CITY OF PRESCOTT, WISCONSIN NOVEMBER 16, 2015 PARKS AND PUBLIC PROPERTY COMMITTEE MEETING MINUTES Pursuant to due call and notice thereof, a meeting of the Parks & Public Property Committee was held November 16, 2015 at the Municipal Building, 800 Borner St. Prescott, WI 54021. Call to order/Roll Call: The meeting was called to order at 5:08 p.m. Members present were Jack Hoschette and Bill Dravis. Joshua Gergen was excused. Public Works Director Hank Zwart and City Administrator Jayne Brand represented staff. Also present Robert Kulla and Cheri Orth residents of 419 Lake Street. Mayor Hovel joined the meeting at approximately 5:25 p.m. The committee discussed the deck on public property at the property located at 419 Lake Street. Robert Kulla owner of the property stated the deck has been on the property since 2010 when his father owned the property. He stated the letter he received and his discussions with the Code Enforcement Officer indicated there was more water runoff but Robert stated there is no more water runoff with the deck being there. He said he did remove the private property sign but has found beer bottles and other liter on the deck. He said he doesn’t have a problem allowing the public to use the deck but wants them to clean up after themselves. Robert stated he feels the deck is on his property but he also understands the city has right of way along Lake Street. He stated if the city needs the property he would remove the deck at that time. Robert also stated he would expect the neighbors to have to remove their decks also. Robert stated he feels there would be greater liability if the deck was not in place. City Administrator Jayne Brand explained we did discuss this deck back in 2010 and he was informed when the house was sold the deck should have been removed. Because the sale was between father and son Mayor Hovel felt the deck could be left but wanted to have a document filed at the Courthouse which would be filed against the property so when the house is sold it would notify the buyer the deck would need to be removed. Brand stated the city did not want to flaw someone’s title if Kulla believes the deck is actually on their property and suggested they have the property surveyed. Kulla provided documents showing the surveys which were done. Public Works Director Hank Zwart stated you can look at the surveys but you need to actually be out at the site to identify where the property stakes are. Mayor Hovel joined the meeting at this time. His recommendation is to put together a letter of agreement allowing the deck to remain and Kulla having a hold harmless for allowing the deck on public property. Kulla stated this was the agreement with his father so he doesn’t understand why it needs to be done again. Alderperson Dravis stated it is because he is the owner of the property and the agreement will allow for reinforcement with Robert as the owner. Dravis/Hoschette motion to get hold harmless, letter of understanding allowing the deck on public property signed by both parties passed without a negative voice vote.
