Pursuant to due call and notice thereof, a meeting of the Parks, and Public Property Committee was held,
July 18, 2022, Municipal Building, 800 Borner Street, Prescott, WI 54021.
Call to Order: Committee Member Bailey Ruona called the meeting to order at 5:01 pm. Members present
were John Peterson, Bailey Ruona. Pat Knox was exempted. City Administrator Matt Wolf, Planner Carter
Hayes, and Police Chief Eric Michaels represented City staff and Police. Members of the public included Tom
Oss.
1. Approve Minutes for June 29, 2022.
Ruona motioned to approve the minutes for June 29, 2022, Peterson seconded, motion passed without a
negative voice vote. (2-to-0)
2. Prescott Beach Hours
The current City Code calls for the Beach to be open based on the following.
Shall be open each year for public use during posted hours; the bathhouse shall be open for public use
during corresponding hours. (421-6)
With recent issues occurring at the beach and new signs being added staff would like to discuss with the
Committee set hours for the Prescott Beach. Currently they have been following other parks within the
community, which is 6 am – 10 pm.
City Administrator Wolf presented the information regarding the proposed changes of the posted Prescott
Beach hours. It was recommended that the hours change to 7 am – 9 pm, or alternatively in accordance with
sunrise and sunset.
Chief Michaels offered the idea of changing the non-motorized boat launch hours to match the Prescott
Beach hours. Committee member Ruona expressed the idea to change the language within the ordinance to
include the non-motorized boat launch. A temporary sign with the new hours will be posted to enforce the
change.
Committee member Ruona motioned to approve the new Prescott Beach Hours, and to move the
ordinance change to the Ordinance Committee. Peterson seconded; motion passed without a negative
voice (2-0).
3. Non-motorized Boat Launch Parking
In 2021 the Parks and Public Property Committee discussed not allowing parking at the very end of Lake
Street and limiting it to the bump out area pictured below. Staff would like to discuss with the Committee
making the area non-motorized boat launch parking only.
Chief Michaels explained the issues regarding the parking at the end of Lake Street. It is expressed that
vehicles have been parked in the cul-de-sac at the end of Lake Street rather than parallel parking bump out
along the street. It is discussed to designate the three spots of parallel parking to be non-motorized boat
launch parking only. Chief Michaels explained that the current parking situation on Lake Street is non-
enforceable. With correct signage, the designated spots become enforceable under city ordinances.
Committee Member Ruona motioned to move the matter to council. Peterson seconded; motion passed
without a negative voice (2-0).
4. Boat Launch Garbage
The weekend of July 9th and 10th the City had someone dump a number of items at the Boat Launch
garbage dumpster area. Staff would like to discuss with the Committee the option of removing the Boat
Launch dumpster and garbage cans, which would have everyone bring their own waste with them and
leave no trace.
City Administrator Wolf presented the information regarding the dumpster and trash receptacles that are
currently at the Public Boat Launch. It is proposed that the dumpster and trash receptacles be removed,
and a carry in & carry out policy be accepted at the boat launch.
The matter will be written in the Committee report and included within the Common Council packet on
July 25, 2022.

6. Other Business
Chief Michaels explained the concern of public gatherings taking place at Point St. Croix and Leo’s
Landing. Both properties owned by the City are leased to private entities. Chief Michaels explained the
difficulty in assessing enforceability. Additional issues were discussed regarding the illegal parking at
Mercord Mill Park. Individuals are currently parking on grass patches not designated for parking, and
sometimes blocking an emergency access road. The City will explore options to satisfy the parking
situation that is occurring at Mercord Mill Park/Leo’s Landing. One of the options includes fencing and
bollards that mitigate illegal parking on City property.
Since the approval of goats for the Freedom Park hillside prairie restoration, several residents have
inquired about goats as a service for vegetation management at their own private residences. Committee
member Ruona expressed the idea to approve the idea of goats as a service for private residences.

