Provo City Planning Commission Report of Action May 14, 2025 ITEM 1 Guilford A Rand requests a Conditional Use Permit to allow a reception center use (SLU 6299) in an existing commercial building in the CG (General Commercial) Zone, located at 1595 N Freedom Blvd. Carterville Neighborhood. Nancy Robison (801) 852-6417 PLCUP20240244 The following action was taken by the Planning Commission on the above described item at its regular meeting of May 14, 2025: APPROVED WITH CONDITIONS On a vote of 5:0, the Planning Commission approved the above noted application, with the following conditions: Conditions of Approval: 1. A business license is obtained and maintained. 2. The applicant must have a valid lease agreement for the extra 22 parking spaces as long as the business is operating. The extra spaces are from the property to the south. Parcel number 19:068:0033 3. The occupancy is capped at 152 persons, using the calculation One (1) space per four (4) persons based on the maximum allowable occupancy. Provo City Code 14.37.060 4. The center is allowed to operate until 10:00 pm. 5. Temporary signage is placed to define allowed parking areas during high volume events. Key issues raised in written comments received subsequent to the Staff Report or public comment during the public hearing included the following: Page 1 of 2 • They would not like it to become an event center that will create problems like the Enigma or the Experience Event Center. • Many comments were made about the quality of the Beehive Bazaar and that they had attended it themselves. • Comments were also made that they appreciated what the Bazaar did to help and encourage young artists or entrepreneurs. • Many people appreciate the way the business owners have run events in the past in different locations. That they were good neighbors, clean, and dedicated to making it a great experience. • Commentors felt that having this business here would improve Provo and using this location will also improve an eyesore that has remained vacant for several years. APPLICANT RESPONSE Key points addressed in the applicant's presentation to the Planning Commission included the following: • They would like to have a permanent location for their Bazaar, and feel they will create a nice event center that could be used for weddings, workshops and even a place where sets could be temporarily installed for the entertainment industry. (Television, Movies etc.). • They want to be good neighbors so they will do what they can to keep parking on their lot and the adjoining one to the south. PLANNING COMMISSION DISCUSSION Key points discussed by the Planning Commission included the following: • Planning commission members are enthusiastic about seeing an eyesore leave Provo and for the Bazaar to move into a permanent location. • Several members have been to that event and have children who have participated in it. They also had great experiences with both. • Discussion was raised about an alleyway to the south of the property, and staff said they would look into that property and how to fix any problems. • The planning commission discussed adding temporary signage about parking to keep vehicles coming to the event space out of the neighborhoods to the north and west. PLANNING COMMISSION DISCUSSION Key points discussed by the Planning Commission included the following: • Allowing this will help ensure that there is owner occupancy. • There are less than fifty properties that this amendment could apply to, and not all of them would need to make use of it. • This is a good incentive for keeping properties on the Historic Register. • Historic properties with garages would potentially be able to use the existing garage space for an ADU. Planning Commission Staff Report Item 1 May 14, 2025 Page 2 OVERVIEW The applicant requests a conditional use permit to operate a multi-use event space. The proposed uses include a handmade craft market three times a year, as well as utilizing the facility for receptions, family gatherings and corporate events. This property has been vacant for some time, and accepting this proposal will reuse an existing commercial building. The applicants have signed a two-year contract to lease 22 spaces from the property owners to the south. Two of those spaces will be used to create egress from the property to maintain the flow of traffic. The other 20 will be for parking. This would limit the occupancy to 152 individuals to be in compliance with Provo City code. The property to the south (Ihub) includes approximately 42,000 sq feet, which would require them to have 70 parking spaces. They currently have 165 parking spaces so they will continue to have adequate parking for their use. It is important to note that this conditional use permit would not be considered the same as a dance hall. It would be treated as an event center. This project aligns with the continuing need for community event space and will enhance the area with added economic and social opportunities. By signing below, the applicant acknowledges that the facility may not be used as a dance hall. FINDINGS OF FACT 1. The subject property is zoned General Commercial (CG). 2. The parking stalls are limited to 38 so the occupancy will be capped at 152 individuals. (According to Provo City code 14.37.060 Parking spaces required for the equivalent of an event space.) 