Resolution to Energize Highway Lighting 2. Resolution approving negative SEQR declaration on Local Law 2-2018 3. Resolution approving Local Law 2-2018 NEW BUSINESS/DISCUSSION: ADJOURNMENT RESOLUTION TO ENERGIZE HIGHWAY LIGHTING Resolution of the Board of Village of Port Dickinson agreeing to energize a highway lighting system on or along within the geographical jurisdiction of the Village of Port Dickinson, such highway identified in Project D263547 – Highway Where & When Contract 17/18 to Construct Repairs to State Highway Lighting along NYS Rte 7 at Phelps St. Interchange and Chenango St. Bridge, Village of Port Dickinson, County of Broome. WHEREAS, the State of New York Department of Transportation proposes to repair\reconstruct (as needed) highway lighting along NYS Rte 7 at Phelps St. Interchange (two lights) and Chenango St. Bridge (four lights) in Project D263547 by repairing and upgrading to LED, NYSDOT owned stick street lights with the project located in County of Broome and within the geographical jurisdiction of the MUNICIPALITY of Village of Port Dickinson, and WHEREAS, the Village of Port Dickinson approves of such project and desires to have a highway lighting system on such highway within its geographical jurisdiction, and WHEREAS, the State of New York has agreed to provide as a part of the project the following items (as needed) in connection with a street lighting system: 1. Underground duct system, including conduits, pull boxes, hand holes and drainage pockets (as needed). 2. Light Standards and appurtenances (as needed). 3. Luminaires, wiring, switches and ballasts and all other components necessary to complete the lighting system (as needed). 4. Replace HPS luminaires with LED luminaires. 5. Circuit for LED lighting will be metered. 5. Turn over a quality lighting system to the MUNICIPALITY for energizing costs at the completion of D263547 with New York State Department of Transportation Region 9 agreeing to perform maintenance of said lighting system, per section 10, part 23 of the NYS Highway Law for a period extending 10 years from the completion date, and WHEREAS, the Village of Port Dickinson agrees to energize (furnish electric) to such highway lighting system for a period of 10 years or until such time as the COMMISSIONER, in his\her discretion, determines that such lighting and/or the maintenance of such lighting system is no longer necessary for such State Highway/Arterial/Interstate. NOW THEREFORE, the Village of Port Dickinson Board, duly convened, does hereby RESOLVE, the Village of Port Dickinson approves of the above subject project; and it is hereby further RESOLVED, that the Village of Port Dickinson shall energize (furnish electric) to such highway lighting system, and it is hereby further RESOLVED, that the Village of Port Dickinson hereby authorizes the Mayor of the Village of Port Dickinson to enter into and execute an Agreement with the State of New York and through the Commissioner of Transportation to commit the Village of Port Dickinson to energize, at its own expense, the lighting system on the above identified project, such agreement to provide energy shall include furnishing of electric current for the lighting system, and BE IT FURTHER RESOLVED, that the Clerk of this Village of Port Dickinson is hereby directed to transmit five (5) certified copies of the foregoing resolution to the State Department of Transportation, 44 Hawley Street, Binghamton, New York 13901-3200, Attention Regional Utility Engineer. RESOLUTION APPROVING LOCAL LAW NO. 2-2018 WHEREAS, a resolution was duly adopted by the Board of Trustees of the Village of Port Dickinson for a public hearing to be held by the Village Board at Port Dickinson Village Hall, 786 Chenango Street in said Village, at 6:00 p.m. on the 12th day of June, 2018 to hear all interested parties on a proposed local law entitled “A Local Law Amending Chapter 62 of the Village Code entitled ‘Water’”; and WHEREAS, notice of said public hearing was duly advertised in the Press & Sun-Bulletin, the official newspaper of the Village, and posted on the Village Clerk’s signboard; and WHEREAS, said public hearing was duly held at Port Dickinson Village Hall at 6:00 p.m. on June 12, 2018, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof; and WHEREAS, pursuant to Part 617 of the implementing regulations of the State Environmental Quality Review Act, it has been determined by the Village Board that adoption of the proposed Local Law constitutes an Unlisted Action as defined under said regulations. The Village Board has considered the possible environmental impacts of the Local Law. The adoption of said Local Law will not have a significant adverse impact on the environment and the Village Board adopts a negative declaration with respect to the Local Law; and WHEREAS, the Village Board, after due deliberation, finds it in the best interest of the Village to adopt said local law. NOW, THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Port Dickinson hereby adopts said local law as Local Law No. 2-2018 entitled “A Local Law Amending Chapter 62 of the Village Code entitled ‘Water’” a copy of which is attached hereto and made a part hereof; and RESOLVED that the Village Clerk be and hereby is directed to enter said Local Law in the minutes of this meeting and to enter said Local Law in the Local Law Book of the Village of Port Dickinson, and to give due notice of the adoption of said Local Law to the Secretary of State; and RESOLVED that this resolution will take effect immediately. CERTIFICATION I, Susan E. Fox, do hereby certify that I am the Village Clerk of the Village of Port Dickinson and that the foregoing constitutes a true, correct and complete copy of a resolution duly adopted by the Village Board of the Village of Port Dickinson at a meeting thereof held at Port Dickinson Village Hall, 786 Chenango Street, Binghamton, New York on June 12, 2018.