Subject: Coulee River Trails Memo
Background
The City of Prescott has been working with Coulee River Trails group, which falls under the
Friends of Freedom Park, on designing a trail system in and around the City of Prescott. To
formalize that agreement the parties have been working together to design a Memorandum of
Understanding. Additionally, the CRT group has submitted a proposal for the design of a
Mountain Bike Skills Course, which is a part of the previously approved Magee Park Concept
Plan.
Memorandum of Understanding
The Memorandum of Understanding for development of trails and other improvements with the
Friends of Freedom Park contains the following between the City of Prescott and Friends of
Freedom Park as a fiscal sponsor for the Coulee River Trails Project:
1. Ownership of Improvements – City of Prescott unless conveyed to FFP/CRT
2. Term of Agreement – Perpetuity until 60 days’ notice by either party
3. CRT Trail Corridors – CRT Trail Corridors as laid out in the Comprehensive Outdoor
Recreation Plan
4. CRT Volunteers – Terms for volunteers of CRT and the need for release and waiver of
liability form with FFP providing insurance coverage for volunteers
5. CRT Responsibilities – Provide technical assistance, be responsible for any all non-
ADA trails, volunteer supervision, etc.
6. City Responsibilities – Review and approve proposed trail designs, purchase materials
if approved by Council, allow CRT to provide a lock box on site, provide maintenance
staff if agreed to by Director of Public Works, review and approve design/maintenance
schedules by CRT, maintain park in unrelated trail areas, etc.
7. Amendment of Agreement – Shall not be altered, changed or amended unless mutually
agreed by both parties.
8. Funding – CRT must seek City approval before going for funding assistance for
development, maintenance, design, or marketing of trails on City property.
Staff would like to review the MOU with the Committee for their feedback. The City Attorney
has reviewed Memorandum of Understanding and provided comments, which were
incorporated into the draft version before the Committee.
Mountain Bike Skills Course
Coulee River Trails has submitted a proposal for the development of a Mountain Bike Skills
Course, which is attached. The course would be constructed by volunteers and would be done
per the specifications laid out in the Memorandum of Understanding.
Recommendation
1. Review the MOU and consider recommendation to City Council
2. Discuss the construction of the Mountain Bike Skills Course by Coulee River Trails and
consider recommendation to City Council.

INTRODUCTION AND PURPOSE
AF
This MEMORANDUM OF UNDERSTANDING (MOU) is hereby made and entered into by and
between Friends of Freedom Park, Inc., hereinafter referred to as “FFP”, a Wisconsin nonprofit
corporation, as fiscal sponsor for the Coulee River Trails Project, hereinafter referred to as
“CRT”, the volunteer Steering Committee of CRT, and the City of Prescott, Wisconsin, referred

to collectively as “the Parties.”
The City of Prescott, FFP and the CRT Steering Committee are interested in promoting
mountain biking as an outdoor recreation and fitness activity and in developing and
maintaining quality trails for cyclists of all ability levels at Magee Park and other city-owned or
city-controlled land in CRT corridors as designated now or in the future.
This MOU identifies specific recreational trail projects, including the design and construction of
technical mountain bike trail features, the parties propose trail construction, trail maintenance
and trail patrol activities which CRT volunteers agree to provide as a service to the City of
Prescott, establishes the responsibilities and conditions under which those volunteer services
will be provided, and delineates the shared responsibilities for trail construction, trail
maintenance and trail patrol activities.
SCOPE OF THE AGREEMENT
A. Ownership of Improvements
All CRT improvements constructed on property owned by the City of Prescott shall remain the
property of the City of Prescott until conveyed to FFP, CRT or another person or entity. All
materials, including records, data, and other information acquired, developed or documented
under this MOU shall be the property of the originating party, unless otherwise mutually agreed
upon by both parties.
B. Term of Agreement
The term of this MOU shall commence on the date all Parties have signed this and will
continue unless terminated by either party upon 60 days written notice.
C. CRT Trail Corridors
This agreement pertains to all CRT trail corridors on city-owned land as approved by the City
of Prescott in its Comprehensive Outdoor Recreation Plan, Magee Park concept plan, and
other decisions approved by the Prescott City Council. Currently, this includes the mountain
bike trail (blue trails) and ADA accessible trails (green trails) at Magee Park and the mountain
bike skills course at Magee Park.

