WITNESSETH WHEREAS, Fire Protection District No. 3 has been duly designated within said Town of Dickinson embracing territory in the easterly portion of said Town adjacent to the Village of Port Dickinson and the City of Binghamton, New York, as such district boundaries are more fully described in the resolution establishing such District and duly adopted by the Town Board of the Town of Dickinson on July 2, 1962, and WHEREAS, following a public hearing duly called, the said Town Board of the Town of Dickinson, acting on behalf of Fire Protection District No. 3, has duly authorized a contract and agreed to enter into same with the Village to provide fire protection to said District upon the terms and provisions herein set forth, and WHEREAS, this contract has been duly authorized and approved by the Executive Committee of the Port Dickinson Fire Company, Inc. and the Board of Trustees of the Village of Port Dickinson. NOW, THEREFORE, the Town does hereby contract with the Village to furnish fire protection to said District and the Village agrees to furnish such protection in the manner following, to-wit: 1. The Village’s fire department shall at all times during the period of this agreement be subject to call for attendance upon any fire occurring in such district, and when notified by alarm or telephone call from any person within the District of a fire within the District, such Department shall respond and attend upon the fire without delay with one or more companies and with suitable ladder, pumping and hose apparatus of the Village. Upon arriving at the scene of the fire, the firemen of the Village attending shall proceed diligently and in every way reasonably suggested for the extinguishment of the fire and the saving of life and property in connection therewith. 2. In consideration of furnishing aid and the use of its apparatus aforesaid, the Village shall receive the sum of $32,800 payable by the Town to the Village on or before March 1, 2023, the sum of $33,450 payable by the Town to the Village on or before March 1, 2024, and the sum of $34,150 payable by the Town to the Village on or before March 1, 2025. 3. Such funds to be paid under any provision of this agreement shall be a charge upon the said Fire Protection District and be assessed and levied upon the taxable property in said District and collected with the Town taxes therefrom. 4. The consideration herein provided by the Village shall include the use of all apparatus, equipment, materials, supplies and labor necessary in the performance by the Village of its obligations under this contract, and the Village shall, during the whole period covered by this contract, at its own expense, provide a policy of insurance to cover loss or damage to its apparatus and equipment to the full value thereof, which policy shall be so written that by its terms, it shall protect the Town of Dickinson and Fire Protection District No. 3 of the Town of Dickinson, as extended, from any liability for such loss or damage to apparatus or equipment. Such policy may, however, contain a clause making deductible therefrom an amount not exceeding Two Hundred Fifty Dollars ($250.00). The Village shall furnish to the Supervisor of the Town of Dickinson a certificate of an insurance company authorized to do business in the State of New York showing the coverage herein provided. 5. The Village shall, during the whole period of this contract at its own expense, procure and maintain policies of insurance for Comprehensive General Liability and Automobile Liability Insurance, written by companies authorized to do business in the State of New York, and so arranged to protect the Village against liability for negligent acts arising from activities that are encompassed by this agreement. Such policies shall be written in the amount of One Million Dollars ($1,000,000.00) for bodily injury and property damage combined for any one occurrence. The Village shall furnish the Supervisor of the Town of Dickinson a certificate showing coverage as herein provided. 6. The Village shall indemnify and hold harmless the Town, its successors and assigns any and all damage, liabilities or claims of any nature, absolute or contingent, together with all expenses and legal fees which may be incurred to compromise, or defend such liabilities or claims arising out of or resulting from activities which are encompassed by this agreement. 7. This agreement and all clauses herein contained shall become effective on January 1, 2023 and shall continue for a period of three years until December 31, 2025. NOW, THEREFORE, BE IT RESOLVED that the Village Board of the Village of Port Dickinson hereby adopts said local law as Local Law No. 11 of 2022 entitled “A LOCAL LAW AMENDING CHAPTER 34 OF THE VILLAGE CODE ENTITLED ‘FIRE PREVENTION’ TO ADD RECREATIONAL BURNING” a copy of which is attached hereto and made a part hereof; and it is further RESOLVED that the Village Clerk be and hereby is directed to enter said Local Law in the minutes of this meeting and to enter said Local Law in the Local Law Book of the Village of Port Dickinson, and to give due notice of the adoption of said Local Law to the Secretary of State; and it is further RESOLVED that this resolution will take effect immediately upon filing with the Department of State.  