Over the next month we will be working with the dealer and training on them to get them in service.  2 We had the building fire at 726 1/2 Chenango Street earlier in the month. Although I estimated about $50k in fire damage, we were able to keep the fire in the kitchen, saving part of the apartment, the rest of the building, and the neighbor’s house about 6-8 feet away. RESOLUTION APPROVING LOCAL LAW NO. 1-2024 At a meeting of the Village Board of the Village of Port Dickinson, held at Village Hall, 786 Chenango Street in said Village on the 12th day of March, 2024, the following resolution was offered and seconded: WHEREAS, notice was given that the Village Board will hold a public hearing on March 12, 2024 at 6:00 p.m. for Local Law No. 1 of the year 2024 entitled “A LOCAL LAW AMENDING CHAPTER 60 OF THE VILLAGE CODE ENTITLED ‘VEHICLES AND TRAFFIC’”; and WHEREAS, notice of said public hearing was duly advertised in the official newspaper of the Village, and posted on the Village Clerk’s signboard; and WHEREAS, said public hearing was duly held on the 12th day of March, 2024 at 6:00 p.m. and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof; and WHEREAS, pursuant to the State Environmental Quality Review Act (“SEQRA”), it has been determined by the Village Board that adoption of the proposed Local Law constitutes a Type II Action as defined under 6 NYCRR 617.5(22) and (33); and WHEREAS, the Village Board, after due deliberation, finds it in the best interest of the Village to adopt said local law. NOW, THEREFORE, BE IT RESOLVED that the Village Board of the Village of Port Dickinson hereby adopts said local law as Local Law No. 1 of 2024 entitled “A LOCAL LAW AMENDING CHAPTER 60 OF THE VILLAGE CODE ENTITLED ‘VEHICLES AND TRAFFIC’” a copy of which is attached hereto and made a part hereof; and it is further RESOLVED that the Village Clerk be and hereby is directed to enter said Local Law in the minutes of this meeting and to enter said Local Law in the Local Law Book of the Village of Port Dickinson, and to give due notice of the adoption of said Local Law to the Secretary of State; and it is further RESOLVED that this resolution will take effect immediately upon filing with the Department of State. 2. NEW BUSINESS/DISCUSSION: ADJOURNMENT  5 VILLAGE OF PORT DICKINSON LOCAL LAW NO. __1_ OF 2024 A LOCAL LAW AMENDING CHAPTER 60 OF THE VILLAGE CODE ENTITLED “VEHICLES AND TRAFFIC” Be it enacted by the Board of Trustees of the Village of Port Dickinson as follows: Section 1. Section 60-37 of the Village Code entitled “Schedule X: No Parking at Any Time” shall be amended as follows: Delete: Name of Street Side Location All Village Streets Both In areas between sidewalks and blacktop of street Replace with: Name of Street Side Location All Village Streets Both Over curb or on any grass areas along streets Section 2. Section 60-38 of the Village Code entitled “Schedule XI: Standing Prohibited” shall be amended as follows: Delete: Name of Street Side Location Beacon Street Both From the south side of Kirkwood Avenue North to Chenango Street Replace with: Name of Street Side Location Beacon Street Both From the east side of Kirkwood Avenue North to Chenango Street Section 3. Separability The provisions of this local law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and as if such person or circumstance, to which the local law or part thereof is held inapplicable, had been specifically exempt therefrom. Section 4. Repealer All Ordinances, Local Laws and parts thereof inconsistent with the Local Law are hereby repealed.  6 Section 5. Effective Date This local law shall take effect upon filing with the New York Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.  7 VILLAGE OF PORT DICKINSON LOCAL LAW NO. _2__ OF 2024 A LOCAL LAW AMENDING CHAPTER 62 OF THE VILLAGE CODE ENTITLED “WATER” Be it enacted by the Board of Trustees of the Village of Port Dickinson as follows: Section 1. Section 62-5A of the Village Code entitled “Water meters” shall be amended as follows: A. All water service shall be metered, and no more than one (1) meter may be installed on any one (1) service. Section 2. Section 62-7A of the Village Code entitled “Unmetered use” shall be amended as follows: A. Use of water directly from a hydrant in the construction of any building before the installation of a meter is not permitted. Contractors and other persons must supply their own water source. Section 2. Separability The provisions of this local law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances. Effective Date This local law shall take effect upon filing with the New York Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.  8 VILLAGE OF PORT DICKINSON LOCAL LAW NO. _3__ OF 2024 A LOCAL LAW AMENDING CHAPTER 65 OF THE VILLAGE CODE ENTITLED “ZONING” REGARDING FEES Be it enacted by the Board of Trustees of the Village of Port Dickinson as follows: Section 1. Section 65-36 of the Village Code entitled “Permit fees” shall be amended as follows: A fee may be charged on all applications or appeals for building permits, use and area variance applications, special permits, and site plans. The amount of such fee shall be set by resolution of the Village Board. Section 2. Section 65-41 of the Village Code entitled “Fees for special permits and variances” shall be re- titled and amended as follows: 65-41 This section reserved for future use. Section 3. Separability The provisions of this local law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and as if such person or circumstance, to which the local law or part thereof is held inapplicable, had been specifically exempt therefrom. Effective Date This local law shall take effect upon filing with the New York Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.  