D. CRT Volunteers
Volunteers providing trail maintenance and patrol services at Magee Park and other city-owned
or controlled areas in CRT corridors pursuant to this agreement are volunteers of CRT and are
covered under the policies and procedures of CRT regarding volunteer organization and
management. Such Volunteers are not employees of or individual volunteers of the City of
Prescott, however they will receive training enabling them to explain the relationship between

FFP, CRT and the City of Prescott. During the term of this MOU, the City of Prescott grants
permission to CRT volunteers to enter City of Prescott owned or controlled lands on which
CRT trails are being designed, constructed or maintained to perform CRT responsibilities
under this MOU. All CRT volunteers will sign a volunteer release and waiver of liability form
given to them by the City before they can work on City property. Furthermore, FFP or CRT
shall provide insurance for any injuries caused or sustained by FFP or CRT employees, agents

or volunteers.
E. CRT Responsibilities
1. Provide technical support to the City of Prescott in determining the location and
design of technical features for CRT trails, consistent with the ability level
designation of each trail segment in accordance with the International Mountain Bike
Association (IMBA) guidelines.
2. Shall be responsible for the maintenance of any and all trails that are non-ADA
compatible that they request to put on City property.
3. Provide and supervise volunteers in the construction of approved technical features
and alignment changes including the following.
● Utilize tools owned by CRT, or tools owned by the City of Prescott that may be
made available by the designated Prescott Public Works Director or other
authorized representatives of the City of Prescott.
● Ensure that trail technical features and alignment changes conform to IMBA
guidelines and City of Prescott approved designs.
● Train and supervise volunteers in appropriate construction techniques in
accordance with IMBA guidelines.
● Identify a crew leader and submit that name to the Prescott Public Works Director
or other authorized representatives of the City of Prescott.
● Coordinate work schedules and on-site public notification of trail construction or
maintenance activities, when needed, with the designated Public Works Director
or other authorized representatives of the City of Prescott.
● Volunteers use of bikes in the on-site planning and testing of technical features
prior to official trail opening as coordinated with the Public Works Department.
4. Provide volunteers to assist with the inspection and hand-work maintenance of trails
including the following.
DR ● Seasonally submit to City of Prescott for approval a schedule identifying
minimum timetable for trail observation/inspection.
● Ensure that all volunteers have received training in trail inspection and
maintenance responsibilities.
● Sculpting and/or removing downed trees on the CRT trails as approved by
AF Prescott Public Works Department.
● Perform routine trail maintenance activities. In the event that CRT is unable to
safely and promptly address an identified issue that may create an unsafe
situation, the CRT volunteer or team leader will notify the Prescott Public Works
representative on duty.
5. Use of Chainsaws and Tree Removal by CRT Volunteers.

● Only individuals who have been designated as “chainsaw operators” will be
allowed to operate chainsaws on City of Prescott properties. CRT or FFP will
provide such designation only to individuals who have received training in the
safe and proper use of chainsaws and who wear appropriate Personal Protective
Equipment (PPE) while using chainsaws for trail maintenance (e.g., chaps,
gloves, and sawyer’s helmet).
● No live standing trees of native species over 4 inches in diameter will be cut
without first receiving approval from the designated Prescott Public Works
Director or representative. No live Oak trees will be cut or trimmed outside of
winter months.
● Brush and small trees that are cut will be scattered at least 10 feet off the trail
and trimmed so that no portion extends more than 3 feet above the ground.
● Large trees up to 12 inches in diameter that fall across a trail may be cut to clear
passage for the bike trail but the remaining portions of the trees should be left in
place provided it’s safe to do so.
● Volunteers shall notify the designated Prescott Public Works or Parks
maintenance staff contact person when a fallen tree greater than 12 inches in
diameter needs to be cleared from a CRT trail. Prescott Public Works crews will
be responsible for clearing such trees.
6. Provide and supervise volunteers for the purpose of winter trail grooming,
maintenance, and inspection.
● Routine trail inspection and maintenance shall be conducted during the winter
season under the same guidelines specified by this MOU for summer season.
● Develop, implement and evaluate winter trail grooming techniques and
equipment.
● Train and supervise volunteers in appropriate trail grooming techniques in
accordance with CRT guidelines for winter trail use.
● Identify a crew leader(s) for winter grooming who will maintain timely
communication with the Prescott Public Works Director or other authorized
representatives of the City of Prescott.
7. Work with the City of Prescott to develop a routine inspection log report sheet for
use by volunteers for the regularly scheduled inspections that will identify desired
DR items for inspection and once created and approved, use the inspection log report
during regular inspections of trails.
● Copies of inspection log reports shall be submitted to Prescott Public Works
Director.
8. Work with partner organizations (e.g., the Rivers, Trails, and Conservation
AF
Assistance program of the National Park Service) to conduct preliminary studies to
assist with trail design (e.g., natural resources surveys, hydrological studies, etc.).
9. Post requests for proposal (RFPs) for certified trail builders, in accordance with all
relevant City of Prescott ordinances, policies, and procedures. Oversee construction
of trails in partnership with Prescott Public Works Director and projects that exceed

