7 MINUTES MUNICIPAL COUNCIL – CITY OF RAHWAY, NEW JERSEY SPECIAL MEETING May 19, 2021 - 6:30 pm Via Zoom “Each person addressing the Council shall first give their name and address to the Clerk. All remarks shall be addressed to the Council as a body and not to any member thereof and, shall not exceed five (5) minutes in duration.” (Chapter 5-63 (C) Rules of Order No. 3) Council President Newbury called the Meeting to order at 6:30 PM and had City Clerk, Jeff Jotz, read the Roll Call. ROLL CALL Present: David Brown, Rodney Farrar, Joseph D. Gibilisco, Danielle “Danni” Newbury, Vannie Deloris Parson, Joanna Miles, Jeremy E. Mojica Absent: James E. Baker, Michael Cox PLEDGE OF ALLEGIANCE Council President Danielle “Danni” Newbury led the Pledge of Allegiance. OPEN PUBLIC MEETINGS STATEMENT City Clerk Jotz announced the meeting had been advertised and posted in accordance with the Open Public Meetings Act of the State of New Jersey. Notice of this meeting has been sent to the official newspapers and adequate and electronic notice has been provided in accordance with the Open Public Meetings Act and New Jersey Administrative Code, Title 5, Chapter 39-Section 1.5 (N.J.A.C. 5:39-1.5) notice of remote public meetings as required by law. ORDINANCES – FIRST READING O-22-21 AN ORDINANCE AMENDING CHAPTER 97 “SPECIAL IMPROVEMENT DISTRICTS” OF THE CODE OF THE CITY OF RAHWAY Motion to introduce the above titled Ordinance O-22-21 on first reading was made by Councilmember Newbury, seconded City Council and adopted by the following vote: YES: Councilmembers Brown, Farrar, Gibilisco, Newbury, Parson, Miles, Mojica ABSENT: Councilmember Baker, Cox Council President Newbury declared the motion carried O-23-21 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14) Motion to introduce the above titled Ordinance O-23-21 on first reading was made by Councilmember Newbury, seconded City Council and adopted by the following vote: YES: Councilmembers Brown, Farrar, Gibilisco, Newbury, Parson, Miles, Mojica ABSENT: Councilmember Baker, Cox Council President Newbury declared the motion carried Introduction Statement: Having been declared adopted on first reading, the City Clerk is hereby authorized and directed to advertise said notice of introduction and passage according to law. The Public Hearing, second reading, and further  7 action will take place at a Council Meeting on June 14, 2021 at 7 p.m. or at any time and place to which the meeting for the further consideration of the ordinances shall be adjourned. Councilmember Cox arrived at 6:07 pm. CONSENT AGENDA All items listed without an asterisk (*) are considered routine by the City Council and will be enacted by one motion. There will be no separate discussion on these items unless a Council Member so requests. Any item not included on the Consent Agenda will be considered in its normal sequence on the Agenda. Motion made by Councilmember Mojica and seconded by Councilmember Cox to adopt the Consent Agenda. The Motion was adopted by the following vote: YES: Councilmembers Brown, Farrar, Cox, Gibilisco, Newbury, Parson, Miles, Mojica ABSENT: Councilmember Baker Council President Newbury declared the motion carried. RESOLUTIONS Dept. of Administration *AR-143-21 RESOLUTION AUTHORIZING THE FILING OF A TREATMENT WORKS APPLICATION WITH THE STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION – MAIN STREET, BLOCK 318.01 & LOT 1.01 Motion to introduce the above titled Resolution was made by Councilmember Brown, seconded by Gibilisco and adopted by the following vote: YES: Councilmembers Brown, Cox, Farrar, Gibilisco, Newbury, Parson, Miles, Mojica ABSENT: Councilmember Baker Council President Newbury declared the motion carried. Councilmember Cox arrived at 6:34 pm. Dept. of Finance *AR-144-21 RESOLUTION AUTHORIZING THE INTRODUCTION OF THE CY 2021 MUNICIPAL BUDGET Motion to introduce the above titled Resolution AR-144-21 on first reading was made by Councilmember Newbury, seconded by the Entire Council and adopted by the following vote: YES: Councilmembers Brown, Cox, Farrar, Gibilisco, Newbury, Parson, Miles, Mojica ABSENT: Councilmember Baker Council President Newbury declared the motion carried. Introduction Statement: Having been declared adopted on first reading, the City Clerk is hereby authorized and directed to advertise said notice of introduction and passage of the Municipal Budget according to law. The Public Hearing, second reading, and further action will take place at a Council Meeting on June 17, 2021 at 6:30 p.m. or at any time and place to which the meeting for the further consideration of the ordinances shall be adjourned. *AR-145-21 A RESOLUTION PROVIDING FOR THE UTILIZATION OF A THREE-YEAR AVERAGE METHOD TO DETERMINE ANTICIPATED REVENUES Motion to introduce the above titled Resolution was made by Councilmember Cox, seconded by Farrar and adopted by the following vote:  7 YES: Councilmembers Brown, Cox, Farrar, Gibilisco, Newbury, Parson, Miles, Mojica ABSENT: Councilmember Baker Council President Newbury declared the motion carried. *AR-146-21 A RESOLUTION PROVIDING FOR THE CANCELLATION OF A SPECIAL EMERGENCY AUTHORIZATION – COVID-19 Motion to introduce the above titled Resolution was made by Councilmember Mojica, seconded by Miles and adopted by the following vote: YES: Councilmembers Brown, Cox, Farrar, Gibilisco, Newbury, Parson, Miles, Mojica ABSENT: Councilmember Baker Council President Newbury declared the motion carried. COMMUNICATIONS: Hearing of Citizens on Any Item (Five Minutes per Speaker) With no one appearing, Council President Newbury closed the Public Hearing. ADJOURNMENT The meeting was officially adjourned at 6:40 PM without objection on a voice vote.
