CALL TO ORDER:
The meeting of the Prosser Planning Commission was called to order at 6:01 p.m. on December
19, 2024, by Chair, Trevor Day. The meeting was also held virtually on GOTOMEETING.
ROLL CALL:
Commissioners present: Michele Villarreal, Don Howell, Nancy Martinez, and Trevor Day.
Aaron Williams was absent. City Staff present were: Steve Zetz (virtually), Community
Development Director, Rachel Shaw, Deputy City Administrator/City Clerk, and Howard Saxton,
City Attorney/Secretary.
APPROVAL OF MINUTES:
Nancy Martinez moved and Don Howell seconded that the minutes from the June 13, 2024, June
20, 2024, August 12, 2024, September 19, 2024, October 17, 2024, and the November 14, 2024,
Planning Commission Meetings be approved as drafted. All voted in favor of approval. Motion
carried.
DISCUSSION REGARDING PLANNED AREA DEVELOPMENT MORATORIUM:
The Secretary presented the City Council Findings supporting the current Moratorium in place
regarding Planned Area Developments (PADS). The Commission provided direction to staff as
follows:
1. The open space/recreation area should be 25% of the gross area of the development. The
ordinance should allow for open space/recreation space to be located off-site when it does
not make sense to have that area within the PAD such as when a park is already close by.
2. Private streets should not be allowed, but a new smaller public street standard for PADS
should be adopted to make sure those streets are adequate. Standard should be added to
ensure that sufficient parking is allowed for guests.
3. PADS should be located near existing retail cores in the City. They should not be
approved unless adequate sidewalks or pathways allow persons residing in the PADS to
walk to such services.
4. PADS should be directly connected to surrounding subdivisions. There should be a
prohibition on creating PADS that do not have one or more connecting streets and walking
facilities to nearby subdivisions and commercial areas. A grid pattern may be used, but it
should not be required.
5. Traffic calming should be encouraged to ensure the walkability in PADS.

6. Criteria should be added to determine whether open space or whether recreational facilities
should be provided. If recreational facilities are required, then irrigation must be available
to serve a PAD. If critical areas are present, then they should be preserved as open space.
7. Low income housing units should not be mandated but rather, the City’s incentive program
should adjusted to better encourage affordable housing.
DISCUSSION:
Rachel Shaw read into the record a proclamation recognizing the achievements and contributions
to the City of Prosser by Steve Zetz, the City’s Community Development Director who is leaving
Prosser to work for the City of Selah Washington. The Commission expressed its regret that
Steve Zetz was leaving the City of Prosser.

Summary Statement:
At the September 24, 2024, City Council meeting, Council adopted Ordinance No. 24-3254,
enacting a moratorium on Planned Are Developments (PAD) for a six-month period of time.
That moratorium is set to expire on March 24, 2025.
Per the Planning Commission's direction at the November 14, 2024, Special Planning
Commission meeting, Staff along with the City's contract Planners at Nexus Planning
Services, have been working on draft PAD options for the Commissioner's consideration.
The items before the Planning Commission to review are three options related to a proposed
overlay zone:
1. Option No. 1 - 100% Within the Buffer

2. Option No. 2 - Any% Within the Buffer
3. Option No. 3 - Any% Only Within Residential and Commercial Districts
The goal of the proposed overlay zone is to ensure future Planned Area Developments are in
close proximity to commercial and retail corridors. A ¼ mile radius from zones “CT”
(commercial, thoroughfare) and “CD” (commercial, downtown) encourages walkability while
discouraging housing development disconnected from essential retail services and community
facilities.
Staff recommends the Commissioners review, discuss and provide staff direction on how to
move forward with a proposed amendment to Prosser Municipal Code (PMC) Chapter 17.20

PLANNED AREA DEVELOPMENTS*

17.20.010 Planned area development defined.
A planned area development is an alternate form of subdivision and development
regulation to provide a more flexible method of development of land. (Ord. 1524 § 5 (part),
1991).
17.20.020 Purposes of a planned area development.
The purposes of a planned area development are:
A. To allow for creative development equal to or superior to traditional lot-by-lot
development;
B. To preserve open space, natural vegetation, water courses, wetlands, historic
buildings and places, and other community values;
C. To provide more efficient street and utility systems by clustering buildings;
D. To provide for a variety of housing types in one development with architectural design
compatibility;
E. To provide integrated landscape development;
F. To provide for the integration of new development into the existing community while
protecting and preserving the values of the surrounding neighborhood;

G. To provide for the development of mobile home parks, subject to the provisions of
Chapter 8.10 of this code pertaining to mobile home park standards. (Ord. 1524 § 5 (part),
1991).
17.20.030 General requirements of a planned area development.
The general requirements of a planned area development are as follows:
A. Minimum Size. Planned area developments may be located on a minimum of 2.5 acres
of land in any zone and are subject to the use restrictions in that zone except as noted
below.
B. Permitted Modifications. All zoning and subdivision requirements may be modified in a
planned area development in the interest of the expressed purposes above, except:
1. Building height;
2. Permitted use;
3. Street setbacks on exterior streets in residential zones;
4. Surveying standards;
5. Engineering design and construction standards of public improvements;
6. Requirements of this code; Chapter 8.10, Mobile Home Park Standards.
C. Permitted Density. In single-family zones the permitted density in the zoning district
may be developed with townhouses of equivalent environmental impact. The number of
townhouses permitted shall be calculated as follows: Permitted single-family density x
1.43 = The number of permitted townhouses. The number of permitted townhouses shall
be rounded to the nearest whole number.
D. Multiple Zones. If a planned area development is proposed within two or more zones,
the maximum number of dwelling units will be the total allowed in each zone combined.
The permitted land uses of the more restrictive zone shall apply to the entire planned area
development.
E. Location. Planned area developments must be located within the “PAD” (planned area
development) overlay in accordance with PMC 18.09.
F. Required Open Space. A minimum of twenty-five percent of the total gross area of the
planned area development, not including dedications, driveways, parking areas, required
street setbacks, yards and land occupied by buildings, must be open space or occupied by

recreational structures such as swimming pools, game courts, and outdoor shelters. (Ord.
1524 § 5 (part), 1991).
1. If critical area habitat is present within the proposed planned area development,
then protected critical area habitat can contribute to the twenty-five percent open
space requirement.
2. If critical area habitat is not present, then proposed planned area development
shall either:
a. Dedicate twenty-five percent of gross area for open space, or
b. Submit for City review off-site provision of open space in accordance with
PMC 18.57.040 (G).
G. Road Requirements. All roads within planned area developments shall be publicly
dedicated. Road criteria shall be as follows:
1. Road widths must have a maximum width of forty feet and in accordance with
City of Prosser construction standards.
2. Primary or “main” street of a planned area development shall connect to local
city street network.
3. All roads with no on-street parking must have a minimum width of twenty-six
feet.
4. There must be road and pedestrian connectivity to adjacent subdivisions.
H. Pedestrian Connectivity Requirements. Where planned area developments are adjacent
to commercial, retail, or industrial nodes, pedestrian improvements for direct connection
must be provided. Pedestrian connectivity criteria shall be as follows:
1. Intersecting, interconnected walking access paths: Walking paths shall provide
thorough pedestrian connectivity.
18.09.010 Districts established.
The following zoning districts are established:
A. “A” (agribusiness) district;
