CITY OF PRESCOTT, WISCONSIN NOVEMBER 18, 2019 HEALTH & SAFETY COMMITTEE MINUTES Pursuant to due call and notice thereof, a meeting of the Health & Safety committee was held, Monday, November 18, 2019, Municipal Building, 800 Borner Street, Prescott, WI 54021. Call to Order: Alderperson Gergen called the meeting to order at 5:00 pm. Members present include Maureen Otwell and Joshua Gergen. City Administrator Jayne Brand represented staff. Also present Darrel Zaleski, Insurance Agent for City of Prescott Gergen/Otwell motion to approve minutes for February 25, 2019 passed without a negative voice vote. Discussion was held on the city relinquishing all control over Prescott Daze. Darrel Zaleski gave a background of how the city took over control over Prescott Daze. There is not an issue with the city having a festival. There has been a gray issue between Prescott Daze and City of Prescott for some time. Prescott Daze needs to be a function of the city. The Prescott Daze Committee would need to be appointed and approved by the city. Council would need to approve everything happening for Prescott Daze. Minutes would need to be held for meetings and presented to Council. Lines have gotten blurred between Prescott Daze Committee and the Council. As it is currently being handled there is a chance the Prescott Daze Committee members could be brought in on a lawsuit. Prescott Daze needs to be clearly defined as a City of Prescott festival or the committee needs to become its own entity or handled by another group. Zaleski stated there are a number of other groups in other communities which handle festivals.. Alderperson Gergen stated he would like to see Prescott Daze handled by someone other than the city. The city would always be liable not matter if the group is private or operating on their own since the events are being held on public property. Even though the Prescott Daze Committee has said there are unsanctioned activities the city and committee would still be liable because they are on the flyer. This is fine but each group or event should be providing the Prescott Daze Committee a certificate of liability insurance. With a liquor claim the state cap protection of $50,000 comes off and the city can be liable for a larger amount of a claim. He also explained how the $50,000 cap works. If someone would have an incident that person could file a claim and be paid up to $50,000. If a spouse or child would file a claim they could also be paid up to the $50,000 cap. It was suggested every vendor and group which put on an event should provide a certificate of insurance. Every one in the parade should provide a certificate of liability. The city would still provide police protection and help with setting up and taking down for Prescott Daze. It is also suggested that the fire department get their own event insurance policy or work with Prescott Daze. The Committee would like to have an informational meeting shortly after the first of the year with the Prescott Daze Committee and public before a final decision is made. Other Business: Activity in parks was discussed in regards to alcohol. The city has recreation immunity for allowing resident to have alcohol in the city park. If the city approves a temporary beer license than the city should get a certificate of liability for insurance. Gergen/Otwell motion to adjourn passed without a negative voice vote.
