Motion by LaFore, seconded by Misteravich, to adopt the Consent Agenda as presented. All yeas Motion passes PUBLIC HEARING None. ITEMS FOR CONSIDERATION 1. Consideration of Special Event Request/St. Augustine Festival Motion by Allen, seconded by Greene, to approve the special event application from St. Augustine Catholic Church to have six (6) temporary signs in conjunction with their annual parish festival on August 7th through August 9th with the following conditions: 1) The applicant shall work with city staff on proper placement of the signs to minimize any sight visibility issues. 2) The signs are allowed to be display July 27th through August 11th, 2020. All yeas Motion passes Motion by Greene, seconded by Allen, to approve the special event application from St. Augustine Catholic Church to have an across the road banner in conjunction with their annual parish festival to be displayed July 27th through August 11th, 2020 and direct the City Clerk to submit the application to MDOT. All yeas Motion passes CCM: 07/06/2020 Page 2 of 7  APPROVED 07/20/2020 Motion by Reindel, seconded by Allen, to approve the request from the St. Augustine Parish Festival to make the 13 parking spaces on Howard Street between the two church driveways handicapped parking for the St. Augustine Parish Festival on August 7th through August 9th, 2020. All yeas Motion passes Council requested that the City Manager speak with the Parish Festival Committee to insure that they maintain the correct COVID-19 CDC guidelines for gatherings. 2. Consideration of Special Event Request/Parish Kickball League Motion by Allen, seconded by Greene, to approve the special event request for the use of the Bailey Park ball field for an adult kickball league for St. Augustine & Holy Family Parishes, on Wednesdays, from July 8th through August 12th, from 6:30 pm – 9:00 pm. All yeas Motion passes 3. Consideration of Proposal on Old City Hall City Manager Moore informed Council that the proposal received from Eric Gordon was forwarded to the City Attorney. According to the legal opinion, the discussion on the sale of property must take place in open session. Although the proposal is in rough form, both the City Manager and City Attorney feel the basics of the proposal are acceptable to the City. It is essentially a five year land contract for $100,000. Eric Gordon addressed Council. They are very appreciative that the City is considering their proposal. His business has outgrown their current location and they are looking forward to creating more jobs and being given the opportunity to own a piece of the City’s history. They plan to restore the building to its original state. Motion by Greene, seconded by Allen, to approve the proposal from Eric Gordon for the purchase of 68225 Main Street for $100,000 over a five year land contract and direct administration to work with the purchaser to prepare the necessary documents for approval. Consideration of the Introduction and First Reading of Ordinance No. 156- 27/Rezoning from RM-1 to B-3/Property located on portions of 37147 31 Mile Road, 37201 31 Mile Road and 67567 Main Street. Motion by Reindel, seconded by LaFore, to give introduction and first reading of Ordinance No. 156-27; Consideration of changes to the official zoning map; to change the zoning of multiple properties located on portions of 37147 31 Mile Road, 37201 31 Mile Road and 67567 Main Street from RM-1 (Multiple Family Residential) to B-3 (General Business). All yeas Motion passes 5. Consideration of the Purchase of a new Police Vehicle Motion by LaFore, seconded by Warn, to authorize the purchase of a 2020 Ford Police Interceptor SUV in the amount of $35,674.00 with necessary added options from Signature Ford with expenses charged to the appropriate line item: Police Department equipment acquisition. All yeas Motion passes 6. Consideration of a revision to the Cemetery Rules Motion by Rix, seconded by Greene, to postpone action on this item until the July 20th meeting. All yeas Motion passes 7. Consideration of a revision to the Cemetery Headstone Guidelines City Manager Moore informed Council that the City has been receiving calls regarding the use of niche headstones for above ground cremation burials. The City’s current Cemetery rules and regulations allow for the burial of one coffin and two cremains per burial plot. The current rules also prohibit above ground level burial vaults and mausoleums. As cremation becomes more popular, there are a variety of headstones available to accommodate above ground cremation burial. Administration has evaluated the use of niche headstones and has no issues with them, provided the Cemetery rules and regulations have been properly updated. The intention would be to allow niche headstones in lieu of ground burials, or a combination thereof, but allowing no more burials per plot than is currently allowed by the rules and regulations. This conservative approach will allow administration and CCM: 07/06/2020 Page 4 of 7  APPROVED 07/20/2020 Council time to track the impact on cemetery sales and the City’s ability to maintain our cemetery. Motion by LaFore, seconded by Misteravich, to approve revising the Cemetery Rules and Regulations, as it relates to the cemetery and cremains headstone guidelines. All yeas Motion passes 8. Consideration of the Extension of the Emergency Declaration Motion by Allen, seconded by LaFore, to approve extending the local state of emergency that was declared by Mayor Tim Rix on May 15, 2020 from July 7, 2020 to September 7, 2020. All yeas Motion passes 9. Consideration of Board Appointments Motion by Greene, seconded by Warn, to reappoint Sue Kiel, to the Library Board for a two (2) year term with an expiration date of June 30, 2022. All yeas Motion passes Motion by Allen, seconded by Warn, to reappoint Denise Robson, to the Library Board for a two (2) year term with an expiration date of June 30, 2022. All yeas Motion passes Motion by Allen, seconded by Warn, to reappoint Alana Stump, to the Library Board for a two (2) year term with an expiration date of June 30, 2022. All yeas Motion passes Motion by Reindel, seconded by Misteravich, to confirm the Mayor’s reappointment of Richard Weinert to the Planning Commission for a 3-year term with an expiration date of June 30, 2023. All yeas Motion passes MISCELLANEOUS MATTERS FROM THE CITY MANAGER - The asphalt patching contractor will be in the City this week to do the asphalt repairs where the City has done catch basin rebuilds. - The Contractor will be doing the structure readjustment on Madison Street and paving this week. COUNCIL COMMENTS Rix stated that Council needs to look at the fireworks ordinance at the next workshop. CLOSED SESSION 1. Collective Bargaining Agreements Motion by Greene, seconded by Allen, to convene into closed session in accordance with Section 8 (c) of the Michigan Open Meeting Act, Public Act 267 of 1976, as amended, for strategy and negotiation sessions connected with the negotiation of a collective bargaining agreement, as requested by administration. A roll call vote was taken: All yeas (Greene, LaFore, Misteravich, Reindel, Rix, Warn, Allen) Motion passes Council recessed at 7:00 pm to go into closed session.
