The New River City 10 Robertson St. February 26, 2018 Radford, Virginia Regular Meeting Number 11 of Radford City Council, F.Y. 2017-2018 The regular meeting of the Radford City Council was convened at 7:00 p.m. in Council Chambers, 10 Robertson Street, Radford, VA. The Mayor of the City, Dr. Bruce Brown was present and presiding. Other members of City Council present were Mr. Robert Gropman, Dr. Richard Harshberger, Mr. Daniel Keith Marshall, and Mr. Michael Turk. Others present were as follows: Mr. David Ridpath, City Manager Ms. Jenni Wilder, City Clerk Ms. Melissa Skelton, Deputy City Clerk/Community Development Director Following the Pledge of Allegiance, led by local Veterans, Rev. McCandlish led the invocation. MINUTES APPROVALS: On a motion by Mr. Gropman and seconded by Mr. Marshall that the minutes for the February 12, 2018 Regular Meeting are approved as presented. VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 OLD BUSINESS SUBJECT: Ordinance #1699 – Zoning Ordinance Amendment: SUMMARY: The Planning Commission requested that section 120.1 -23 (1) of the Zoning Ordinance be amended to permit “Recreational Vehicle Parks” within the Conservation District with an approved Special Use Permit. The amendment would complement outdoor development planning and tourism efforts. A Public Hearing was held on January 8, 2018 with no comments. The Planning Commission considered the Ordinance at its meeting and public hearing on February 5, 2018. The Planning Commission approved the Ordinance and has recommended City Council approval. City Council approved the first reading on February 12, 2018. ACTION: Dr. Harshberger moved to approve and adopt Ordinance 1699 as presented, Mr. Marshall, seconded the motion. VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 CITIZEN COMMENTS: No Comments NEW BUSINESS: SUBJECT: Facility Use Agreement – Radford City Schools: SUMMARY: The City of Radford shares facility use at Veterans Field (New River Drive), the Radford Municipal Baseball Field (George Street), the Bobcat Trail (George Street) and now the Armory Fieldhouse (Scott Street) with Radford City Schools. A use agreement has been developed that includes property maintenance, scheduling, insurance, notices and permitted uses. Generally, the uses are sports training, recreation, physical education and various school sponsored events. The agreement formalizes current practices and is established for an initial two years. The School Board Attorney and Superintendent have reviewed the agreement with Sands Anderson. ACTION: Dr. Harshberger moved to approve the agreement as presented, Mr. Turk, seconded the motion. VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 SUBJECT: Budget Amendment – Radford City Schools: SUMMARY: Radford City schools have requested an amendment to their F.Y. 2018 Budget. The amendment is necessary to incorporate grant revenue they have received, as well as a capital projects carryover balance from F.Y. 2017. The total amount of the Amendment is $473,488. ACTION: Mr. Marshall moved to approve the Budget Amendment on the first reading Mr. Gropman, seconded the motion. VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 SUBJECT: Appropriation Ordinance #1691.22 – School Capital Reserves: SUMMARY: Radford City Schools have requested that $220,000 be transferred from the School Board Reserve Fund to their Capital Projects Fund. The funds will be used for classroom instruction, Architectural services, building improvements and technology. ACTION: Mr. Marshall moved to approve Appropriation Ordinance 1691.22 on the first reading Mr. Turk, seconded the motion. VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 ACTION: Mr. Gropman moved to approve and adopt Appropriation Ordinance 1691.22 on the second reading Mr. Marshall, seconded the motion. VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 CITY MANAGERS COMMENTS: Mr. Ridpath asked the public to be patient with crews as they have had to make many utility cuts in the roads and have been patching those with hot patch until asphalt companies open. Mr. Ridpath also mentioned the recycling and dump site will be moving locations in April and to stay tuned to the website for more details. CITY COUNCIL COMMENTS: Dr. Harshberger gave a Factoid: Radford can be considered the safest community in the region. Mayor Brown mentioned the light change at Wadsworth Street and Eight Street and Mr. Ridpath explained the changes noting to go to the website for full details. Mr. Marshall made a motion, seconded by Mr. Turk to convene a closed meeting for the purpose Discussion or consideration of the acquisition of real property for a public purpose, or of the disposition of publicly held real property, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body. Virginia Code Section 2.2-3711 (A) (3). Consultation with legal counsel and briefings by staff members or consultants pertaining to actual or probable litigation, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating posture of the public body; and consultation with legal counsel employed or retained by a public body regarding specific legal matters requiring the provision of legal advice by such counsel. For the purposes of this subdivision, "probable litigation" means litigation that has been specifically threatened or on which the public body or its legal counsel has a reasonable basis to believe will be commenced by or against a known party. Nothing in this subdivision shall be construed to permit the closure of a meeting merely because an attorney representing the public body is in attendance or is consulted on a matter. Virginia Code Section 2.2-3711 (A) (7). VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 No action was taken in the closed meeting. Mr. Marshall made a motion to adjourn the closed meeting, Mr. Turk seconded the motion. VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 Mr. Marshall made a motion to re-convene the regular meeting, Mr. Turk seconded the motion. VOTE: AYES: Mr. Gropman, Dr. Harshberger, Mr. Marshall, Mr. Turk, Mayor Brown NAYES: None-0 CERTIFICATION OF THE CLOSED MEETING: Mr. Marshall made a motion that Council did not discuss anything in the closed meeting other than the two items for which it was convened, Mr. Turk seconded the motion.
