CALL TO ORDER PUBLIC HEARING: LOCAL LAW NO. 1-2020, A LOCAL LAW AMENDING CHAPTER 60 “VEHICLES AND TRAFFIC” VILLAGE OF PORT DICKINSON LOCAL LAW NO. 1 FOR THE YEAR 2020 A LOCAL LAW AMENDING CHAPTER 60 ENTITLED “VEHICLES AND TRAFFIC” SECTION 1. Chapter 60 of the Village Code shall hereby be amended as follows: § 60-15. Seasonal parking restriction. Section 60-15(7) shall be amended by adding the following: c. Grant Street at Chenango Street on both sides of that street on which there will be no parking 30 feet west of the curb line. § 60-24. Penalties for offenses. Section 60-24.A. shall hereby be amended as follows, with the underlined portion indicating new language: A. “(i) Unless otherwise indicated herein, for a violation of any of the provisions of Article IV (Parking, Standing and Stopping), the initial fine for violations of that article shall be a fine of Twenty-five Dollars ($25.00); however, each violator may, within seven business days, exclusive of the date on which the ticket was issued, or of the time when such notice was attached to such vehicle, pay to the Town Court of the Town of Dickinson as and for a penalty and in full satisfaction of such violation, the sum of Ten Dollars ($10.00). If a plea of not guilty has not been filed nor the fine paid within 30 calendar days from the date on which the ticket was issued or of the time when such notice was attached to such vehicle, the fine shall be Fifty Dollars ($50.00). (ii) Violations of Section 60-14 (Seasonal Parking Restrictions) shall be punishable by a fine of twenty- dollars ($20.00); however, each violator may, within seven business days, exclusive of the date on which the ticket was issued, or of the time when such notice was attached to such vehicle, pay to the Town Court of the Town of Dickinson as and for a penalty and in full satisfaction of such violation, the sum of Ten Dollars ($10.00). If a plea of not guilty has not been filed nor the fine paid within 30 calendar days from the date on which the ticket was issued or of the time when such notice was attached to such vehicle, the fine shall be forty dollars ($40.00).” [The remainder of this section remains the same.]  2 § 60-37. Schedule X: No Parking at Any Time. Section 60-37. shall be amended by adding the following: Grant Street North From the westerly curb line of Chenango Street to a point 30 feet west of said curb line SECTION 2. Remainder Except as hereinabove amended, the remainder of the Code of the Village of Port Dickinson shall remain in full force and effect. SECTION 3. Separability The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and as if such person or circumstance, to which the local law or part thereof is held inapplicable, had been specifically exempt therefrom. SECTION 4. Effective Date This Local Law shall take effect immediately upon filing with the New York State Secretary of State in accordance with Section 27 of the Municipal Home Rule Law. Abstract of Unaudited vouchers for the Capital Project Fund for $ COMMUNICATIONS: TRUSTEE-COMMISSIONER REPORTS: Administration/Community Association – Charles Harding, Trustee Public Works – Michael Cashman, Trustee Planning – meeting 1/14/20, 7:00PM Public Safety – James DeGennaro, Trustee  3 Parks, Water & Sewer – Robert Aagre, Trustee 1. We have been able to tweak the water system a bit, to reduce the Binghamton water share down to about 11% of total usage, with the less expensive Fenton water providing 89%. Our goal over time is to increase Fenton's share to about 95%. 2. The Broome County Health Department, acting on behalf of New York State, declared Port Dickinson's water systems to be in substantial compliance on all critical points of testing and management practices. Thank you to Joel Troutman and Josh Marris for their efforts in achieving these results. And, a thank you to the Fenton and Binghamton Water Departments for providing us with some good quality water. 3. The Village is seeking a NYS Urban Forestry Council Grant of $1,000 to purchase a mix of 24 trees, in our on- going tree planting program. This will help us take the next step toward our goal of having the Village certified as a Tree City USA community. Zoning Board of Appeals – none OLD BUSINESS: 1. Water shutoff procedure 2. Street light replacement RESOLUTIONS FOR APPROVAL: 1. Resolution authorizing the Mayor to sign an agreement with Sentry Alarms for pump station monitoring for $173.75/month for all 5 stations and a one-time installation charge of $525.00 2. Resolution authorizing the Mayor to sign the STOP DWI Overtime Patrol contract renewal with Broome County for $500, CA-1512-1F 3. Resolution authorizing Robert Aagre, as Trustee of the Village of Port Dickinson, or such person’s successor, is hereby authorized and directed to file an application for an Urban Forestry Council Quick Start Grant in an amount not to exceed $1,000 and upon approval of said request to enter into and execute a project agreement with the New York State Urban Forestry Council for such financial assistance to the Village of Port Dickinson for the 2020 Tree Project. 4. Resolution adopting SEQR determination for Local Law 1-2020, A LOCAL LAW AMENDING CHAPTER 60 “VEHICLES AND TRAFFIC 5. VILLAGE OF PORT DICKINSON RESOLUTION APPROVING LOCAL LAW NO. 1-2020, A LOCAL LAW AMENDING CHAPTER 60 “VEHICLES AND TRAFFIC At a regular meeting of the Village Board of the Village of Port Dickinson, held at Village Hall, 786 Chenango Street in said Village on the 14th day of January, 2020, the following resolution was offered and seconded: WHEREAS, the Village of Port Dickinson scheduled a public hearing for January 14, 2020 at 6:00 p.m. for Local Law No. 1 of the year 2020 entitled “A Local Law Amending Chapter 60 entitled ‘Vehicles and Traffic’”; and WHEREAS, notice of said public hearing was duly advertised in the Press & Sun-Bulletin, the official newspaper of the Village, and posted on the Village Clerk’s signboard; and WHEREAS, said public hearing was duly held at Village Hall, 786 Chenango Street in the Village at 6:00 p.m. on January 14, 2020, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof; and  4 WHEREAS, pursuant to the State Environmental Quality Review Act (“SEQRA”), it has been determined by the Village Board that adoption of the proposed Local Law constitutes a Type II Action as defined under 6 NYCRR 617.5(22) and (33); and WHEREAS, the Village Board, after due deliberation, finds it in the best interest of the Village to adopt said local law. NOW, THEREFORE, BE IT RESOLVED that the Village Board of the Village of Port Dickinson hereby adopts said local law as Local Law No. 1-2020 entitled “A Local Law Amending Chapter 60 entitled ‘Vehicles and Traffic’” a copy of which is attached hereto and made a part hereof; and it is further RESOLVED that the Village Clerk be and hereby is directed to enter said Local Law in the minutes of this meeting and to enter said Local Law in the Local Law Book of the Village of Port Dickinson, and to give due notice of the adoption of said Local Law to the Secretary of State; and it is further RESOLVED that this resolution will take effect immediately upon filing with the Department of State.
