SPECIAL PORT COMMISSION MEETING Wednesday, December 01, 2021 at 10:00 AM City Council Chambers | 202 N. Virginia Street, Port Lavaca TX 77979 MINUTES STATE OF TEXAS § COUNTY OF CALHOUN § CITY OF PORT LAVACA § MINUTES OF 12/01/2021 SPECIAL PORT COMMISSION MEETING The agenda having been properly posted, Chairman Alex Davila called the meeting to order at 10:03 A.M. on Tuesday, December 01, 2021. Members attending were Commissioner David Roberts, Commissioner Mike McGuire, Commissioner Sue Traylor, Commissioner Michael Kovarek, Commissioner Jamie O’Neil. City Staff attending were, Interim City Manager Jody Weaver, Finance Director Susan Lang, Harbor Master Jim Rudellat and Rachel Garza. Visitors in attendance were Mark Slider, Encore Absent Member: Commissioner Larry Nichols CONSENT AGENDA 1. CONSIDER / DISCUSS A NEW LEASE OF TRACTS 17 AND 17(A) AT THE HARBOR OF REFUGE, FOLLOWING EXPIRATION OF THE CURRENT LEASE ON DECEMBER 31, 2021. Encore is offering to pay the same $5,000/mo (for a slightly smaller footprint) and will improve the existing road with side swales to drain and crush concrete to be constructed by Philip Gonzales for $50,000 and then build a 100' x 300' rock pad for a cost of about $50,000 AND keep the site clean. They would like to have a 5-year lease but would need a minimum 2 years in order to make this $100,000 investment. I mentioned that the $5,000/month rate was effective Jan 2020, so the rate may need to be adjusted considering the MCI since that time. Motion to authorize Jody Weaver with the task of performing an environmental and legal certification survey for Tract 17 and 17(A) as of December 31, 2021. Motion was made by Commissioner Mike McGuire, and Commissioner Jamie O’Neil. Motion Carries. Motion to accept a two (2) year lease from January 1, 2022 – December 31, 2023 to Encore for Tract 17 and 17(a) with an MCI between 2% and 5% on 10/1/2022. Motion was made by Commissioner Jamie O’Neil, and Commissioner Sue Traylor. Motion Carries. ADJOURNMENT A motion was made by Commissioner Sue Traylor to adjourn the meeting. It was seconded by Commissioner Mike McGuire. The meeting was adjourned at 10:45 A.M.
