APPROVED 06/15/2020 REGULAR MEETING MINUTES JUNE 1, 2020 THE REGULAR MEETING OF THE RICHMOND CITY COUNCIL WAS CALLED TO ORDER AT 7:00 P.M., ON MONDAY, JUNE 1, 2020, BY MAYOR RIX; WHO ALSO GAVE THE INVOCATION. ROLL CALL Present: Allen, Greene, LaFore, Misteravich, Reindel, Rix, Warn Absent: None Others: City Manager Moore Visitors: Mark Smola, Keelie Rots, Bradley Rots APPROVAL OF MINUTES Motion by Reindel, seconded by Greene, to approve the minutes of the May 18, 2020, Regular Meeting, as presented. All yeas Motion passes Motion by Warn, seconded by Greene, to approve the minutes of the May 20, 2020 Budget Workshop, as presented. All yeas Motion passes AUDIENCE PARTICIPATION (Agenda and Non-Agenda Items) None. ADOPTION OF AGENDA Motion by Warn, seconded by Greene, to adopt the agenda as presented. All yeas Motion passes CONSENT AGENDA CCM: 06/01/2020 Page 1 of 5  APPROVED 06/15/2020 a) Approval of Schedule of Bills dated May 28, 2020, in the amount of $ 159,437.34 Motion by LaFore, seconded by Misteravich, to adopt the Consent Agenda as presented. All yeas Motion passes PUBLIC HEARING None. ITEMS FOR CONSIDERATION 1. Consideration of the Request to keep Chickens/Bradley and Keelie Rots/35966 Madison Street City Manager Moore informed Council that we received a petition from Bradley and Keelie Rots to keep four (4) egg-laying chickens on property located at 35966 Madison Street. The property in question is located on the south side of Madison Street between Ferguson and Stone. The properties to the north, south, east and west are developed with single family residences. The subject property is 0.27 acres in area. Letters were sent to the adjacent properties. Letter received from the following: Mark and Donna Smola, 69843 Stone Street – Opposed to the request Laura Winkelman, 69843 Ferguson Street – Opposed to request Keelie Rots, petitioner, 35966 Madison, informed Council that they would like to keep four (4) hens. She was a stay-at-home mom, so she would be able to maintain the coop daily. They wanted to be respectful to the neighboring properties. LaFore indicated that he felt their intentions were good, but based on this property’s location he did not feel approving this request would be in the best interest of the neighborhood. Misteravich – addressed the letters from neighboring property owners – they expressed concern with the smell from the coop. He could go either way – but he had similar concerns as expressed by LaFore. Greene – Addressed the letters received from neighboring property owners who were opposed to the request. As she indicated on past request, the current approval process CCM: 06/01/2020 Page 2 of 5  APPROVED 06/15/2020 put neighbor against neighbor – it may be time for Council to reconsider an ordinance which would give Council some guidelines to follow. Rix – Felt Council needed to address the request on a case-by-case basis. Last meeting, the request approved was on a much larger lot. This area was too small – he would be denying this request. Council needs to establish some criteria – Council may want to review the keeping of fowl within the City as the July workshop. Motion by LaFore, seconded by Warn, to deny the petition from Bradley and Keelie Rots to keep up to four (4) check hens on the property. Discussion on motion: Mark Smola, 69843 Stone, an adjacent property owner – he was against the request. He expressed concern with the noise and smell. The coop will be 40’ away from their dining room. Rix – Stated that the keeping of fowl was not against any City ordinance – Council can authorize the keeping of fowl within the City limits. Council needs to take a harder look at the keeping of fowl within the City. Vote on motion: All yeas Motion passes 2. Consideration of Special Event Request/St. Augustine Catholic Church/Procession down Main Street Motion by Greene, seconded by Allen, to approve the request received from St. Augustine Church to conduct their Procession down Main Street, beginning at approximately 7:00 a.m., on Sunday, June 14th, 2020 at St. Augustine’s Church and traveling north along Main Street to Holy Parish Church in Memphis. Discussion on motion: Rix – expressed concern with the motion approving the walk from St. Augustine’s Church to Holy Parish Church in Memphis – Council does not have authority to approve anything outside of the City limits. Motion was changed to read: Motion by Greene, seconded by Allen, to approve the request received from St. Augustine Church to conduct their Procession down Main Street, beginning at approximately 7:00 a.m., on Sunday, June 14th, 2020 at St. Augustine’s Church and traveling north along Main Street to the City limits. Consideration of Extending the Local State of Emergency due to COVID-19 City Manager Moore informed Council that one of the main reason to declare a local state of emergency is to be eligible for federal funds. Motion by Reindel, seconded by Warn, to approve extending the local state of emergency that was declared by Mayor Tim Rix on March 16, 2020 for a period of 23 days after the expiration on the original 90 day extension, until July 7, 2020. All yeas Motion passes MISCELLANEOUS MATTERS FROM THE CITY MANAGER - City Administration will be reviewing the latest Executive Order from Governor Whitmer – we may be able to open some City services sooner than expected. Administration will inform Council of any programming changes to City services. - Thanked Jason, Troy and Karen for their help with tonight’s meeting. COUNCIL COMMENTS Rix questioned if Council would need to meet to undo previous actions taken by Council, due to COVID-19. City Manager Moore explained that some City services may not be able to open, due to the current capacity limits being imposed – it may not be cost effective for the City to reopen some activities.