VILLAGE OF PORT DICKINSON LOCAL LAW NO. 11 OF 2022 A LOCAL LAW AMENDING CHAPTER 34 OF THE VILLAGE CODE ENTITLED “FIRE PREVENTION” TO ADD RECREATIONAL BURNING Be it enacted by the Board of Trustees of the Village of Port Dickinson as follows: Section 1. Section 34-6 of the Village Code shall be amended as follows: § 34-6. Recreational Burning It is the intent of this section to protect the general health, welfare and safety of the people of the Village of Port Dickinson by prohibiting open fires, which are dangerous to life and property. A. Definitions. As used in this section, the following terms shall have the meanings indicated: Garbage. The animal and vegetable waste resulting from the handling, preparation, cooking and serving of food. Nuisance. Any action that causes an unreasonable interference with the use and enjoyment of a neighbor’s property. Open Fire. Any outdoor fire or outdoor smoke-producing process from which air contaminants are emitted directly into the outdoor atmosphere. Refuse. All waste material, including but not limited to garbage, rubbish, incinerator residue, street sweepings, dead animals and offal. Rubbish. Solid or liquid waste material, including but not limited to paper and paper products; rags; trees or leaves, needles and branches therefrom; vines; lawn and garden debris; furniture; cans; crockery; plastic; cartons; chemicals; paint; grease; sludge; oils and other petroleum products; lumber; sawdust; demolition materials; tires; and automobiles and other vehicles and parts for junk, salvage or disposal. B. Prohibited burning. The following fires are prohibited in Port Dickinson: (1) The burning of garbage, refuse and rubbish in any manner is prohibited. (2) All open fires are prohibited in Port Dickinson, with the exception of those in conformity with the provisions of § 34-6(C) of this chapter. (3) Open burning for outdoor cooking is prohibited in or on multiple-dwelling structures. C. Permitted burning. Burning in an open fire, provided that it is not contrary to any other federal, state, county or local law, ordinance, rule or regulation, will be permitted as follows:  (1) Bonfires. Bonfires shall be permitted only for a publicly-sponsored celebration or event, or for an organization-sponsored event, or for a public or private school-sponsored event, and shall be subject to meeting all requirements of the bonfire permit application obtained from and filed with the Fire Chief’s office, prior to any bonfire being lit and taking place. No fire shall be ignited prior to an on-site inspection of the location where the bonfire is to take place and shall be subject to any and all conditions or restrictions the Fire Chief may impose for the safety of life and property, nor shall any fire be ignited prior to the issuance of a bonfire permit issued by the Fire Chief's office. The Fire Department shall be notified prior to igniting any said bonfire permitted by the Fire Chief’s office. (2) Outdoor cooking. Open burning will be permitted for outdoor cooking when the fire is limited to the minimal size necessary and contained in a device or cooking utensil commonly referred to as a "grill" or "hibachi" and designed for outdoor cooking purposes. All applicable and/or reasonable safety precautions shall be taken when using said devices or utensils. (3) Recreational fires or campfires. Small recreational fires or campfires shall be permitted only when all of the following are adhered to: (a) When the fire is contained to a device designed to hold a small fire, such as an outdoor fireplace, or commercially manufactured steel or ceramic portable fireplace, and used according to the manufacturer's directions. (b) Said fire is solely for a recreational purpose. (c) Said fire is placed no closer than 25 feet to any structure. (d) Said fire is properly attended and controlled at all times by a responsible party with appropriate fire extinguishing equipment readily available. (e) Said fire shall not present a safety hazard to life or property, nor create a nuisance. D. Control of fires within the Village. If, in the opinion of the Fire Chief, weather conditions are such that the starting or the continuation of burning is a risk to life, health or property within the Village, he or she shall have the right to declare that any and all burning shall cease immediately until further notice. E. Enforcement. The Fire Chief and such firefighting personnel as he or she shall designate, the Police Department’s officers, and the Code Enforcement Officer are hereby vested with authority to enforce the provisions of this section. The Fire Department is hereby authorized to extinguish any open burning fire being conducted in violation of any of the provisions of this section. F. Penalties for offenses. (1) Any violation by a person, firm or corporation of any provision of this section shall be deemed a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or both.  (2) Any person who takes part in or assists in any violation of this section shall also be subject to the penalties provided herein. (3) Each day (twenty-four-hour period) that a violation of this section is committed or permitted to exist shall be deemed to constitute a distinct and separate violation. Section 2. The existing Section 34-6 of the Village Code entitled “Penalties for offenses” shall be renumbered to § 34-7. Section 3. Separability The provisions of this local law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and as if such person or circumstance, to which the local law or part thereof is held inapplicable, had been specifically exempt therefrom. Section 4. Repealer All Ordinances, Local Laws and parts thereof inconsistent with the Local Law are hereby repealed. Section 5. Effective Date This local law shall take effect upon filing with the New York Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.  