Special Privilege is not being requested to achieve an inconsistent use of the property or other neighboring properties or zones. The property is located in a commercial zone, but it has been a historically residential property since 1920. B.) Such a variance is necessary because the property has been a historically occupied family residence, and a backyard with a 6’ fence, and the parcel was later zoned as commercial . The view within the backyard has views of a commercially operated auto dealership building, and their yard-long garbage dumpster, that is seen when standing in the middle of the backyard. The proposed trellis will help mitigate the view. C.) The granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone that is located. The proposed trellis is only meant to block the view from the backyard of the neighboring auto dealership and their dumpster.