3. All CRC issues have been resolved. 4. The applicant has a lease agreement with the property owners to the south for a period of two years. This lease agreement would need to be renewed as long as the business is operating. 5. The applicant will need to acquire a business license. STAFF ANALYSIS Conditional Use Permits are subject to compliance with 14.02.040. Responses are in bold. The ordinance, in part, is as follows: (1) The Planning Commission may, subject to the procedures and standards set forth in this Chapter, grant, conditionally grant, or deny an application for a Conditional Use Permit for uses allowed by the chapter for the applicable zone. The purpose of a Conditional Use Permit is to allow proper integration of uses into the community which may only be suitable in specific locations and may have potentially detrimental characteristics if not properly designed, located, and conditioned. (2) The following standards shall apply to any request for a Conditional Use Permit: Planning Commission Staff Report Item 1 May 14, 2025 Page 3 (a) A proposed conditional use shall be granted unless the subject use will be detrimental to the health, safety, or general welfare of persons residing in the vicinity or injurious to property in the vicinity. The subject property has direct access to Freedom Blvd. It seems unlikely that patron traffic would impact Moon River Drive. The subject property is in an existing commercial zone. The closest residential use, a duplex, is approximately 110 feet away to the east. Due to these factors, staff believe the proposed multi-use event space will not be detrimental to the health, safety, or general welfare of persons residing in the vicinity or injurious to property in the vicinity. (b) A proposed conditional use shall be detrimental to the health, safety, or general welfare of persons residing in the vicinity or injurious to property in the vicinity: (i) if the proposed use will cause unreasonable risks to the safety of persons or property because of vehicular traffic or parking, large gatherings of people, or other causes; The proposed operation will not cause unreasonable risk to the safety of persons or property because of vehicular traffic for the reasons listed above. On-site parking meeting code requirements with a lease for additional spaces. (ii) if the proposed use will unreasonably interfere with the lawful use of surrounding property; The proposed use will not unreasonably interfere with the lawful use of surrounding property. The applicant’s property is sufficient for the operation. The property is surrounded by commercial uses on all the adjacent land. (iv) if the proposed use will in any other way be detrimental to the health, safety or general welfare of persons residing in the vicinity or injurious to property in the vicinity. The proposed use will not be detrimental to the health, safety or general welfare of persons residing in the vicinity or injurious to property in the vicinity. (c) A change in the market value of real estate shall not be a basis for the denial of a proposed conditional use. The proposed use will not likely affect the market value of real estate in the vicinity as the property has been zoned for commercial uses for many years. (d) If a part of a proposed conditional use is found to be contrary to the standards Planning Commission Staff Report Item 1 May 14, 2025 Page 4 described in this section, the applicant may propose or consent to curative measures which will make the proposed use not contrary to the standards described in this section. The proposed use is not contrary to the standards described herein. CONCLUSIONS Based on the foregoing Findings of Facts and Staff Analysis, staff recommend approval of the requested Conditional Use Permit for Beehive Bazar LLC with the following conditions: • That the occupancy is capped at 152 persons. • That the applicant obtains the correct business license prior to operating. • That the applicant keeps a valid lease agreement for the extra 22 parking spaces as long as the business is operating. • Hours of operation are clearly defined. Planning Commission Staff Report *Item 2 May 14, 2025 Page 2 BACKGROUND The applicant owns a property that is on Provo’s Historic Landmark Register. The property is in an area that allows accessory dwelling units (ADU), and she would like to establish one. One of the requirements for parking spaces to be counted on a driveway is that the driveway leads to the required covered parking (garage or carport). Like many historic properties, there is not an existing carport or garage on the property that meets code. Rather than trying to add a new carport to the historic property, staff suggested another approach would be to amend the City Code. CODE ANALYSIS Sec. 14.020.020(2) establishes criteria for the amendments to the zoning title as follows: (Staff response in bold type) Before recommending an amendment to this Title, the Planning Commission shall determine whether such amendment is in the interest of the public and is consistent with the goals and policies of the Provo City General Plan. The following guidelines shall be used to determine consistency with the General Plan: (a) Public purpose for the amendment in question. Staff response: The purpose of the amendment is to allow ADUs in