State Representative Jeff Yaroch was in attendance and presented Commission

PUBLIC HEARING
A-1. TXT-03-2018/City of Richmond/Text Amendments to amend Section
5.205 of the Zoning Ordinance to allow air conditioners and
generators within the non-required side yard areas
Motion by Rix, seconded by Frank, to open the public hearing at 7:05 p.m.

City Planner Jeschke informed the Commission that the proposed text amendments
would change the zoning ordinance to allow air conditioners and generators to be placed
in the non-required side yards.
N0 written or verbal comments were received.
Motion by Moore, seconded by Frank, to close the public hearing at 7:06 p.m.

ITEMS FOR CONSIDERATION
B-1. TXT-03-2018/City of Richmond/Proposed Text Amendment to amend
Section 5.2015 (Permitted Yard Encroachments) of the Zoning
Ordinance to allow air conditioners and generators within the non-
required side yard area
Motion by Zink, seconded by Frank, to approve TXT-03-2018 (Proposed Ordinance
Amendment #156-25) which amends Section 5.205 (Permitted Yard Encroachments) to
allow air conditioner and generator units within the non-required side yard area or the
entire rear yard area.

B-2. SPR-03-2018/Dick Huvaere Land Inc/Re-review of approved Site Plan
for a vehicle storage lot in conjunction with an existing automobile
dealership/37305 31 Mile Road
City Planner Jeschke informed the Commission that the applicant was requesting a re-
review of an approved Site Plan. The original plans for a vehicle storage lot in
conjunction with an existing automobile dealership at 37305 31 Mile Road was approved

in January 2018. Since that time, the applicant has made three changes to the proposed
plan. This re-review only focuses on the three changes that were made to the previously
approved site plan.
Change #1 – The landscape buffer. The applicant has worked out an agreement with the
adjacent property owner on 31 Mile Road. The apple trees that the property owner had
wanted preserved will now be removed. The amended landscape plan now shows the 6
foot tall privacy wall being moved to the property boundary and 3 additional sunset
maple trees being planted on Mr. Brickel’s property. It also now shows only a single row
of pine trees on the parking lot side of the wall.
The City Planner is recommending that two staggered rows of pine trees planted along
the northern property boundary of the property located at 37275 31 Mile Road located
between the pr8ivacy fence and the parking spaces. The applicant has stated they are
willing to take three or four trees from the remainder of the site to add to the landscape
buffer adjacent to Mr. Brickel’s property.
Change #2 – Snow Storage Area. The amended site and landscape plans now show the
provision of three “paved” areas for snow storage along the edge of the detention basin.
The revised plans show one “paved area on the north side of the detention basin and two
“paved” areas along the west side of the detention basin.
Change #3 – Lighting. The applicant submitted a revised photometric plan dated
October 2, 2018 which indicates twenty-two (22) light poles on the site that vary in
height from 16.5 feet along the western property boundary to 27.5 feet along the east.
The individual lighting units range from 166 watts to 332 watts. This proposal has the
same number of light poles as the previous review but with a slightly different
placement.
The revised lighting plan does not conform to the height requirements in Section 14.02,
A of the Zoning Ordinance. The westernmost row is within 50 feet of residential
properties and therefore are limited to a height of 15 feet. The next two rows of lights in
the center of the site are within 300 feet of residential property and therefore cannot
exceed heights of 20 feet. In addition, the maximum lighting height allowed is 25 feet.
The City Planner has serious reservations with the lighting heights that are being
proposed. The City Planner is recommending that the applicant be required to work
with City staff on a lighting plan that meeting our lighting ordinance.
Scott Riddle addressed the changes to the lighting plan. The applicant want to get more
lighting on the site and have a consistent height for all of the lights.
Brien Mendez, the lighting designer, informed the Commission that all of the lighting is
designed to dim throughout the night. The lighting poles have been raised to allow for
the lighting to reach the outer edges of the property. All of the lights will have shields on
them and be directed onto their targets.

City Planner informed the Commissioners that they could approve the revised lighting
plan.
Chairman McClellan questioned if possible our zoning ordinance was out of date and
does not take into account the new lighting technology.
Discussion on the applicant proposing higher light poles but lower footcandles – if
approved, would the Commission be setting a precedence.
Motion by Zink, seconded by Frank, to approve the requested re-review of an
approved Site Plan Review for a proposed vehicle storage lot in conjunction with an
existing automobile dealership on 6.5 acres of property located at 37305 31 Mile Road.
Some questioned by Commissioners as to what exactly we were approving.
Zink withdrew his motion.
Motion by Zink, seconded by Frank, to approve the requested re-review of an
approved Site Plan Review for a proposed vehicle storage lot in conjunction with an
existing automobile dealership on 6.5 acres of property located at 37305 31 Mile Road,
subject to the following condition:
1. The applicants lighting design as shown on the Photometric Plan dated October
2, 2018 is allowed with taller lighting fixtures so that fewer total lights are
needed, while maintaining an overall lighting intensity that is below the
ordinance standards.

MISCELLANEOUS MATTERS FROM THE CITY STAFF
City Manager Moore – Homecoming Parade on Friday October 12th.
- Cemetery Walk on Saturday, October 13th
- Fire Department Open House on Sunday, October 14th.
City Planner Jeschke – At the November PC Meeting, the Commission will be reviewing
the site plan for the Teltow condominium project – this is the final review. The City
Attorney is reviewing the Master Deed and By-Laws. Once approved by the Planning
Commission it will go to City Council for final approval.
COMMENTS FROM CHAIRMAN AND COMMISSION MEMBERS
Zink – Commented on the nice article in the Macomb Daily regarding the City’s Master
Plan.

Frank – Questioned if any fixes were planning for the bike trail. City Manager Moore
stated that he and the DPS Director would need to look at possibly putting together a
patching contract for this.
Majchrzak – Commented on rut on Main Street in front of Chaps – between the road
and the curb.
McClellan – Thanked all of the Commission members and the support and the honor he
received.
