Staff 90 emailed the inspection report to the corporate office on March 31, 2026. A re-inspection confirmed 91 that the violations had not been corrected, and a Notice of Violation and Notice of Hearing was 92 issued. On May 13, 2026, the corporate office acknowledged receipt of the Notice and advised it 93 would be forwarded to the appropriate team; however, follow-up inspections on May 26, 2026, 94 and June 16, 2026, confirmed that the violations remained uncorrected. Mr. Hooker presented the 95 fire inspection report, photographs documenting the violations, email correspondence, the Notice 96 of Violation and Notice of Hearing, and proof of certified mailings. Based on the testimony and 97 evidence presented, Staff requested that the property be found in violation, be granted until July 6, 98 2026, to achieve compliance, and a $250 administrative fee be imposed. 99 100 Special Magistrate Berryman found the property to be in non-compliance; ordered a compliance 101 date on or before July 6, 2026, or be brought back for further adjudication at the July 27, 2026, 102 hearing; and assessed the $250 administrative fee. 103 104 6. Atlantic Ave. #2102 Alleged Violation: Rental Without Permit Property Owner(s): Colbert Consulting Inc. Trust c/o Donald Colbert Synopsis of Violation: On April 1, 2026, staff observed an online rental ad for the property located at 4535 S. Atlantic Avenue #2102. A permit check of the residence indicated that the property did not have a valid rental permit by the Town. After unsuccessful attempts to achieve compliance with the property owner, the case was heard by the Special Magistrate on June 22, 2026, who ordered a compliance date of July 6, 2026. As of July 17, 2026, a rental permit has not been applied for. Timeline of Events: April 1, 2026 – Staff observed an online advertisement for the property located at 4535 S. Atlantic Ave. The online advertisement referred to unit number 2102 in the title. Staff mailed a courtesy letter via first-class mail, advising that a rental permit is needed, and including a rental application form. The correspondence established a compliance deadline of April 14, 2026. April 24, 2026 – A formal notice of violation and notice of hearing was sent via certified mail, indicating a compliance date of May 8, 2026. April 29, 2026 - Certified mail was received and signed for. June 22, 2026- The case was presented to the Special Magistrate, who found the property to be in non-compliance. July 17, 2026 – No rental permit application has been submitted as of today’s date Recommendation: Staff recommends that the Special Magistrate reiterates the original order dated June 22, 2026. Additionally, staff recommends a daily fine of $100 per day be assessed until the property is brought into compliance. The one-time administrative fee of $250 has not been paid per the original order. TO: Chloe Berryman, Special Magistrate FROM: David Hooker, Code Compliance Manager DATE: July 7, 2026 DATE OF MEETING: July 27, 2026 Case Number: 2026-503 Address: 4618 South Atlantic Avenue Alleged Violation: Florida Fire Prevention Code Property Owner(s): 7-Eleven Inc. c/o Tax Department 34039 Synopsis of Violation: On March 26, 2026, staff conducted the required annual fire inspection of the business and noticed violations of the Florida Fire Prevention Code (NFPA 1). During the inspection, staff advised the employee representative of the observed violations, which included a blocked emergency exit and exterior electrical outlets that were missing the required weatherproof covers. Staff also advised that the corporate offices in Texas would be contacted regarding the outstanding deficiencies and that a re-inspection would be scheduled to verify compliance. Timeline of Events: March 26, 2026 – The annual fire inspection was performed. Staff obtained contact information from an employee for where to send the report. March 31, 2026 – Staff emailed the fire inspection report to 7-Eleven’s field consultant. No response was received from the corporation. 1 May 5, 2026 – A re-inspection of the property indicated no corrections had been made to address the blocked emergency exit and missing exterior covers for outlets, thus a formal notice of violation/notice of hearing issued May 11, 2026 – A certified letter was delivered to the store in Ponce Inlet. A certified receipt was returned to staff. May 12, 2026 – A certified letter was sent to the 7-Eleven corporate office in Dallas, Texas and a certified receipt was returned to staff. Staff also received an email from the corporate office with acknowledgement that the certified letter had been received and the notice of violation had been forwarded for a resolution. May 26, 2026 – A follow-up re-inspection was performed, noting there were no corrections to the violations. June 1, 2026 – An additional follow-up inspection was performed and the violations were not corrected. June 22, 2026 – The case was presented to Special Magistrate and the owners were found to be in violation of the cited sections of adopted codes. The Special Magistrate orders the property to be in compliance no later than July 6, 2026, and also imposed a $250 administrative fee. June 24, 2026 – The Special Magistrate order was sent to the 7-Eleven corporation