MUNICIPAL COUNCIL - CITY OF RAHWAY, NEW JERSEY
SPECIAL MEETING
April 24, 2020 ~ 2:30 P.M.

Council President Mojica called the meeting to order at 2:30 p.m. and read the Roll Call.
ROLL CALL
Present: Rodney Farrar, Michael Cox, Robert “Bob” Bresenhan Jr.,
David Brown, Joseph D. Gibilisco,
Joanna Miles Jeremy E. Mojica
Absent: James Baker, Danielle “Danni” Newbury
PLEDGE OF ALLEGIANCE
Council President Mojica led the Pledge of Allegiance.
OPEN PUBLIC MEETING STATEMENT:
City Clerk Rayna E. Harris announced the meeting had been advertised and posted in accordance with the Open
Public Meetings Act of the State of New Jersey.
This Meeting was called pursuant to the provisions of the Open Public Meetings Act. Notice of this meeting was
sent to the Union County Local Source, Home News Tribune, and the Star Ledger. In addition, copies of notice
were posted on the bulletin board in the Municipal Building and filed in the Office of the City Clerk. Notices on the
bulletin board have remained continuously posted. Proper notice having been given; the City Clerk is directed to
include this statement in the minutes of this meeting.
RESOLUTIONS
AR-116-20 RESOLUTION OF THE CITY OF RAHWAY, IN THE COUNTY OF UNION, NEW JERSEY,
ESTABLISHING THE RATE OF INTEREST FOR DELINQUENT TAXES
Motion to adopt Resolution AR-116-20 was made by Councilmember Mojica, seconded by the
City Council and by the following vote:
YES: Councilmembers Bresenhan, Brown, Cox, Farrar, Gibilisco, Miles, Mojica
ABSENT: Councilmembers Baker and Newbury
Council President Mojica declared the motion carried.

RESOLUTION OF THE CITY OF RAHWAY, IN THE COUNTY OF UNION, NEW JERSEY,
ESTABLISHING THE RATE OF INTEREST FOR DELINQUENT TAXES

WHEREAS, N.J.S.A. 54:4-67a permits the governing body by resolution to fix the rate of interest to be
charged for the nonpayment of taxes, assessments, or other municipal liens or charges, on or before the date when
they would become delinquent; and
WHEREAS, the statute fixes the rate of interest cannot exceed 8% per annum on the first $1,500.00 of the
delinquency and 18% per annum on any amount in excess of $1,500.00, to be calculated from the date the tax was
payable until the date that actual payment to the tax collector is made; and
WHEREAS, the City of Rahway adopted resolution # AR-05-20 setting the Rate of Interest for Delinquent
Taxes on January 7, 2020, and
WHEREAS, due to the COVID-19 pandemic and the State and Federal declarations of a major disaster
throughout New Jersey, the governing body of the City of Rahway wishes to change the rate of interest for future
delinquent tax payments.
NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the City of Rahway, County of
Union, State of New Jersey that the rate of interest for taxes unpaid on or after May 10, 2020 is fixed at 0.000001%
on the first $1,500.00 of delinquency and 0.000001% per annum on any amount of taxes in excess of $1,500.00
effective May 1, 2020; and
BE IT FURTHER RESOLVED that the rate of interest for taxes unpaid shall be calculated from date of
the quarterly payment until the date of actual payment; and
BE IT FURTHER RESOLVED, this Resolution shall be published in its entirety once in the official
newspaper of the City of Rahway and a copy of this adopted Resolution forwarded to the Division of Local
Government Services in the Department of Community Affairs
BE IT FURTHER RESOLVED, effective June 1, 2020 the rate of interest for taxes unpaid after June 10,
2020 is fixed at 8% on the first $1,500.00 of delinquency and 18% per annum on any amount of taxes in excess of
$1,500.00 effective June 1, 2020.
COMMUNICATIONS: Hearing of Citizens on Any Item (Five Minutes per Speaker)
With no one appearing, Council President Mojica closed the public hearing.
ADJOURNMENT
The meeting was adjourned at 2:33 p.m. without objection on a voice vote.