$25,000 must follow Wisconsin State Statute 66.0901 following bidding
requirements. City will work with CRT to post public notices in accordance with
State Statutes.
10. Submit recommendations to the City of Prescott for any changes to the trail
alignment that may be contemplated by CRT in carrying out the volunteer duties as
outlined in this MOU. All proposed changes must be reviewed and approved by the
City of Prescott (City Administrator and/or Director of Public Works).
11. Recommend to the City of Prescott the types, location and language for trail
directional, cautionary and informational signs and install (if requested by City of
Prescott).
12. A designated CRT representative(s) may make recommendations to Prescott Public
Works Director as to when to close and re-open trails due to poor conditions or other
unforeseen circumstances observed during trail patrol or maintenance activities.
13. Provide trail patrol volunteers (Ambassadors) as an optional service to assist in
monitoring trail activities and providing assistance to trail users.
● CRT may provide volunteers identified and trained by CRT as trail patrollers to
ride and monitor the trail.
● Trail patrollers can offer assistance to trail users within the scope of their training
and volunteer status under CRT.
● Trail patrollers should call 911 for emergency assistance situations (City of
Prescott Public Safety may not be the first response unit to arrive at the scene).
To contact City of Prescott Public Safety specifically for non-emergency
situations such reporting suspicious activity, uncooperative behaviors, or
unauthorized trail use by calling 911 and requesting to be put in contact with a
City of Prescott Public Safety Officer.
● The schedule for trail patrol by CRT volunteers should be communicated in
advance to City of Prescott Public Works Director or other authorized
representatives of the City of Prescott.
● Provide City of Prescott with summary trail safety reports as generated by CRT
volunteer trail patrol.
DR 14. CRT volunteers may not interfere with the enjoyment of park users and must abide
by City of Prescott Ordinances and park rules.
F. CITY OF PRESCOTT RESPONSIBILITIES:
AF 1. To review and approve design and implementation plans for all agreed to volunteer
activities.
2. Shall grant access to CRT to city-owned land for purposes of trail design, staking
and marking trails, maintenance, and construction of trails upon approval by the City
T of Prescott Council.
3. To purchase materials, if approved by Council, to be used in the construction of
approved technical features.
4. To loan tools and equipment for construction and maintenance activities, upon
request and approval of City.
5. To allow CRT to provide their own lock box at an agreed upon location within Magee
Park or future city-owned land within the Coulee River Trails corridor. Purchase of
tools will be the responsibility of CRT.
6. To provide City of Prescott maintenance staff support for approved work on a
schedule agreed to by City of Prescott Public Works Director.
7. To review and approve recommended technical feature designs, construction
schedules and trail maintenance schedules.
8. As agreed by the Parties, to repair and maintain Magee Park and other city-owned
property in the Coulee River Trails corridor, including parking areas and other
features within the park which are unrelated to direct trail use.
9. To recognize CRT’s contributions for trail design, technical feature design and
construction and volunteer maintenance support in appropriate signage at an
appropriate location in a manner approved by City of Prescott and to be coordinated
through the City Administrator .
10. To display a message about the CRT organization and event opportunities in
manner approved by City of Prescott at a location approved by the City of Prescott.
11. To authorize CRT to have an informational display/booth at trailheads to use as it
needs for trail promotion, maintenance, fundraising, and special events.
12. To notify CRT of trail closures or events which affect the use of the trail for posting

13. Promptly approve or reject the types, location and language for trail directional,
cautionary and informational signs on city owned or controlled property as
recommended by CRT.
G. Termination of Agreement
This MOU may be terminated by any party upon delivery of 60-day written notice to the other
Parties.
H. Amendment of Agreement
This MOU shall not be altered, changed or amended except by written mutual agreement of

I. Funding
All grants or other funding requests made by CRT or FFP for the development, design,
maintenance, or marketing of trails on City property shall be approved by either the City
Administrator, Public Works Director, or the Common Council of Prescott.

