MINUTES Mayor and Council Regular Meeting February 28, 2022 6:00 P.M. CALL TO ORDER – A Regular Meeting of the Mayor and Council of the Borough of River Edge was held virtually via Zoom in the Council Chambers of the River Edge Borough Hall at 705 Kinderkamack Road, River Edge, NJ 07661. The meeting was called to order at 6:10 p.m. by Mayor Thomas Papaleo. SILENT PRAYER – FLAG SALUTE Mayor Papaleo asked for a moment of silence reflection and gratitude for all the men in blue in every community throughout the United States and for all that they do in service for those in need. The Mayor led those present in a salute to the flag. STATEMENT OF COMPLIANCE - Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification via the February 18, 2022 Sunshine Notice containing the time, date and access information to the Town News and the Record and by posting of same on the municipal bulletin board and Borough Web Site and filing a notice of the same with the Municipal Clerk. ABSENT: None ALSO PRESENT: Borough Administrator Lissette Aportela Borough Attorney Thomas Sarlo, Esq. #22-95 Approve the Promotion of Joseph Zemaites to the Position of Sergeant WHEREAS, pursuant to General Ordinances §71-1(b) entitled “Table of Organization” for the Borough Police Department, there exists three (3) vacancies in the position of Police Sergeant; and WHEREAS, the Borough seeks to promote an employee of the Borough Police Department to the position of Police Sergeant to fill such vacancy pursuant to General Ordinances §71-17 entitled “Promotion to rank of Sergeant”; and WHEREAS, after interviewing candidates on February 16, 2022 and February 17, 2022, and reviewing the results of the various portions of the promotional process, the governing body has determined to promote Patrol Officer Joseph Zemaites to the position of Police Sergeant. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of River Edge, County of Bergen, State of New Jersey, that Patrol Officer Joseph Zemaites is promoted to Police Sergeant at an annual base salary of $136,877.00 plus longevity and holiday pay, effective February 17, 2022. The Regular Meeting Resumed at 6:37 p.m. For Discussion 2021 ADA Ramp Project Lissette Aportela, Borough Administrator – stated that the Borough went out to bid for ADA Ramp Replacement Project. She explained that the ramps needed to be updated to be compliant with federal regulations and the bids are currently being evaluated by the Borough Engineer. She also explained that there is one property that has a unique situation and the property owner and Borough Engineer are here to explain the situation. She noted that there is an encroachment on the Borough right-of-way which existed prior to Ms. Zenick purchasing the home and will be impacted by this project. Robert Costa, Borough Engineer- explained that there is a rock retaining wall on the corner of 5th Avenue and Surrey Lane and hedges surrounding the property. To get the ramp in the correct location, they need to build a slight retaining wall in the Borough right-of-way. Mr. Costa explained that there is a need to remove the existing rock wall and hedges ast hey encroach into the Borough right-of-way. Ms. Zenick is requesting the Borough to replace all of the shrubs. Eugenia Zenick, 834 Fifth Avenue- said that from an aesthetic perspective, she doesn’t want to be left with half of a hedge for half of her property. She noted that she would like to have input into the work that is going to be done. She advised that she purchased the property in its current condition and was not aware of the encroachment. Borough Engineer Costa – said that only the governing body has the authority to issue a change order to construct all the way down to the driveway which is what would be required to amend the contract. Ms. Zenick- expressed hope that they can work together and come up with a solution. Mayor Papaleo-said that he and Councilman Chinigo have been members of the Land Use Board and seem to run into this a lot where owners are encroaching on Borough property. He continued to say that the issue becomes who should pay for it when it comes to illegal planting on Borough property. He noted that the taxpayers would be paying be for this request which would set a precedent. He asked Mr. Costa what the taxpayers would be charged. Borough Engineer Costa- replied roughly $5,000. Mayor Papaleo-asked the Borough Attorney to comment on the legal issues that would involved. Tom Sarlo, Borough Attorney- advised that, if a precedent is set, the same would need to be done for all homeowners. He also stated that they also can look at it on a case-by-case basis because not every situation is exactly the same. He advised that the homeowner can be required to remove the encroachment. Despite the fact that the encroachment existed when the home was purchased, it now becomes the new homeowner’s responsibility. He advised that the Borough needs to act on that encroachment to ensure that it’s not affecting the health, welfare or safety of surrounding residents. Alhtough Borough Attorney Sarlo acknowledged the homeowner’s point of view, as Mr. Costa stated, the encroachment is an issue and should be rectified. He suggested the possibility of entering into a license agreement. There was discussion regarding whether a license agreement should be drafted. Concerns were expressed about the impact of the shrubbery on the line of sight and the precedent that may be set by entering into such an agreement. The possibility of the Borough incurring the cost to remove the shrubbery was considered. It was agreed that Borough Engineer Costa is to meet with Ms. Zenick to discuss this matter further and report back to the governing body with a recommendation at the March 14th Regular Meeting. Historic Commission Meetings Lissette Aportela- reported that, although it was agreed to return to