APPROVED 11/21/2016 REGULAR MEETING MINUTES NOVEMBER 7, 2016 THE REGULAR MEETING OF THE RICHMOND CITY COUNCIL WAS CALLED TO ORDER AT 7:00 P.M., ON MONDAY, NOVEMBER 7, 2016, BY MAYOR RIX. PLEDGE OF ALLEGIANCE Council Members and the audience present stood for the Pledge of Allegiance and the Invocation. ROLL CALL Present: Allen, Greene, LaFore, Misteravich, Rix, Warn, Yaroch Absent: None Others: City Manager Moore, Recording Secretary Field Visitors: Brian Walmsley, Richmond Community Schools Superintendent Tom Garant, Richmond Fire Chief APPROVAL OF MINUTES Motion by Warn, seconded by Allen, to approve the minutes of the October 17, 2016, regular meeting, as amended. City Manager Moore informed Council that Councilor Greene should have been excused from the October 17, 2016 meeting as she did contact administration that she would be absent due to being out of town. Council was in agreement that the November 7, 2016 minutes would reflect that Councilor Greene was excused. All yeas Motion passes Motion by Warn, seconded by Yaroch, to approve the minutes of the October 18, 2016, quarterly roundtable meeting, as presented. All yeas Motion passes CONSENT AGENDA a) Receive and File October 13, 2016, Planning Commission Meeting Minutes b) Receive and File October 26, 2016, TIFA Meeting Minutes c) Approval of November 3, 2016, Schedule of Bills in the amount of $ 335,910.51 Motion by LaFore, seconded by Misteravich, to approve the Consent Agenda as presented. All yeas Motion passes PUBLIC HEARING None scheduled. ITEMS FOR CONSIDERATION 1. Consideration of Lot Split / Combination Request / Richmond Community Schools Motion by Yaroch, seconded by Allen, to approve the two lot split/ combination actions requested from Richmond Community Schools for Parcel 50-07-06-02-226-003 and 50- 07-06-02-226-005. The actions are listed below: Action #1: Split .256 acres from the Auditorium parcel (50-07-06-02-226-005) on Main St (parcel #1). Action #2: Combine the .256 acre parcel created from the split in Action #1 with the property on Division Rd (50-07-06-02-226-003). Consideration of the Purchase of the Jaws of Life / Fire Department Motion by Yaroch, seconded by Greene, to waive purchasing ordinance requirements and approve the purchase of the extraction equipment in the amount of $27,650 from Apollo Fire Equipment Company. Chief Garant spoke about the benefits of the Hurst “Jaws” that they were faster more flexible and had a longer battery life. A roll call vote was taken: All yeas (Warn, Yaroch, Allen, Greene, LaFore, Misteravich, Rix,) Motion passes 3. Consideration of MABAS / St. Clair County Motion by Yaroch, seconded by Allen, to approve the updated Michigan Mutual Aid Box System Agreement and authorize the Mayor to sign the agreement. All yeas Motion passes 4. Consideration of Rescinding the “Guidelines for Soliciting on City Streets” Motion by LaFore, seconded by Misteravich, to rescind the “Guidelines for Soliciting on City Streets” in order to follow the Attorney General’s Opinion related to the Uniform Traffic Code. Discussion on motion: Rix – This topic was discussed extensively during our quarterly roundtable meeting. Really do not have a choice in this. The Attorney General was asked by a State Senator to look into this issue and we will comply with what the Attorney General states. This is a Tradition that is going away. Yaroch – This is unfortunate for the organizations that depend on fund raising using this method; but officially nobody really had the authority to solicit in the streets. Appears from the opinion that we may not have had the authority to grant permission in the past. It is appropriate to follow the Attorney General guidelines. Misteravich – Concur. Our hands are tied on this subject and has been becoming unsafe for the people in the intersections soliciting. Rix – Disagrees that this was an operation we should not have been doing in the first place. Being addressed because of our drivers today. Greene – It is a slippery slope to allow the State to come in and take away things that are unique about each community. All yeas Motion passes MISCELLANEOUS MATTERS FROM THE CITY MANAGER - Junior Honor Society will be holding their Rake and Run event on Thursday, October 10th from 3 – 6 p.m. - This Thursday at 7:00 p.m. the Planning Commission will be getting public input for their Master Plan. - The new hedge row has been installed for the Pet Section in the City Cemetery. - The City closed on the sale of the house on 69360 Main Street. COUNCIL COMMENTS LaFore – Want to wish Yaroch good luck tomorrow on his run in the State election. Yaroch – Thank you to the Chamber of Commerce for the great job they did for the Treats in the Streets and the Scarecrow Contest. - Would also like to thank Troop 84 of the Richmond Boy Scouts in inviting a Councilor to their meeting. They had some great questions for me. Allen – Good luck tomorrow Yaroch. - Very pleased with the Scarecrow Contest and Ladies Night Out. Greene – Richmond Community Baptist Church has changed their name to Grace Community Church. - Congratulation to the Library on winning the Scarecrow Contest. Wilbur was adorable. - Thank you to the Chamber on the Scarecrow Contest. This seemed to be one of the best years. All the displays held up so nicely and everything was all cleaned up wonderfully. - Hold your elected officials accountable. Misteravich – Concur.