historically significant buildings with minimal impact to the historic integrity of the property. This achieves two goals; increasing ADUs where they are allowed by zoning and to preserve the historic integrity of Landmark properties. Additionally, the required off-street parking would be provided. (b) Confirmation that the public purpose is best served by the amendment in question. Staff response: The amendment will allow property owners with historic properties to be able to establish legal ADU’s where they are already allowed without needing to add new structures on the property that may detract from the historic character. This will help alleviate new development pressures to alter historic properties which will encourage efforts to preserve these community assets. (c) Compatibility of the proposed amendment with General Plan policies, goals, and objectives. Staff response: This amendment aligns with, and helps carry out, goals in the General Plan including: Chapter 4.1c Continue to examine zoning solutions in certain locations to promote Accessory Dwelling Units in residential areas. Chapter 4.2c. Encourage "affordability through design" by using the best practices to improve efficiency in building and land use. (d) Consistency of the proposed amendment with the General Plan’s “timing and sequencing” provisions on changes of use, insofar as they are articulated. Planning Commission Staff Report *Item 2 May 14, 2025 Page 3 Staff response: The proposed amendment to the ordinance does not conflict with and timing and sequencing of the General Plan. (e) Potential of the proposed amendment to hinder or obstruct attainment of the General Plan’s articulated policies. Staff response: Staff does not see any potential conflicts from the proposed amendment with the General Plan policies. (f) Adverse impacts on adjacent landowners. Staff response: No adverse impacts would be expected for adjacent landowners. (g) Verification of correctness in the original zoning or General Plan for the area in question. Staff response: N/A (h) In cases where a conflict arises between the General Plan Map and General Plan Policies, precedence shall be given to the Plan Policies. Staff response: No conflicts exist between the map and plan in relation to the proposed amendment. STAFF ANALYSIS Adding a new structure on a landmarked property is generally not desired as it may unnecessarily impact or alter the original historic setting and character of the property or detract from the original design and layout of the historic structure. We want to encourage the use and upkeep of our historic structures and not require things that would detract from the original character. The proposed amendment (attachment 1) would add text in chapter 14.30 – Accessory Dwelling Units – to provide an exclusion to the covered parking requirement for historic properties. They would still need to provide the four (4) parking spaces as required in the code. The proposed amendment would not allow ADUs where they are not already allowed. If a landmark property is in an area that currently does not allow an ADU, then this amendment would not change that. This would only be applicable for properties that are on the historic register and are also found in a zone that would allow an ADU, and all the requirements would have to be met. This item does not go to the Landmarks Commission for a recommendation, but the Chair of the Landmarks Commission has provided a personal letter of support (attachment 2) for this proposed text amendment. Currently, Provo has 47 homes that are on the Landmarks register and are in zones or areas where ADUs are permitted by right. Planning Commission Staff Report *Item 2 May 14, 2025 Page 4 CONCLUSION The proposed text amendment is something that staff supports as it will help to preserve the historic setting around historic homes and not detract from them with new additions. The parking that is required by code will still be provided and it will not allow ADU’s in areas where they are not already allowed. The public purpose will be to help ensure that we are encouraging preservation and allowing for full use of the property while keeping adequate off-street parking. STAFF RECOMMENDATION Recommend approval to the Municipal Council for the proposed ordinance text amendment to Provo City Code 14.30, to allow for homes on the Landmarks Registry to be exempt from providing covered parking structures for Accessory Dwelling Units. ADUs shall be subject to the following development standards: … (5) Parking. A one (1) family dwelling with an ADU shall have at least four (4) off-street parking spaces. (a) Two (2) tandem parking spaces (front to rear) shall be permitted when the front and back spaces are both designated to serve either the ADU or the principal part of the dwelling unit. (b) Parking spaces for a one (1) family dwelling with an associated ADU may be located on a driveway in a required front yard, provided the driveway leads to the minimum number of required covered off-street parking spaces. This change will provide an exemption from the requirement of covered parking structures for accessory dwelling units on properties listed in the Landmarks Registry. I believe this amendment will be beneficial in preserving open space and reducing visual clutter around our historic buildings.