in Texas and physical address of business. June 25, 2026 – A re-inspection of the property took place and corrections were still not made. Staff gave a business card to employee to have franchisee contact the Town. July 1, 2026 – Staff performed another re-inspection of the property and the violations remained. Staff spoke with an employee who stated that the franchisee would be in later that day. No contact was made by the franchisee. July 2, 2026 – Staff spoke with an employee with the 7-Eleven corporate office. She advised that they are in receipt of the Special Magistrates order and will again reach out to the area maintenance crew to get this issue resolved. July 6, 2026 - Staff spoke with franchisee owner and the Corporate Area Maintenance Supervisor regarding the outstanding fire code violations. An on-site re-inspection was conducted and staff verified that all previously cited violations had been corrected. The property was found to be in full compliance with the Florida Fire Prevention Code. Recommendation: It is recommended that this property be found in compliance with the order dated of June 22, 2026. TO: Chloe Berryman, Special Magistrate FROM: David Hooker, Code Compliance Manager DATE: July 7, 2026 DATE OF MEETING: July 27, 2026 Case Number: 2026-386 Address: 4329 South Atlantic Avenue Alleged Violation: Property maintenance issue involving lot or dwelling Property Owner(s): William Frazier Synopsis of Violation: In May 2026, staff received a complaint from a neighboring property owner advising that a portion of the subject property’s balcony had partially collapsed during Tropical Storm Nicole in November 2022 and remained in a state of disrepair. Following the storm, numerous local, state and federal agencies worked with affected property owners to stabilize damaged structures and protect costal properties. Temporary protective measures, including placement of trap bags, were utilized to help safeguard homes that were at immediate risk of additional damage. Since that time, the County’s beach renourishment project has been completed, shoreline conditions have stabilized, and repairs have been completed on other properties impacted by the storm. However, the damage to the balcony at the subject property has not been repaired and continues to remain in its damaged condition.. Timeline of Events: November 2022 – Hurricane Nicole made landfall on the east coast of Florida, causing significant damage to numerous coastal properties, including structures within the Town of Ponce Inlet. 1 May 4, 2026 – Staff received a complaint from the neighboring property owner advising that the subject property’s second story balcony on the oceanfront side, which had been damaged by Tropical Storm Nicole, had not been repaired. Staff conducted an inspection from the beach and confirmed that the balcony remained in a state of repair. A formal normal of violation was subsequently issued to the property owner June 22, 2026 – Staff spoke with the property owner and advised that a building permit would be required for either the repair or demolition of the damaged balcony. The owner indicated that he would begin contacting contractors to obtain proposals and move forward with the necessary work July 2, 2026 – A notice of violation and notice of hearing were posted at the subject property and at Town Hall. Later that day, Mr. Frazier stopped by Town Hall to give an update on his efforts to bring the property into compliance. Recommendation: Based on the testimony and evidence presented, staff respectfully recommends that the respondent to be found in violation of sections 102.2, 304.1, and 304.10 of the International Property Maintenance Code. Staff further recommends that the respondent be granted 14 days (on or before August 10, 2026) to obtain the required building permits for the repair or demolition of the damaged balcony. In addition, staff recommends that the $250 administrative fee be imposed in accordance with the Town’s adopted fee schedule. TO: Chloe Berryman, Special Magistrate FROM: Travis Mincey, Rental Housing Inspector DATE: July 7, 2026 DATE OF MEETING: July 27, 2026 Case Number: 2026-956 Address: 30 Calumet Ave Alleged Violation: Tankless water heater and gas lines installed without required permits. Property Owner(s): Kenneth & Evann Lee Synopsis of Violation: On June 10, 2026, staff observed two Total Comfort vehicles parked in the driveway of 30 Calumet Ave., along with a water heater placed at the garage door entrance. A review of the Town’s permitting records confirmed that no permits were issued for the property. Staff contacted a representative from Total Comfort, to address the matter. Total Comfort was informed that the installation work was conducted without the required permits from the Town. The contractor was advised to immediately submit a permit application to the Town for the installation of the tankless water heater and installed propane gas lines. Timeline of Events: • June 10, 2026 – While conducting a routine patrol of the Town, staff observed Total Comfort vehicles located in the driveway along with a water heater placed at the garage door entrance. Staff was made aware that a tankless gas water heater was Page 1 of 2 being installed. A permit check revealed