MINUTES RICHWOOD CITY COUNCIL MEETING Monday, October 14, 2024 at 6:00 PM BE IT KNOWN THAT a City of Richwood City Council will meet Monday, October 14, 2024, beginning at 6:00 PM at Richwood City Hall, located at 1800 Brazosport Blvd. N., Richwood, Texas 77531 with the following agenda: I. CALL TO ORDER The meeting was called to order at 6:00 PM. II. INVOCATION Patricia Ditto, Finance Director, led the invocation. III. PLEDGES OF ALLEGIANCE Mayor Durham led the pledges. IV. ROLL CALL OF COUNCIL MEMBERS Michael Durham, Mayor: Present Paul Stallberg, Position 1: Present Mike Challenger, Position 2: Present Amanda Reynolds, Position 3: Present William Yearsin, Position 4: Present Jeremy Fountain, Position 5: Present Others present were Eric Foerster, City Manager; Clif Custer, Public Works Director; Kirsten Garcia, City Secretary; Tricia Ditto, Finance Director; Police Chief Stephen Mayer; and Phillip Knop, City Attorney. V. PUBLIC COMMENTS Bob Page - 101 Hummingbird - Mr. Page spoke regarding Councilman Challengers' behavior during the Council meetings and requested he resign or state he will not run for reelection. VI. CONSENT AGENDA A. Budget Report, August 2024 B. Approve a resolution updating the City's Purchasing Policy, to include language from the local government code. C. Approval of minutes from regular meeting held September 9, 2024. Motion to remove item A and approve items B and C. Motion made by Mike Challenger. Motion denied for lack of second. Motion to approve the consent agenda. Motion was made by Amanda Reynolds and seconded by William Yearsin. Voting Yea: Paul Stallberg, Mike Challenger, Amanda Reynolds, William Yearsin, Jeremy Fountain VII. PRESENTATION A. Challenge Coin presentation from Brazoria County Sheriff's Office to Councilman Will Yearsin. Councilman Paul Stallberg presented on behalf of the Brazoria County Sheriff’s Office. B. Certificate of Appreciation for Mayor Durham, presented by the Brazoria County AgriLife Extension. Kimberly Mayer, with Brazoria County AgriLife Extension, presented. VIII. DISCUSSION AND ACTION ITEMS A. Discuss and consider awarding the GLO CDBG-MIT MOD Contract No. 24-065-013-E170 to Matula and Matula Construction, Inc. Clif Custer, Public Works Director, presented. Motion to award the GLO CDBG-MIT MOD Contract No. 24-065-013-E170 to Matula and Matula Construction, Inc. Discuss any out-of-pocket costs for the City of Richwood. Discussion was held on the possibility of changing the scope. Motion to award the GLO CDBG-MIT MOD Contract No. 24-065-013-E170 to Matula and Matula Construction, Inc. Motion made by Amanda Reynolds, Seconded by William Yearsin. Voting Yea: Paul Stallberg, Mike Challenger, Amanda Reynolds, William Yearsin, Jeremy Fountain B. Discuss and consider rescheduling the regular council meeting scheduled for November 11, 2024, due to the Veteran's Day holiday. Motion to reschedule to Monday, November 4, 2024. Motion made by Amanda Reynolds, Seconded by Jeremy Fountain. Voting Yea: Paul Stallberg, Mike Challenger, Amanda Reynolds, William Yearsin, Jeremy Fountain C. Discuss, consider, and approve resolution 24-R-92 and appoint representatives for the 2025 H-GAC Board. Kirsten Garcia, City Secretary, presented. Motion to appoint Amanda Reynolds as primary and Jeremy Fountain as secondary representative for the 2025 H-GAC Board. Motion made by William Yearsin, Seconded by Jeremy Fountain. Voting Yea: Paul Stallberg, Amanda Reynolds, William Yearsin, Jeremy Fountain Voting Nay: Mike Challenger D. Discuss and appoint the 2024 Charter Review Board members. Kirsten Garcia, City Secretary, presented. Motion to appoint 2024 Charter Review Committee members Bob Page, Matt Yarborough, Lauren LaCount, and Mike Johnson. Motion made by Amanda Reynolds, Seconded by William Yearsin. Voting Yea: Paul Stallberg, Amanda Reynolds, William Yearsin, Jeremy Fountain Voting Nay: Mike Challenger E. Discuss and consider a request to allow the street closure of Audubon Woods Dr from North Mahan to Wisteria for the City of Richwood to host Trunk or Treat on October 25, 2024, from 5:00 P.M. to 9:00 P.M. Kirsten Garcia, City Secretary, presented. Motion to approve. Motion made by Amanda Reynolds, Seconded by William Yearsin. Voting Yea: Paul Stallberg, Mike Challenger, Amanda Reynolds, William Yearsin, Jeremy Fountain F. Consider items removed from the consent agenda No items were removed. IX. CAPITAL IMPROVEMENT PROJECTS UPDATE Clif Custer, Public Works Director, presented. X. CITY MANAGER'S REPORT Eric Foerster, City Manager, gave a report. XI. COUNCIL MEMBER COMMENTS & REPORTS Paul Stallberg thanked Mr. Page for coming and wished more residents would come. He also thanked Kimberly Mayer for her attendance. Mike Challenger thanked Mr. Page for coming and wished more residents would come. He also spoke regarding acting with integrity and apologized to anyone he offended. Amanda Reynolds thanked those who volunteered for the Charter Review Committee, as it’s an important task. She also hopes everyone comes out for trunk or treat. Will Yearsin thanked Mr. Page for coming out and wished more people would speak out about how they feel. He also thanked Kimberly Mayer for coming and educating him about her program. Jeremy Fountain gave a shout-out to the Chief and staff for National Night Out, stating it was a good turnout and many people came out. XII. MAYOR'S REPORT Mayor Durham thanked Mr. Page and Mrs. Mayer. He also gave a shout-out to the police and fire departments for their presence in the BCFA parade. He thanked Councilman Yearsin for his actions, which were highlighted this evening. He also thanked the staff and everyone who attended the national night out. XIII. ITEMS OF COMMUNITY INTEREST Trunk or Treat, Friday, October 25, from 6-8 PM Nextrex Recycling is still going well. XIV. FUTURE AGENDA ITEMS Fire Department Report Ethics Ordinance Discussion TikTok Policy XV. ADJOURNMENT Being there no further business, the meeting was adjourned at 6:57 PM.