to in-person meetings effective tomorrow, the Historic Preservation Commission has requested to extend their virtual format through the next 2 months. The request came through their liaison, Councilwoman Malellari, and is a request that requires approval by the governing body. She noted that the Borough Clerk, Anne Dodd, received a similar request from the Municipal Alliance. Councilwoman Busteed -as the liaison to the Municipal Alliance, said that one member is looking for a permanent hybrid option which she understands is not permissible. Tom Sarlo- stated that, should Council wish to grant a one or two-month extension for this commission, he recommended that a definitive end date be established. He cautioned against granting an extension simply for convenience purposes. As this request is being made due to health concerns for the members of the Historic Preservaiton Commission, it was agreed that an extension is warranted. Councilwoman Busteed confirmed that the Mucicipal Alliance is not looking to pursue a hybrid format. Motion by Councilwoman Busteed, second by Councilwoman Kinsella, and all members present voting in favor, to allow Historic Preservation Commission to continue conducting their meetings virtually for 2 additional months. 2021 Open Space Project Lissette Aportela – explained that for the 2021 Municipal Park Improvement Program, an application was submitted for outdoor exercise equipment to be installed at Memorial Park and a contact was received form the County for execution. She explained that the National Fitness Campaign would also provide a grant of $30,000 should the Borough pursue the project. Before any contract is signed, she advised that it needs to be authorizerd for execution by governing body. She asked for confirmation that this project is one that the governing body would like to pursue. Mayor Papaleo- said that he thinks the majority, if not all, of Council is not in favor of doing this and asked if this funding can be reallocated. If so, he questioned what would be required and what the timeline would be. Lissette Aportela - said that funds can be reallocated and it needs to be for a municipal park improvement project. She explained that a new application would be required and the same procedures would need to be followed in order to amend the contract. Once it’s approved, a resolution would be required to authorize execution of the amended contract. Although funding would remain the same, should actual costs be less, the County would reduce funding and the balance would go back to the County. After some discussion about the need for repairs to the parks and how this funding could be used for this purpose, it was agreed that an application should be submitted to reallocate these funds. The possibility of using this funding for the hockey dashers was raised. As the purchase of the hockey dashers will most likely not utilize the full grant, it was decided that Borough Administrator Aportela, Recreation Director Baldanza, and DPW Superintendent Milito work in consultation with the Recreation Commission to broaden the scope of this project. Brookside Park will also be considered as an alternative site. The governing body is to be kept apprised via email on the recommended project for which the reallocation of funds will be sought. APPROVAL OF MINUTES – On motion by Councilwoman Kaufman, seconded by Councilwoman Busteed, with, and all members present voting in favor, that the minutes of the Mayor and Council Closed Session Meeting of February 14, 2022, Mayor and Council Special Meeting and Closed Session Meeting of February 16, 2022, and Mayor and Council Special Meeting and Closed Session Meeting of February 17, 2022 are hereby approved. PUBLIC COMMENTS ON ANY ITEM ON THIS AGENDA – On motion by Councilman Chinigo, seconded by Councilwoman Montisano-Koen, and all present voting in favor, to open for public comments on any item on the agenda. Brianne Etter, 711 Elm Ave -lives on the border of Memorial Park and has visited a location where this fitness equipment has been installed. She asked if Councilman Chinigo could send his questions regarding the National Fitness Campaign to the Recreation Commission because she never saw them. Councilman Chinigo- said that the questions were addressed to Ms. Baldanza during the budget hearing last year. He said that he and Councilwoman Montisano-Koen both had questions that did not get answered. He noted that the governing body has not seen a sketch or locations for where this equipment is to be installed. Brianne Etter- commented that she has been a physical therapist for 8 years, has seen residents asking for outdoor physical equipment and doesn’t think this is just a fad. She is hoping this can be tabled to a later date because she feels that this is something residents really want. Mayor Papaleo- said that it can be brought up for future discussion under New Business or the Recreation Commission may submit a proposal for consideration next year. APPOINTMENTS & PERSONNEL CHANGES – On motion by Council President Kaufman, seconded by Councilwoman Busteed, to approve the following appointments and personnel changes: Approve the appointment of Stefanie Butler to the Board of Health for a 3-year term through 12/31/24 effective February 28, 2022. Anne Dodd, Borough Clerk-stated that the Land Use Board has not had the opportunity to review this ordinance and suggested that it be tabled and listed for adoption at the next meeting. Mayor Papaleo-suggested it be listed for adoption on March 28th. Lissette Aportela- explained that the Fire Department ordinance was completely revised this past fall and General Code found conflicting language. She advised that this amendment is to correct the language to enure consistency. Section 33-4 entitled “Elections” is hereby amended and that those portions of the aforesaid set