REGULAR MEETING MINUTES SEPTEMBER 2, 2014 THE REGULAR MEETING OF THE RICHMOND CITY COUNCIL WAS CALLED TO ORDER AT 7:04 P.M., ON TUESDAY, SEPTEMBER 2, 2014, AT THE HISTORIC SCHOOL HOUSE IN BAILEY PARK, BY MAYOR RIX. ROLL CALL Present: Goodar, Greene, LaFore, Misteravich, Rix, Schultz, Yaroch Absent: None Others: City Manager Moore, City Clerk Stagl Visitors: City Planner Jeschke, DPS Director Goetzinger, Library/Recreation Director Kammer, Ken Kingsley, Christine Rowley APPROVAL OF MINUTES Motion by Yaroch, seconded by Greene, to approve the minutes of the August 18, 2014, regular meeting, as presented. All yeas Motion passes AUDIENCE PARTICIPATION Rix – Thanked the Historical Society for the use of the School House to conduct the Council Meeting. ADOPTION OF AGENDA Motion by Yaroch, seconded by Goodar, to adopt the agenda as presented. All yeas Motion passes PUBLIC HEARING None scheduled. ITEMS FOR CONSIDERATION 1. Consideration of Adopting Resolution No. 2014-14/Recognition of Constitution Week Motion by Greene, seconded by Yaroch, to adopt Resolution 2014-14, a resolution proclaiming Constitution Week as September 17-23 in the City of Richmond. All yeas Motion passes 2. Consideration of Special Event Request/Chamber of Commerce/Treats in the Street Motion by Greene, seconded by Goodar, to approve the Special Event Permit requested by the Richmond Area Chamber of Commerce for the utilization of the municipal parking lot from 12:00 p.m. to 9:00 p.m. on Friday, October 31st, 2014 for the 9th annual Treats in the Street. Consideration of Adopting Resolution No. 2014-15/Designation of Street Administrator Motion by Goodar, seconded by Schultz, to adopt Resolution 2014-15, designating Jim Goetzinger as the Street Administrator as required by Act 51, Sec 17(7) Public Acts of 1951. All yeas Motion passes 4. Consideration of Special Event Request/Second Chance Network City Manager Moore informed Council that The Second Chance Network, of Warren, was requesting authorization to do an intersection fundraising drive. In reviewing the request, administration came across some discrepancies. In addition to acting on this request, Council was being requested to consider adopting “Guidelines for Soliciting on City Streets”. The proposed guidelines are based on a similar policy recently adopted by the City of Roseville. It allows for the approval of service clubs and non-profit organization located within the City of Richmond or Richmond School District. It also set some guidelines on information that organizations would need to submit and have on file with the City. The City Attorney, Rex Burgess, has reviewed the guidelines and indicated that they looked fine. Administration is recommending the denial of the request from the Second Chance Network, based on the guidelines. Motion by Yaroch, seconded by LaFore, to approve the proposed “Guidelines for Soliciting on City Streets”, with the following language to be added to item #6: Additionally, Worker’s Compensation Insurance is required if the Organization has paid solicitors: Discussion on motion: Extensive discussion on how this additional language may affect Richmond Charities. Most Councilors were not comfortable with the additional language, but would approve the guidelines as they were originally presented. Yaroch indicated that if solicitors are paid to solicit by the organization, they should have worker’s compensation insurance. He further indicated that if an organization would be required by law to provide worker’s compensation insurance, we should require that they supply proof of this insurance. Misteravich – Didn’t feel that we had an issue with this in the City and didn’t want to hinder the local organizations that solicit in the streets. Six yeas (Goodar, Greene, LaFore, Misteravich, Rix, Schultz) One nay (Yaroch) Motion passes Motion by Schultz, seconded by Greene, to deny the request received from the Second Chance Network to conduct an intersection fundraising drive. All yeas Motion passes 5. Consideration of the Purchase of a Recreation Mower Motion by Greene, seconded by Goodar, to approve the purchase of the Gravely ProTurn 160 mower from Ball Equipment for $6,999.00. All yeas Motion passes MISCELLANEOUS MATTERS FROM THE CITY MANAGER - Calendar pages have been forwarded to Council for the scheduling of the Quarterly Roundtable - Wish good luck to the Good Old Days Festival COUNCIL COMMENTS All Councilors wished for good weather and a successful Good Old Days Festival. Councilors thanked the Historical Society for allowing Council to use the Schoolhouse for the Council Meeting. LaFore – Reminded everyone that Richmond had a home game this Friday against Yale.
