CALL TO ORDER:
The meeting of the Prosser Planning Commission was called to order at 6:04 p.m. on April 17,
2025, by Chair, Trevor Day. The meeting was also held virtually on GOTOMEETING.
ROLL CALL:
Commissioners present: Michele Villarreal, Don Howell, Nancy Martinez, Aaron Williams, and
Trevor Day. City Staff present were: Howard Saxton, City Attorney/Secretary and Rachel Shaw,
Deputy City Administrator/City Clerk. Also present was Ryan Hughes, the City’s contracted
planner.
APPROVAL OF MINUTES:
Michele Villarreal moved and Nancy Martinez seconded that the minutes from the March 27,
2024, Planning Commission meeting be approved as drafted. All voted in favor of approval.
Motion carried.
COMPREHENSIVE PLAN LAND USE MAP AMENDMENT:
The Chair opened the public hearing on the Comprehensive Plan Land Use Map Amendment.
The Secretary reviewed the process the City followed to amend the Land Use Map. The Secretary
also summarized the application in this matter filed by the City. Since it had been omitted from
the hearing packet, the Secretary handed out the City’s affidavit of mailing to interested property
owners within 300 feet of the boundaries of the properties. There was no public testimony
presented at the hearing. The Chair closed the public hearing and the Commission deliberated.
Aaron Williams moved and Don Howell seconded that the Commission recommend approval of
the Comprehensive Plan with the Amended Land Use Maps attached to the Meeting Packet to the
City Council for approval. All approved. Motion carried.
The Commission next reviewed the draft findings for this matter. Don Howell moved and Aaron
Williams seconded that the findings be approved. All approved. Motion carried.
DISCUSSION REGARDING PERIODIC UPDATE OF THE CITY’S COMPREHENSIVE
PLAN:
Ryan Hughes from NEXUS Planning gave a presentation on the Comprehensive Plan Periodic
Update (Update). Ryan presented as follows: the Planning Commission is the steward of the
Update; the Comprehensive Plan is the centerpiece of local planning; the State mandates the
Updates occur; he shared the process the City has to follow for the Update; in 2023 the State added

the requirement to have a Climate and Resiliency element in the City’s Comprehensive Plan;
NEXUS was at the Harvest Festival and also at a meeting of the Migrant Education Program;
NEXUS is working on a housing analysis showing housing needs for the City for the next 20 years,
including by income levels; and NEXUS will be at the June Planning Commission Meeting with
drafts of the Update so the Commission can see if NEXUS is on the right track, or not.
DISCUSSION ON PLANNED AREA DEVELOPMENTS:
Ryan Hughes discussed options regarding updating the Planned Area Development Ordinance
(PAD). The Commission reached a consensus that the PAD should be replaced with an overlay
zone allowing zero-lot line developments and infill developments, each with increased density in
certain parts of the City that are walkable to transit and services.
DISCUSSION REGARDING A LOT COVERAGE ORDINANCE:
Ryan Hughes indicated that a lot coverage ordinance limits the percentage of impervious surfaces
allowed on lots in the City. These percentages will be different depending on permitted use on
the lot. The Commissioners reached a consensus that the Commission should consider approving
a lot coverage ordinance to Council, but asked NEXUS to do a cursory review of exiting lots in
the City to determine what percentage of existing lots are covered with impervious surfaces and
what is the status of existing stormwater drainage facilities in the City.
ADJOURNMENT:
The Commission reached a consensus that the May Commission meeting be moved to May 22,
2025. There being no other business to come before the Planning Commission, the meeting was
ADJOURNED at 7:03 p.m.

At the March 27, 2025, Planning Commission’s meeting, the Commission agreed to
repeal the PAD ordinance and replace it with an Infill ordinance. The choice was for
the Option 2 map to be used as the spatial boundaries of a potential Infill ordinance
“overlay zone” or for establishing a new “Infill” zoning district.

AN ORDINANCE ESTABLISHING PROSSER MUNICIPAL CODE 18.36
REGARDING AN INFILL DEVELOPMENT OVERLAY DISTRICT. IT ALSO
AMENDINGS PROSSER’S MUNICIPAL CODE 18.06.010 TO ADDING A
DEFINITION FOR ZERO-LOT LINE DEVELOPMENT. ALSO SETTING
FORTH THE EFFECTIVE DATE OF THE ORDINANCE AND PROVIDES
THAT ITS PROVISIONS ARE SEVERABLE FROM ONE ANOTHER AND
PROVIDES FOR PUBLICATION BY SUMMARY.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PROSSER,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. A new chapter 18.36 is added to Title 18 of the Prosser Municipal Code.
Prosser Municipal Code 18.36 is hereby adopted to read as follows:
18.36 “ID” (Infill Development) (“ID") Overlay District
Sections:
18.36.010 Purpose.
18.36.020 Permitted uses.
18.36.030 Criteria.
18.36.040 Infill Development Overlay Development standards.
18.36.990 Severability.
18.36.010 Purpose.
The purposes of the ID overlay district are:
A. To allow for creative development equal to or superior to traditional lot-by-lot development;
B. To provide more efficient street and utility systems by increasing density in areas suitable for
growth;
C. To provide for the integration of new development into the existing community while
protecting and preserving the values of the surrounding neighborhood;
D. To integrate new development within neighborhoods to prioritize walkability and middle
housing options.
18.36.020 Permitted uses.
The following are permitted uses in the ID overlay district:

A. Multi-Family Residential Buildings, townhouses, cottage courts, and courtyard buildings;
B. Zero-Lot Line Development; and
C. Any permitted uses provided by the underlying residential zone the lot is within.
18.36.030 Criteria.
Criteria for parcels within the Infill Development Overlay are as follows:
A. Public Services. All public facilities and services are immediately available and adequate to
the site of development within the Overlay or can be made available and adequate prior to
completion of such development.
B. Public Roads. The public streets and roads serving the site of development are adequate to
carry the additional traffic resulting from the development of the site.
18.36.040 Infill Development Overlay Development standards.
Development standards for parcels within the Infill Development Overlay are as follows:
A. Lot Area. For lots within the RL District, the minimum lot area will be seven thousand five
hundred square feet. For lots within the RM or RH District, the minimum lot area will be three
thousand square feet.
B. Minimum setbacks. For lots within the RL District, minimum setbacks are street frontage,
fifteen feet; sides, five feet on one side, and ten feet on the garage side or if no garage then the
driveway side if the same exist; rear, twenty feet. For lots within the RM or RH District,
minimum setbacks are street frontage, five feet; sides, five feet on both sides; rear, twenty feet.
C. Minimum lot width. For lots within the RL District, the minimum lot width is seventy-five
feet. For lots within the RM or RH District, the minimum lot width is twenty-five feet.
D. Maximum Lot Coverage. For lots within the RL District, maximum lot coverage is sixty
percent. For lots within the RM District, maximum lot coverage is eighty-five percent. For lots
within the RH District, maximum lot coverage is one hundred percent.
E. Permitted Number of Lots. The maximum permitted number of lots/dwelling units for any
development in the ID Overlay is determined by dividing the gross area of the parcel in square

feet by forty-three thousand five hundred sixty square feet, multiplied by the allowed maximum
density. The maximum densities for each residential zone are as follows: six for RL, fifteen for
RM, and twenty-six for RH. The closest or next lowest whole number is the permitted maximum
number of lots. If the maximum density limitation would prevent a single-family dwelling unit
from being built in the RL or RM zone, or would prevent a triplex from being built in the RH
zoning district, on a lot which was legally existing at the time this section was enacted, then
maximum density shall not apply to that lot.
18.36.990 SeverabilitySEVERABILITY.
If any section, subsection, sentence, clause, paragraph, phrase, or word of this chapter should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality thereof shall not affect the validity or constitutionality of any other section,
subsection, sentence, clause, paragraph, phrase or word of this chapter. (Ord. 2766 § 7, 2012).
Section 2. Prosser Municipal Code 18.06.010 is hereby adopted to include the following
definitions:
Cottage Court. “Cottage Court” means a group of small, detached residential structures
arranged around a shared court visible from the street.
Courtyard Building. “Courtyard Building” means a residential structure consisting of multiple
side-by-side and/or stacked dwelling units oriented around a shared courtyard.
Townhouse. “Townhouse” means an attached residential structure that consists of multi-story
dwelling units placed side-by-side. Entryways are on the narrow side of the structure and
typically face a street or courtyard.
Zero-Lot Line Development. “Zero-Lot Line Development” means the development of a
residential building on a lot in which any portion of one or more of the building’s walls rests
directly on a side or rear lot line to allow for units to be attached across lot lines. Zero-lot line
development allows individual ownership of each unit/lot.
Section 3. SEVERABILITY. The provisions of this ordinance are hereby declared to be
severable. If any section, subsection, sentence, clause, paragraph, phrase, or word of this chapter
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any
other section, subsection, sentence, clause, paragraph, phrase or word of this chapter. (Ord. 2766
§ 7, 2012).

person or circumstance is for any reason held to be invalid or unconstitutional, the remainder of

4. Clustering in accordance with Chapter 18.59 (planning commission recommendation).
5. Bed and breakfast operations in accordance with Section 18.60.240 (board of adjustment).
6. Sign code variance in accordance with Section 18.72.110 (board of adjustment).
7. Conditional use permits in accordance with Section 18.75.050 (board of adjustment).
8. Variances in accordance with Section 18.75.080 (board of adjustment).
9. Recreational vehicle parks in accordance with Section 18.60.250 (board of adjustment).
10. Site-specific rezones in accordance with Section 18.78.020 (planning commission
recommendation).

"Definitions": “Lot coverage” means the total area, at ground
level, of the principal building and all accessory buildings and
structures.
