AGENDA FOR THE REGULAR MEETING OF BOARD OF TRUSTEES, HELD ON FRIDAY, JANUARY 19, 2024 AT 4:00 P.M. PRESENT: OTHERS PRESENT: The Pledge of Allegiance. Approval of Minutes of Regular Meeting held on December 15, 2023. Motion By: Seconded: Approval of Abstract of Audited Vouchers Schedule 01-24, $xx and Treasurer’s Report for the Month ending December 31, 2023: $ 181,280.46 General Account $ 8,147,669.08 General Investment $ 959,938.75 Capital Reserve $ 500,000.00 Compensating Balance $ 3,132,783.03 Class General Account $ 329,622.82 Scrub Oak Renovation Bond Proceeds $13,251,294.14 Total 12/31/2023 Motion By: Seconded: Clerk’s report for December 2023 False Fire and Burglar Alarms: Fire Billed: $1,200; Fire Collected: $650 Burglar Billed: $375; Burglar Collected: $900 Departmental Monthly Reports: Fire Department Building Department Police Department Resolution to approve that the General Village Election of the Village of Quogue, New York will be held on Friday, June 21, 2024. The polling place for the 2024 General Village Election shall be at the Quogue Firehouse, Jessup Avenue, Quogue, New York. The polls shall open at 12:00 noon and close at 9:00 p.m. prevailing time and the offices to be filled at said General Village Election and the terms thereof are as follows: Mayor- one (1) for the term of two (2) years Trustees – two (2) for the term of two (2) years Motion By: Seconded: Resolution to approve that the certified amount of unpaid Village taxes for the fiscal year 2023-2024 submitted by the Treasurer of the Village of Quogue, and as provided in Section 1454 of the Real Property Tax Law of the State of New York, has been compared with the original tax roll and has been found to be correct and the amount of unpaid taxes is $19,185.24 and further to approve that the unpaid village taxes for such fiscal year will be sold by Public Tax Sale at which sale certificates of tax liens for such unpaid taxes shall be properly sold with interest and advertising fee ($25); such tax sale shall be held in the manner provided by law, at 9:15 A.M. on Tuesday, March 12, 2024 and notices of such tax sale to be published in the Southampton Press-Western Edition for three (3) consecutive weeks in issues dated 2/22/2024, 2/29/24, and 3/7/2024 in accordance with statutory law. Motion By: Seconded: Resolution to accept the certification from the Quogue Fire Department as to the members and points they received in 2023 under the Quogue Fire Department Service Award Program Point System and to direct the Fire Department to post it for at least 30 days as required by law and to resubmit it at the end of such period with any changes. Motion By: Seconded: Resolution to authorize expenditures from the Fire Department Capital Reserve Fund, subject to a permissive referendum, of up to an additional $20,000 for additional expenses related to the upfitting of the Ford F-150 Super Crew 4x4 SSV. Inc. in the amount of $35 for shipping 17296 Witmer Public Safety Group Inc in the amount of $19.94 for shipping and small price increase 17274 Barnwell House of Tires in the amount of $71.76 for a price increase Motion By: Seconded: Resolution to approve the following payments from H4200200 Road Improvements: Chip’s Evergreen Landscape & Lawn Care – $20,888.75 – Ogden Lane Project The Raynor Group - $947.50 – Ogden Lane Roadway Improvements The Raynor Group - $250.00 – Jessup Avenue Road Reconstruction Motion By: Seconded: Resolution to approve the following transfers: From A3620210 Safety Inspection/Furniture to A3620411 Safety/Supplies & Materials in the amount of $,1000.00 From A3620210 Safety Inspection/Furniture to A362049 Safety Insp/Misc. in the amount of $500.00 From A1420400 Law/Contract.Vill.Attny to AA1420410 Law/Codification in the amount of $2,500.00 Motion By: Seconded: Resolution to authorize an intermunicipal agreement with the Suffolk County Planning Commission. Whereas, General Municipal Law (GML) § 239 requires the referral of certain proposed planning and zoning actions to the Suffolk County Planning Commission by local Towns and Villages within the County, and Whereas, GML also allows for the County to enter into an agreement with a referring body or other duly authorized body of a Town or Village to provide that certain proposed actions be deemed matters of local rather than inter-community or county-wide concern and, therefore, not subject to referral, and Whereas, the Village of Quogue has proposed a litany of actions which are consistent with the intent of GML and represent matters of local not county-wide concern, and Whereas, the adoption of an inter-municipal agreement would streamline the referral review process without any compromise to county-wide or inter-community planning considerations, now therefore be it Resolved, that pursuant to the above the Suffolk County Planning Commission considers the following list of actions to constitute matters of local determination which are NOT subject to the referral process: □ All area variances associated with single-family residences. □ Change of one permitted use to another with no changes in parking requirements (i.e. retail to office). □ Minor additions less than 1,000 square feet with no change to use or occupancy. □ Site plan applications proposing less than 5,000 square feet of new or renovated floor area or less than 10,000 square feet of land disturbance. Exception – actions that have been given a Positive Declaration pursuant to SEQR or actions involving property abutting state or county parkland, the Atlantic Ocean, Long Island Sound, any bay in Suffolk County or estuary of any of the foregoing bodies of water shall be subject to the full review process. Resolved, That the Village Clerk is directed to forward a copy of this resolution to the Suffolk County Planning Commission and to the Planning Board and Zoning Board of Appeals of the Village of Quogue. Motion By: Seconded: RESOLVED, that the Board of Trustees of the Village of Quogue hereby directs that a public hearing shall be held on Friday, February 16, 2024 at 4:00 p.m. prevailing time, at the Village Hall, Jessup Avenue, Quogue, New York, to hear any and all persons either for or against a local law entitled: “A LOCAL LAW authorizing a Property Tax Levy in excess of the limit established in General Municipal Law §3-c.” Attached hereto as Exhibit A AND BE IT FURTHER RESOLVED, that the Village Clerk is hereby authorized and directed to publish the following Notice of Public Hearing: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that the Board of Trustees of the Village of Quogue hereby directs that a public hearing shall be held on Friday, February 16, 2024 at 4:00 p.m. prevailing time, at the Village Hall, Jessup Avenue, Quogue, New York, to hear any and all persons either for or against a local law entitled: “A LOCAL LAW authorizing a Property Tax Levy in excess of the limit established in General Municipal Law §3- c.” Pursuant to §103-a of the New York State Public Officer’s Law and Local Law No. 3 of 2022, the meeting of the Board of Trustees and aforementioned public hearing will be held in person, or it may be held as a hybrid meeting in a combination of both in-person and videoconference (i.e. ZOOM). Notice whether the meeting will be held as a hybrid meeting and the access requirements of such remote meeting platform may be obtained from the Village Clerk. Copies of the proposed law are on file in the Village Hall and may be reviewed during normal business hours. Motion By: Seconded: WHEREAS, Board of Trustees of the Village of Quogue have proposed a local law amending Chapter 168 (Taxation) of the Village Code to add a new Article VIII establishing a tax exemption for income eligible senior citizens; and WHEREAS, a public hearing was held on January 19, 2024; and WHEREAS, the adoption of said local law is considered to be a Type II action under 6 NYCRR §617.5(c), SEQRA and will not have a significant adverse impact upon the environment; NOW, THEREFORE, BE IT RESOLVED, that Local Law No. __ of 2024 is hereby adopted as attached Exhibit B.