VILLAGE OF PORT DICKINSON RESOLUTION APPROVING LOCAL LAW NO. 12-2022 At a meeting of the Village Board of the Village of Port Dickinson, held at Village Hall, 786 Chenango Street in said Village on the 15th day of November, 2022, the following resolution was offered and seconded: WHEREAS, notice was given that the Village Board will hold a public hearing on November 15, 2022 at 6:02 p.m. for Local Law No. 12 of the year 2022 entitled “A LOCAL LAW AMENDING CHAPTER 65 OF THE VILLAGE CODE REGARDING CANNABIS RELATED BUSINESSES”; and WHEREAS, notice of said public hearing was duly advertised in the official newspaper of the Village, and posted on the Village Clerk’s signboard; and WHEREAS, said public hearing was duly held November 15, 2022 at 6:02 p.m. and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof; and WHEREAS, pursuant to Part 617 of the implementing regulations of the State Environmental Quality Review Act, it is determined by the Village Board that adoption of the proposed Local Law constitutes Unlisted Action, as defined under said regulations. The Village Board has considered the possible environmental impacts of the Local Law. The adoption of said Local Law will not have a significant adverse impact on the environment and the Village Board adopts a negative declaration with respect to the Local Law; and WHEREAS, the Village Board, after due deliberation, finds it in the best interest of the Village to adopt said local law. NOW, THEREFORE, BE IT RESOLVED that the Village Board of the Village of Port Dickinson hereby adopts said local law as Local Law No. 12 of 2022 entitled “A LOCAL LAW AMENDING CHAPTER 65 OF THE VILLAGE CODE REGARDING CANNABIS RELATED BUSINESSES” a copy of which is attached hereto and made a part hereof; and it is further RESOLVED that the Village Clerk be and hereby is directed to enter said Local Law in the minutes of this meeting and to enter said Local Law in the Local Law Book of the Village of Port Dickinson, and to give due notice of the adoption of said Local Law to the Secretary of State; and it is further RESOLVED that this resolution will take effect immediately upon filing with the Department of State.  VILLAGE OF PORT DICKINSON LOCAL LAW NO. 12 FOR THE YEAR 2022 A LOCAL LAW AMENDING CHAPTER 65 OF THE VILLAGE CODE REGARDING CANNABIS RELATED BUSINESSES Be it enacted by the Village Board of the Village of Port Dickinson as follows: Section 1. Legislative Intent It is the intent of this local law to specify those areas within the Village of Port Dickinson that are appropriate for the establishment cannabis related businesses, and make such uses subject to special permit and site plan review. Section 2. Authority This local law is adopted pursuant to the New York State Municipal Home Rule Law, Section 131 of the New York State Cannabis Law, and all other relevant provisions of the New York State Constitution and New York State Village Law. Section 3. Definitions The following definitions are hereby added to Section 65-3 of the Village Code: CANNABIS BUSINESS, INDUSTRIAL – A cannabis related business licensed by the New York State Office of Cannabis Management or other duly authorized state or federal agency, to operate one of the following business types: Adult-use Cultivator, Adult-use Nursery, Adult-use Processor, Adult-use Distributor, Adult-use Cooperative, or Adult-use Microbusiness. CANNABIS BUSINESS, ON-SITE CONSUMPTION – A cannabis related business licensed by the New York State Office of Cannabis Management or other duly authorized state or federal agency, to operate an Adult-use On-Site Consumption business. An on-site consumption license authorizes the acquisition, possession and sale of cannabis from the licensed premises of the on-site consumption licensee to cannabis consumers for use at the on-site consumption location. CANNABIS BUSINESS, RETAIL – A cannabis related business licensed by the New York State Office of Cannabis Management or other duly authorized state or federal agency, to operate one of the following business types: Adult-use Retail Dispensary or Adult-use Delivery. Section 4. A new Section 65-28.1 entitled “Cannabis Businesses” shall be added to the Village Code as follows: § 65-28.1. Cannabis Businesses. A. Cannabis Business, On-Site Consumption and Cannabis Business, Retail, may be permitted in Commercial (C) and Commercial/Industrial (C/I) districts, provided the location shall be such as to offer reasonable protection to nearby properties against possible detrimental effects, taking into consideration the physical relationship to surrounding properties, and access to the site over any nearby residential streets. B. Cannabis Business, Industrial may be permitted in the Commercial/Industrial (C/I) districts, provided the location shall be such as to offer reasonable protection to nearby properties against possible detrimental effects, taking into consideration the physical relationship to surrounding properties, and access to the site over any nearby residential streets. Section 5. The Schedule of Zoning Regulations, Attachment II, C Commercial and I Industrial Districts is hereby amended as set forth below. Column 2: “Permitted Uses, Principal, Commercial Districts,” shall be amended by adding the following: 5. Cannabis Business, On-site Consumption and Cannabis Business, Retail, by special permit. Column 2: “Permitted Uses, Principal, Industrial Districts,” shall be amended by adding the following: 4. Cannabis Business, On-site Consumption, Cannabis Business, Retail and Cannabis Business, Industrial, by special permit. Section 6. Remainder Except as hereinabove amended, the remainder of the Code of the Village of Port Dickinson shall remain in full force and effect. Section 7. Separability The provisions of this local law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and as if such person or circumstance, to which the local law or part thereof is held inapplicable, had been specifically exempt therefrom Section 8.
