Planning Commission Meeting January 7, 2020 A meeting of the Planning Commission was held on Tuesday evening, January 7, 2020 at Village Justice Courtroom, 350 North Main Street, Port Chester, NY at 7:00 p.m. with Chairman Anthony Baxter Presiding Present in addition to Chairman Baxter were Commissioners: Coperine, Espinoza, Passarelli, Scarola, Summa and Robinson Also present was Village Attorney Anthony Cerreto, Planning Director Eric Zamft, Planner Evan Breining, Village Engineer Vincent Masucci and Assistant Planning Director Curt Lavalla. The meeting opened with a quorum at 7:00 p.m. _______________________________________ Constance R. Case #2018-0175 – Continued Public Hearing An application submitted by Daniel Mayet, AIA on behalf of Luis Lopez for property located at 7 Willow Street, Port Chester, NY known and designated as Section 141.38, Block 2, Lot 47 to consider a request to: Site Plan approval to convert existing space (formerly cabaret) into a new restaurant. On the motion of Commissioner Coperine, which was seconded by Commissioner Scarola, the Public Hearing was reopened. Mr. Cuddy began by saying that on previous appearances before the Commission Mr. Lopez was being represented by Mario DeMarco Esq. since that last meeting Mr. Gioffre is in the process of being retained by Mr. Lopez and getting copies of all the materials, information and memos that have been associated with this application. At this point Mr. Gioffre said he has not had the opportunity to review all of the materials and would like to do so before proceeding further. Mr. Gioffre asked that the matter be adjourned to the January 27, 2020 meeting No one from the public spoke for or against this application. On the motion of Commissioner Summa, which was seconded by Commissioner Robinson, the Public Hearing was adjourned to January 27, 2020. Case #2019-0195 – Continued Public Meeting An application submitted by Anthony B. Gioffre III, Esq. of Cuddy & Feder LLP on behalf of 30 Broad St. Owners LLC and 136-138 Irving Owners LLC for property located at 30 Broad Street & 136 Irving Avenue, known and designated as Section 142.22, Block 2, Lot(s) 2 & 3, to consider request for Site Plan approval to raze the two existing structures at the project location and construct a new nine-story mixed-use development containing a microbrewery/brewpub on the first and second floors, office spaces on the second through fifth floors, and a total of 20 residential units on the sixth floor through ninth floor penthouse. Anthony Gioffre Esq. of Cuddy & Feder represented the matter for the applicant. Also in support of the application was Pierre Sarrazin Architect of Sarrazin Neil Linsky Traffic Engineer, and Paul Berte’ Engineer for the project. Mr. Gioffre said since their last appearance before the Commission they have been pretty busy. They have appeared before the Traffic Commission, the Architectural Board of Review and the Zoning Board of Appeals. All of the Boards have granted the requisite approvals allowing them to continue with the project. This proposal seeks to redevelop the properties that are within the C5 Train Station Mixed Use Zoning District. District. It has three principal uses which are all allowed within the zone. No variance relief is need and no special exception is required. The brew pub will require some additional requirements as specified in the miscellaneous sections of the code. Mr. Gioffre said that some Village Memos had been issued which they have not had time to respond to in writing. However they do believe that all of the comments have been addressed with previous submissions. Mr. Sarrazin also provided the Commission with copies of the revised renderings. There were no outstanding issues that were identified at the last appearance before the Commission. A revised EAF has also been submitted to the Commission. Planning Director Eric Zamft said they have responded to all of Staff’s completeness questions and the question is whether the Commission is comfortable enough to bring this to a Public Hearing. In addition Mr. Sarrazin or Mr. Berte should address the construction and demolition safety aspects at the proposed site. This is supplemental information and not information needed for completeness of the application. Assistant Planning Director Curt Lavalla said he wanted to correct his staff report to say that a lighting plan has been received by staff. Staff also recommends trees be planted along the sidewalk or linear rain gardens, utilizing the Village’s Green Infrastructure Manual as guidance. Staff also recommends the Applicant explore installing a green roof, not only on the roof but also the under-utilized portion of the second-floor roof area. Applicant should address whether any exterior lighting is proposed, given the presence of the ground- floor outdoor seating area and the second-floor balcony/outdoor seating area. Case # 2019-0196 – New Public Meeting Notice is hereby given that the Planning Commission of the Village of Port Chester, New York will hold a PUBLIC MEETING on January 7, 2020 at 7:00 pm, at the Court Room, Police Headquarters Building, 350 North Main Street, Port Chester, New York to review an application submitted by Eliot Senor & Alex Zoldan on behalf of Congregation Kneses Tifereth Israel (KTI), 575 King Street Port Chester, NY known and designated as Section 136.46, Block 2, Lot(s) to consider request to: Subdivide an unused portion of the property into four building lots. Eliot Senor Engineer/Surveyor of Hartsdale represented this application. Mr. Senor said they have an unused piece of property on the KTI Synagogue property. The entire property is approximately ten acres. The applicant is proposing to subdivide the unused portion of the property into four lots. The affected portion of the property is on the corner of Quintard and King Streets and behind it is a private road Harve. The lots range in size from twelve thousand plus up to thirteen thousand plus square feet. 7500 square feet is the minimum lot size requirement. The lots are not quite two times the size of the minimum required size. Each property is seventy feet wide and the corner lot is seventy feet wide at the building setback line. Three of the houses will face King Street and the one on the corner of Quintard will face Quintard Street. Three driveway will come out to King Street and one to Quintard Street. Percolation tests were also performed at the site. (15-18 minutes per inch) Assistant Planning Director Curt Lavalla offered that the proposal has been reviewed by the necessary committees and led to a revised application which is being presented tonight. It was also suggested that the driveway to all the houses exit to King Street. The private street Harve is not eligible to be part of this application for driveway access. The property is nine point seven five acres and the remaining acreage of the parent parcel is eight point six acreage. This is an unlisted SEQRA action but the recommendation of the Village Attorney and Staff is to percolate for a coordinated review and wait thirty days to see if any of the other interested agencies have any objections. The Planning Commission as Lead Agency and the Board of Trustees as we approach the final plat phase. Also NY DOT because King Street is a state highway. There are some issues with drainage and stormwater management that should be addressed later in the project. Mr. Senor also passed around a sample picture of what the houses will look like once they are built. He also said that they are proposing to maintain all of their drainage on site. They are also willing to help in any way they can with controlling the traffic flow at the intersections. The Village Engineer Vincent Masucci was also concerned with flooding and drainage on the property as well. Planning Director Eric Zamft suggested while waiting for the thirty days to lapse, the Civil and Village Engineers, applicants and staff could perhaps meet and work out any items that need to be addressed ahead of next month’s meeting. Planning Commission Minutes Page 7 January 7, 2020 A discussion ensued and several issues arose as a result. One with regard to an alleged easement for Harve Road. This has to be worked out with applicants and residents because it is not a Village Road. In addition there were some questions regarding the noticing of the hearing and the distance to which the applicant sent notices. These items will also be addressed when the applicant and engineers and staff talk meet in a week or two. On the motion of Commissioner Scarola, which was seconded by Commissioner Robinson, the Planning Commission declared itself Lead Agency for SEQRA pertaining to this project.
