Summary Statement:
Staff Report 1504 Wine Country Road Rezone
Applicant was notified of a code violation in which a duplex had been illegally converted into a
4 plex. Applicant was advised that the current zoning did not allow for a 4 plex. Applicant has
submitted an application for a site specific rezone at 1504 Wine Country Road from
Residential Medium Density (RM) to Residential High Density (RH). If the rezone is approved
applicant would then be required to submit plans and comply with Building and Fire Code to
convert the Duplex into a 4 Plex.

The Comprehensive Plan and the Land Use Designation Map were updated in 2018
to accommodate and encourage these types of density increases when it makes
sense. The following Comprehensive Plan policies support the request for a rezone.

Policy H-3.2. Locate High Density Residential within a reasonable distance of schools,
employment centers, and transportation systems, and provide urban services, including water,
sewer, utilities, drainage, emergency services, and garbage disposal deemed necessary to
high-density residential development.
Policy H-3.3. Require Multi-family development to have direct access to adequate streets.
Policy H-4.5. Encourage residential uses that support increased densities,
while maintaining the single-family character of existing neighborhoods, such as duplexes,
multi-generational housing, and cottage housing.
Policy H-4.6. Encourage higher density single-family neighborhoods near commercial
centers and other facilities/services to encourage pedestrian, rather than vehicular circulation.
Staff has no objections to the proposed rezone and has advised the owner of the
requirements needed to convert the duplex to a legal 4 plex, including but not limited to
providing additional off street parking spaces, creating fire separations as required in the IBC
and Fire Code, and altering egress doors and windows as required.
Staff received one comment letter but believes that the concerns would be addressed at the
time of building permit with the addition of additional off street parking.