K. Hold Harmless Agreement
Each party agrees that it will be responsible for its own acts and the results thereof and shall
not be responsible for the acts of the other party and the results thereof and each party shall
carry insurance sufficient to insure against the acts of the party’s agents, employees or
volunteers. Each party, therefore, agrees that it will assume all risk and liability to itself, its
agents or employees, for the injury to persons or property resulting in any manner from the
conduct of its own operations, and the operation of its agents or employees under this
agreement, for any loss, cost, damage, or expense resulting at any time from any and all
causes due to any acts or acts of negligence, or the failure to exercise proper precautions, of
or by itself or its own agents or its own employees, while occupying or providing volunteer

services on CRT trails under and pursuant to this MOU. The Parties acknowledge and agree
that this hold harmless agreement does not constitute a waiver of defenses to liability claims
and does not prevent a party from asserting any defenses to claims provided by Wisconsin
statutes and other laws.
L. Applicable Law.

The construction, interpretation, and enforcement of this MOU shall be governed by the laws of
the State of Wisconsin.
A. Severability.
Should any portion of this MOU be determined to be illegal or unenforceable, the remainder of
the MOU shall continue in full force and effect, and any of the parties may renegotiate the

terms affected by the severance.

Coulee River Trails
Request to City of Prescott to Move forward with Mountain Bike Skills Park Construction
Proposal
Coulee River Trails (CRT) is asking for permission from the City of Prescott to move forward with creating a mountain
bike skill-building course. This course is a component of the officially approved Magee Park Concept Plan (attached).
Discussion
CRT is asking to utilize volunteer and donated labor, machinery, materials and supplies to develop a skill-building course
in the area of the existing quarry within Magee Park. A collage of potential park features is attached along with a map
showing the perimeter of the course along with topographical features and planned modifications to the area. The exact
positions of the various features on the course are yet to be determined. Features in the attached PDF are
representative only. The intended construction will consist of the following:
● Clear and grade the quarry and the existing spoil piles to the west to have a clean slate of approx. 0.5 acre.
● Dress the area with cohesive clay soils of 6 inches in depth
● Find clean fill to add into the park
● Grade terrain features with a skid steer
● Add lumber planks, limestone blocks, etc.
● No construction will take place on the steep quarry wall slopes. Barriers such as large boulders or fencing will be
placed to separate and prevent utilization of side slopes.
CRT intends to oversee and maintain this skills park unless another agreement is formed.
Before the skills park is opened for public use, we will ask the designated city representative(s) to approve the
completed layout and features.
A Memorandum of Understanding (MOU) between CRT and the City will accompany this proposal in order to define and
separate the respective roles and responsibilities of the organizations. With this aspect of the project we intend to
create initial excitement for and use of Magee Park with minimal monetary investment from the City.
Organization Information
CRT is a non-profit community group committed to developing and maintaining a regional trail system in the Prescott
area. CRT operates under the fiscal sponsorship of Friends of Freedom Park. In addition to Friends of Freedom Park, CRT
is working in coordination with the City of Prescott, The National Park Service, the Prescott School District, and
Landmark Conservancy.
Our mission is to connect and conserve the unique habitat and history of the confluence region, providing a place for
recreation and exploration.
Our vision is to protect a nationally significant habitat as a nature preserve and promote outdoor activity by creating a
trail system to allow pedestrians and bicyclists to explore and enjoy the unique confluence region.

Subject: Public Square Pickleball
Background
The City has been exploring the construction of dedicated pickleball courts for Public Square Park.
Currently, the residents interested in pickleball have been utilizing the tennis courts to play pickleball
on, sometimes flexing the area to fit 4 courts.
Since the previous Parks Committee meeting on March 21st, 2022, the City has reached out to the
following companies/contractors for the various aspects of court construction:

Sport Court North (6-13-22) – Comprehensive Court Construction

Currently, the only estimate to include the full court construction has been Sport Court North. It has
served as a baseline for a complete cost estimate of the project but offers room for modifications
that can lower total cost. Modifications to lower cost could include fence height and base material
used.