no permit had been submitted for the water heater or gas plumbing. • June 18, 2026 – Staff contacted Total Comfort relaying the town has not received a submitted permit application for the installation of the water heater and installed gas lines. • June 25, 2026 – A Notice of Violation and Hearing was sent via Certified mail indicating a compliance date of July 6, 2026. • June 30, 2026 – application for a gas permit (818-2026) for the new gas lines being installed. Permit did not include the tankless portion of the work being performed. • July 17, 2026 – No application has been received for the tankless water heater Recommendation: Staff recommends that the property be found in non-compliance with Florida Building Code, section 105.1. Staff further recommends the property owner be granted 10 days (on or before Thursday August 6, 2026), to bring the property into compliance by applying and obtaining the required building permit. A one-time fee of $250 shall also be imposed per the Town’s fee schedule for administrative processing of the violation. Furthermore, if there is a failure to comply with the Order, this case is to be brought back for further adjudication at the next scheduled hearing date of August 25, 2026. Peninsula Dr Alleged Violation: Swimming pool renovation without required permit Property Owner(s): John & Cynthia Michaelis Synopsis of Violation: On June 12, 2026, staff observed a swimming pool being renovated at 4529 S. Peninsula Dr. A subsequent review of the Town’s permit records confirmed that no permits had been issued for the construction activities taking place. Staff contacted the property owner to address the matter. Mrs. Michaels was informed that the construction work was proceeding without the required permits from the Town. As a result, a Stop Work Order was issued and posted at the property. Mrs. Michaels was advised that all work was to immediately cease until a permit application had been submitted and approved prior to work being able to commence. Timeline of Events: • June 12, 2026 – While conducting a routine patrol of the Town, staff observed a dump trailer containing demolition materials located in the right of way at 4529 S. Page 1 of 2 Peninsula Dr. A permit check revealed no permit had been issued, resulting in a Stop Work order being placed on the property. • June 23, 2026 – A notice of violation / notice of hearing was sent via Certified mail, noting a compliance date of July 3, 2026. • June 27, 2026 – Certified mail received with the owner’s signature. • July 17, 2026 – To date no permit application has been received by the town. Recommendation: Staff recommends that the property be found in non-compliance with Florida Building Code, section 105.1. Staff further recommends the property owner be granted 10 days (on or before Thursday August 6, 2026), to bring the property into compliance by obtaining the required permit. Furthermore, a one-time fee of $250 shall also be imposed per the Town’s fee schedule for administrative processing of the violation. Upon failure to comply with the Order, this case is to be brought back for further adjudication at the next scheduled hearing date of August 25, 2026. TO: Chloe Berryman, Special Magistrate FROM: David Hooker, Code Compliance Manager DATE: July 7, 2026 DATE OF MEETING: July 27, 2026 Case Number: 2026-994 Address: 4790 Michael Lane Alleged Violation: High grass Property Owner(s): Andrea King Synopsis of Violation: In June 2026, staff observed that the subject property contained grass exceeding the maximum height permitted by the Town code. Staff attempted to contact the property owner regarding the violation; however those efforts were unsuccessful. Timeline of Events: June 15, 2026 – Staff observed that the subject property was in violation due to overgrown grass. An attempt was made to contact the property owner; however, staff was unsuccessful. June 18, 2026 – Staff made a second attempt to contact the property owner at the residence and attempted to reach the owner using the telephone number on file. The telephone number was found to be no longer in service. June 25, 2026 – Due to owner’s failure to respond and the continued existence of the violation, staff issued a formal notice of violation / notice of hearing. 1 July 2, 2026 – Staff verified that the violation remained. In accordance with Florida Statutes, staff posted the property and at Town Hall with the notice of violation/ notice of hearing to complete the required service of the notice. July 6, 2026 – A certified mail receipt has been returned to staff, with the owner’s signature. Recommendation: Staff recommends that the respondent be found in violation of the cited sections of the adopted Town Code. Staff further recommends that the respondent be granted ten (10) days, on or before August 6, 2026, to bring the property into compliance by cutting the overgrown grass. In addition, staff recommends that the $250 administrative fee be imposed in accordance with the Town's adopted fee schedule. Should the respondent fail to achieve compliance by the prescribed deadline, staff requests that this matter be scheduled for further proceedings before the Special Magistrate at the next scheduled hearing on August 24, 2026, for further adjudication. 2