9 VILLAGE OF PORT DICKINSON LOCAL LAW NO. _4__ OF 2024 A LOCAL LAW AMENDING THE VILLAGE CODE TO SET FEES BY RESOLUTION Be it enacted by the Board of Trustees of the Village of Port Dickinson as follows: Section 1. Section 7-1 of the Village Code entitled “Authority” shall be amended as follows: The Village Clerk, as custodian and in charge of the records and files of the Village, be and hereby is authorized upon receipt in advance of a fee to search such records and files and issue certificates attesting to the payment or lack of payment of Village taxes. The amount of such fee shall be set by resolution of the Village Board. Section 2. Section 34-5(D) of the Village Code entitled “Fireworks” shall be amended as follows: D. The Fire Marshal upon receipt of such application shall cause to be made an inspection of the premises named in the application as the place where it is proposed to give the public display of fireworks. If, in the judgment of the Fire Marshal, it would not be hazardous to surrounding property or dangerous to persons to permit such public display of fireworks at such location, he or she shall approve and return such application to the Village Clerk. Such application is then approved and the Village Clerk shall issue a permit in writing to the applicant upon the payment of the permit fee and submission of evidence of insurance coverage required herein. The amount of such fee shall be set by resolution of the Village Board. Section 3. Section 45-3.2.3 of the Village Code entitled “Avoidable alarm charges” shall be amended as follows: (a) Each alarm user shall pay to the Village a charge for each and every avoidable alarm to which the Village responds, in each calendar year, as follows: First two (2) avoidable alarms each calendar year No charge Third and each additional avoidable alarm Fee as set forth by resolution per calendar year of the Village Board Section 4. Section 52-3 of the Village Code entitled “Fees” shall be amended as follows: Each applicant must pay a permit fee to the Village Clerk for each excavation, except those for utility poles. Such fee shall be set forth by resolution of the Village Board. Section 5. Section 52-11(D) of the Village Code entitled “Sidewalk maintenance; violations” shall be amended as follows:  10 In the case of snow and ice, no such sixty-day notice is required and if, within twenty-four (24) hours after the cessation of every fall of snow or the formation of any ice, the owner or occupant of any premises shall fail to clear such sidewalk of snow and ice, he shall be in violation of this section unless such time period be extended by the Code Enforcement Officer of the Village by reason of the fact that such ice is too thick to be removed within such twenty-four (24) hour period, in which event such ice must be removed within such reasonable time as determined by the Code Enforcement Officer. In addition, the Village may clear such sidewalks of snow and ice if they are not cleared by the owner or occupant within the said twenty-four (24) hours and assess the cost thereof against the owner of the adjacent property to defray the cost of the Village Code Enforcement Officer in determining which premises are in violation of this section and the time of the Village Clerk or Treasurer in determining the name of the owner of the property adjacent to said sidewalk. Such cost shall be set forth by resolution of the Village Board, and if not paid, shall be assessable against the property as a tax thereon. Notice of said cost being assessed on the property owner shall be served by certified or registered mail. Such property owner may appeal the assessment of such cost to the Village Clerk within 15 days of the date of mailing. The Village Clerk may overturn such assessment if the Village Clerk determines that good cause was shown by the property owner for failure to clear such snow and ice. If in judgment of the Commissioner of Public Works the employees of the Department of Public Works, by reason of their work schedule, will be unable to attend to such clearing activities within twenty-four (24) hours of receipt of said order, then the Enforcement Officer may direct a private contractor previously approved by the Board of Trustees to perform such services at the pay schedule previously approved. In such event, the costs of such private contractor shall be assessed on the property owner in the same manner as the costs for the Village to clear such snow and ice. Section 6. Section 54-8 of the Village Code entitled “Fees” shall be amended as follows: Each application for a permit to construct or install a swimming pool or enlarge an existing pool shall be accompanied by a fee. Such fee shall be set by resolution of the Village Board. Section 7. Section 59-5(A) of the Village Code entitled “Restoration permits” shall be amended as follows: A. Upon written application and the deposit of a fee, the Village Enforcement Officer may, in their discretion, issue a permit for the open storage of one (l) motor vehicle otherwise prohibited by this chapter, pending the making of such repairs as are necessary to place this vehicle in condition for legal operation for use on the public highway or for such use as it was originally intended. Such fee shall be set by resolution of the Village Board. Section 8. Section 60-36(C)(3)(a) of the Village Code entitled “Fees” shall be amended as follows: a. A fee shall apply to all permits issued under §60-36. Said fee shall be set by resolution of the Village Board. Section 9. Section 65-55A(C) of the Village Code entitled “Special Registration Use Permit” shall be amended as follows:  11 C. Upon the issuance of such special registration use permit, a fee shall be paid by the licensee to defray the administrative costs thereof and the cost of inspecting the premises during the term of such permit to insure compliance with this section. Such fee shall be set by resolution of the Village Board. Section 10. Section 65-55B(A) of the Village Code entitled “Renewal/Revocation of Special Registration Use Permit” shall be amended as follows: A. Such special registration use permit shall be effective from the date of its issuance until the 31st day of December of the year of such issuance. Applications for renewal permits shall be submitted in the December preceding the year for which such renewal permit is sought and may be issued, either upon the applicant’s reaffirmation of his original application and a statement showing any variations therein, or upon a new application as described in § 65-55A. Said application for renewal shall be accompanied with a fee to be paid by the applicant to defray the administrative cost of said application. Such fee shall be set by resolution of the Village Board. Section 11. Separability The provisions of this local law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances.
