ZONING BOARD OF ADJUSTMENT REGULAR MEETING MINUTES SEPTEMBER 21, 2020 CALL TO ORDER The Zoning Board of Adjustment of the City of Rahway held its regularly scheduled meeting Monday, September 21, 2020 via electronic communications equipment. Pursuant to the provisions of the New Jersey Open Public Meetings Act, N.J.S.A. 10:4-8(b), this meeting was held via Zoom. Due to the SARS-CoV-2 pandemic, commonly known as the novel coronavirus disease 2019 (COVID-19). The meeting was called to order at 7:04 p.m. ______________________________________________________________________________ FLAG SALUTE The Board saluted the flag. ______________________________________________________________________________ ROLL CALL On a call of the roll, the following Board Members and Officials should be present: BOARD Ms. Joann Gemenden, Commissioner Ms. Marie Richelieu, Commissioner Mr. Brandon Givens, Commissioner Mr. James Heim, Commissioner Mr. Adrian Zapotocky, Commissioner Ms. Jelsie Basso, 1st Alternate Commissioner Mr Richard Zdan 2nd Alternate Commissioner Mr. William Tomkiewicz, 3rd Alternate Commissioner Mr. Roy Smith, 4th Alternate Commissioner Mr. William Hering, Commissioner / Chairman Mr. James E. Pellettiere, Commissioner / Vice Chairman Mr. Mark Moon, Esq, Board Attorney Ms. Jacqueline Dirmann, City Engineer Mr. Kevin O’Brien City Planner Mrs. Ann Marie Williams, Board Secretary *Absent from this meeting were Commissioners Givens, Richelieu, Heim and Basso. ZONING BOARD OF ADJUSTMENT MEETING MINUTES SEPTEMBER 21, 2020 _______ PAGE TWO REGULAR MEETING: Chairman Hering opened the meeting at 7:04 pm with the regulations and reading of the agenda into the record. The following action took place. Chairman Hering opened the floor to the Board Attorney Mark Moon to discuss application titled Gyaan Ka Saagar for a Proposed Place of Worship with One Apartment Residence using a Minor Site Plan, Use (“D”) Variance, Bulk (“C”) Variance. Applicant was on the September Agenda. Moon spoke to the attorney of the applicant who advised there were going to revise the application specific to the Apartment, the scope, and the drawings. The applicant wishes to carry over the application to the October meeting. They will be submitting amended drawings and sending new notices. Commissioner Zapotocky asked that a drawing of the exterior be included in the new submissions. There were individuals from the public who were online. Chairman Hering allowed them to introduce themselves. Renea Williams of 887 E Hazelwood Ave. She advised that when they were having worship the entire street was blocked inclusive of driveways. Worship center also utilized the factory parking lots for valet parking with over 100 people and it was chaos. Moon advised that the application was being carried over to October and she will have an opportunity to speak then. Wilbert Jackson of 1368 Witherspoon St. He agreed with Ms. Williams. He is on the other end of the block and was looking forward to being heard at the next meeting. Darleen Plunkett of 1362 Witherspoon St. She advised that other residents were notified of the meeting and she was not. Chairman confirmed it was because she was outside of the 200 feet; however, everyone would be given an opportunity to speak at the next meeting Laura Bellevue of 1430 Witherspoon St. She advised she had issues logging on because the information was incorrect. Moon advised that the applicant did in fact re notice. ZONING BOARD OF ADJUSTMENT MEETING MINUTES SEPTEMBER 21, 2020 _______ PAGE THREE MEMORIALIZATIONS: Motion to approve the resolution of the Zoning Board of Adjustment of the City of Rahway memorializing the action of the Board approving the application of Anatoliy Girkhovskiy for approval of a Use “D1” Variance. Motion: Commissioner Zdan Second: Commissioner Zapotocky Yes: Commissioners Gemenden, Zapotocky, Zdan, Tomkiewicz and Hering No: none Abstain: Commissioners Smith and Pellettiere Absent: Commissioners Givens, Richelieu, Heim and Basso Resolution was Memorialized Motion to approve the resolution of the Zoning Board of Adjustment of the City of Rahway memorializing the action of the Board approving the application of Optimum Care Medical Transport for Preliminary and Final Major Site Plan Approval with a Conditional Use Variance and Bulk “C” Variances.