Discussion
If the City moved forward with the construction of the Pickleball Courts, it would require a split in the
costs between the City and the Prescott Pickleball Association. This would be in addition to the other
Public Square Park improvements listed below that are included in the City’s Comprehensive Outdoor
Recreation Plan.
• The City would be responsible for 50% of the pickleball court costs.
o Dependent on bids, could be roughly $90,000.
• The City would also undertake the tennis court fence replacement.
o Cost estimated at $21,120.
• The City would also explore resurfacing and updating the basketball court.
o Acrylic surfacing estimated at $12,792
o New hoops (x2) estimated at $7,000
o Total Cost Estimation: $19,792
• Additional parking and sidewalks would also be necessary.
o Potential assistance from Public Works Department.
o Cost estimated at approximately $10,000.
Projected Total City Cost: $140,912*
*Approximation based on received estimates.
• Evaluate the project’s cost and options moving forward.
• Examine project specifications and adjust aspects and amenities to fit budget constraints.
• Review complete project plan and provide perspectives and timeline of execution.
Recommendation
• Staff recommends discussion of including the Public Square Park improvements in the 2023
Budget with the contingency that the Prescott Pickleball Association will be responsible for
50% of the costs associated with construction of the Pickleball Courts.

Background
The City of Prescott has allocated $125,000 for the development of a Boat Launch and Fishing
Pier in the 2022 Budget through TIF #4 funds. Cedar Corporation worked with River City
Welding to design a preliminary plan set to submit to the DNR and Army Corps of Engineers
for approval. Prior to the work being done the DNR is requiring a mussel survey and relocation
be completed. Previously, this work was to be included in the bidding process but after
clarification from the DNR this work needs to be completed separate.
Discussion
Cedar Corporation has approached multiple organizations about completing the work for the
Mussel Survey and Relocation however only received one formal proposal and estimate
response form Daguna Consulting for a total of $15,200. As this is a professional service
being requested there is no public bidding requirement. If approved the money for the work
would come out of TID #4 as part of the riverfront improvements.
Recommendation
Discuss approval of the Daguna Consulting quote of $15,200 and forwarding on to Council for
consideration.

SCOPE OF WORK
The City of Prescott, Wisconsin plans to replace an existing boat launch dock and install
a floating fishing dock in the Mississippi River where one had previously been. The
project is located just downstream of the confluence of the St. Croix River and
Mississippi River at 44.745086, -92.799209 (WGS84). The existing boat launch dock is
in poor condition and will be replaced with a new floating dock. A new walkway will
lead to a new floating fishing dock. The project footprint is approximate 0.35 acres. A
natural resources review found that several federally listed (FE = endangered) and state-
listed mussels (ST = threatened, SE = endangered) may be present in the area, including
but not limited to:

The Wisconsin Department of Natural Resources (DNR) is requiring a mussel survey and
relocation as a prerequisite for project approval. If federally listed species are detected
during the survey and relocation, the U. S. Fish and Wildlife Service (USFWS) will need
to be consulted before a permit allowing work is issued. No federal species may be
relocated, and additional permission may need to be issued to proceed with any
relocation. If no federally listed species are detected, the DNR has tentatively approved a
relocation of mussels.
We, Daguna Consulting, LLC, propose a mussel survey/relocation that would cover
habitats in and around the project footprint. The survey/relocation will include all areas of
the riverbed that will be directly impacted by construction and any areas that would
receive sediment or indirect disturbance from construction activities. Surveys/relocations
will conform to the” Broad Incidental Take Permit/Authorization for Common Activities
(BITP/A)” published in November 2019. The DNR and, if warranted, the USFWS will
determine the need for additional relocation or other mitigation actions based on survey
results and preliminary relocation efforts.

Relocation sites will need to be surveyed. Surveys will select suitable sites based on
similarity to habitat in project location and similarity of assemblage conditions (see
below)

Possible mitigation, marking, monitoring
Project footprint will be confirmed with client and client will work only in areas that have
been cleared of mussels. Daguna Consulting will provide precise GPS boundaries of
cleared area.
All listed species will be marked using a Dremmel or plastic shellfish tags before
relocation. Otherwise, no monitoring is planned.
Relocation Team
Lead Biologist will be Brett Ostby. He is an approved surveyor for the State of
Wisconsin. Work will be covered by Wisconsin Endangered and Threatened Species
(E/T) Permit #1015 and United States Fish and Wildlife Service Recovery Permit
TE59798B-2, which covers all federally listed mussels in Wisconsin.
Brett Ostby earned a Masters’ Degree in Fisheries and Wildlife Sciences from Virginia
Tech (Blacksburg, VA) in 2005 and has 20 years of experience conducting freshwater
mussel surveys and leading research projects. His work has been funded by various
governmental and non-governmental agencies across the United States. Information on

The primary diver will be Emory Hagemeyer. He has over 7 years of experience
conducting freshwater mussel surveys and relocations.
Timing:
Relocations will occur in a timeframe that allows completion of all relocation work prior
to initiation of activities that impact the streambed. This will ensure that mussels do not
move back into the relocation area before construction is initiated.
Water Temperature:
To minimize thermal stress to the mussels, air temperatures will be above 32oF and water
temperature will be above 40oF during surveys and relocations.
Impact Area Delineation:
Mussels will be relocated from all areas of temporary or permanent instream impact as
defined above. The survey/relocation area will include an appropriate buffer as dictated
by substrate and flow conditions at that site. The impact area will be clearly marked or
delineated with a GPS unit. Markers by be deployed and may remain in place throughout
the length of the project (not just the relocation) if deemed necessary (determined on a
project-by-project basis). This is to ensure that impacts to the streambed are contained
within the areas where mussels were removed.

Mussel Collection from the Impact Area:
Following delineation of the impact area, the relocation team will establish transects or a
grid within the collection area. All mussels in the impact area will be collected using
SCUBA. All mussels will be collected and held in submerged mesh bags to minimize
handling stress. The number of mussels collected in each bag or effort will be based on
the size and number of mussels and adjusted to avoid overcrowding. All areas will be
traversed at least twice to ensure all or an acceptable percentage of the total number of
mussels within the area are collected.
Holding, Processing & Transport of Mussels:
Following collection of mussels from the substrate, the mussels will be maintained in
water at ambient temperature during holding and subsequent transport to the relocation
site. Out of water time during processing will be kept to the minimum required to identify
and process. Water temperatures will be monitored throughout the relocation. At a
minimum, all mussels collected will be identified, counted, and relocated. A subset of
mussels may be measured, sexed, aged. All listed species will be uniquely marked on one
or both valves.
Transplant Site Delineation:
As part of the project, additional surveys will be conducted in greater area to determine
transplant sites. The Minnesota DNR, Wisconsin DNR and U. S. Army Corps of
Engineers may be asked to identify transplant sites, as they have data on nearby areas. A
suitable area will have all the following:
1. Be close to the collection area with sufficient habitat to support a viable
population.
2. Have similar or better habitat to the collection site.
3. Not be influenced by factors detrimental to unionids (e.g., point discharge,
dredging, navigation).
4. Have an existing or historical mussel population with similar species composition.
Placement of Mussels at Transplant Site:
All endangered/threatened mussel species will be hand placed in a natural position within
the substrate. The remaining mussels (not endangered/threatened) will be distributed by
hand along the surface of the substrate above suitable substrate,
Closing Report:
A closing report will be submitted to the Endangered Resources Review Program
(DNRERReview@wi.gov) or appropriate ER Review Liaison within 30 days of
completion of the mussel relocation. The closing report must include the following
information:
• Project Name
• Project Location (GPS location and description)

• Map indicating the location and extent of both temporary and permanent instream

• Map indicating the transplant location
• Species observed and any additional information collected
• Number of individuals of each species observed
FEE AND BASIS OF PAYMENT
The estimate for the survey, initial relocation, identification of transplant site and report
is $15,200.00. If additional services are required beyond this scope of work, we will bill
at a rate of $130/hr for each biologist, plus mileage according to standard IRS rates and
per diem of $150.

This estimate was made using the following assumptions:
1. Access to public and private property, if necessary, will be arrange by the client.
2. The work site is readily accessible for a sampling boat, truck, biologists, and their
gear.
3. Boat traffic and construction activities are limited so that biologists are not
endangered during surveys.
4. All field work can be completed during a 3-day period by a crew of 3 biologists.
5. There is only 1 deployment to the site from Rochester, MN.
6. The DNR/USFWS approve this survey/relocation approach.