forth below are hereby amended as follows and that those portions of the Ordinance not set forth below shall remain unchanged: Delete: § 33-4. – Elections As stated above, to be eligible to hold any Fire Officer position a member shall comply with all applicable residency requirements, must have an average of fifty percent (50%) attendance at dispatches, drills, and meetings, as calculated per the River Edge Fire Department SOP for calculating averages, and must have been a member for at least one (1) year beyond the probationary period. Additionally, the Member must satisfy the years of service required in specified Fire Officer Positions to hold such position. NOW, THEREFORE, BE IT RESOLVED that the Chief Financial Officer is hereby authorized to refund the following to: Block/Lot Name & Address Refund 1206/4 Jack Anserian $500.00 282 Oak Avenue February 28, 2022 #22-99 Certify REA Tax Identification Statement WHEREAS, the Recycling Enhancement Act., P.L. 2007, Chapter 311, has established a recycling fund from which tonnage grants may be made to municipalities in order to encourage separation and recycling programs; and WHEREAS, there is levied upon the owner or operator of every solid waste facility (with certain exceptions) a recycling tax of $3.00 per ton on all solid waste accepted for disposal or transfer at the solid waste facility; and  WHEREAS, whenever a municipality operates a municipal service system for solid waste collection, or provides for regular solid waste collection service under a contract awarded pursuant to the “Local Public Contracts Law”, the amount of grant monies received by the municipality shall not be less than the annual amount of recycling tax paid by the municipality except that all grant moneys received by the municipality shall be expended only for its recycling program. Please make the checks payable to: ATCF II NJ LLC, TAXSERV AS CUST PO Box 69239 Baltimore, MD 21264-9239 February 28, 2022 #22-101 Amend Resolution #21-165 Authorizing the Purchase of a Ford F250 for the Police Department Under State Contract WHEREAS, the Governing Body of the Borough of River Edge adopted resolution #21-165 authorizing the purchase of a Ford F250 for the Police Department from Winner Ford through State Contract #88726 on May 24, 2021, at a cost of $39,237.00; and WHEREAS, due to supply chain issues, the 2021 Ford F250 was not available; however, the vehicles was replaced at no extra cost with a 2022 Ford F250 by Winner Ford. NOW, THEREFORE, BE IT RESOLVED that resolution #21-165 is hereby amended to reflect this change. February 28, 2022 #22-102 Approve Change Order #1 – Department of Public Works Roof Replacement Project  WHEREAS, via resolution #R19-287, adopted August 12, 2019, the Mayor and Council authorized the issuance of a purchase order for a Solargard Metal Roof to Weatherproofing Technologies, Inc., for the Department of Public Works Replacement Project in the amount of $149,884.01; and WHEREAS, N.J.A.C. 5:34-4.7 permits change orders for construction, reconstruction and major repair contracts; and WHEREAS, there is a need to consider Change Order No 1 due to the need to retain the services of another contractor to complete the project which resulted in a decrease of $25,900.00; and WHEREAS, the total amount of change orders approved to date including this change order do not exceed the originally awarded contract price by more than 20 percent; and WHEREAS, Change Order No. 1 had been reviewed and approved by the Borough Administrator. NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that it does hereby authorize Change Order No. 1, a copy of which is attached hereto. BE IT FURTHER RESOLVED that the Borough Administrator is hereby authorized to execute Change Order #1. BE IT FURTHER RESOLVED that this Change Order shall decrease the final contract price from $149,884.01 to $123,984.01 February 28, 2022 #22-103 Authorize Issuance of Purchase Order – Automated License Plate Reader WHEREAS, the Police Chief Michael Walker investigated the options to purchase an automated license plate reader (ALPR) for the radar trailer under a New Jersey State Bid contract; and WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-12, permits municipalities to purchase goods and services without advertising for bids, from companies under any contract or contracts for such goods or services entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury, commonly referred to as “State Contracts”; and WHEREAS, PIPS Neology fixed ALPR system, qualifies to be purchased using State Contract #17-FLEET-00760, from General Sales Administration of 47 N. February 28, 2022 #22-104 Authorize Issuance of Purchase Order – Radar Trailer WHEREAS, the purchase of a radar trailer for the River Edge Police Department was authorized in the 2018 capital budget; and WHEREAS, the Police Chief Michael Walker investigated the options to purchase the radar trailer under a New Jersey State Bid contract; and  WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-12, permits municipalities to purchase goods and services without advertising for bids, from companies under any contract or contracts for such goods or services entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury, commonly referred to as “State Contracts”; and WHEREAS, a radar trailer, qualifies to be purchased using State Contract #17-FLEET- 00776, from All Traffic Solutions of 14201 Sullyfield Circle, Suite 300 in Chanitlly, VA 20151, at a total cost of $16,575.00 and WHEREAS, Borough Administrator/Qualified Purchasing Agent, Lissette Aportela has verified that State Contract #17-FLEET-00776, was awarded to All Traffic Solutions on May 15, 2019, through May 14, 2023; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available for this purchase. February 28, 2022 #22-105 Confirm Emergency Purchase – Emergency Sewer Repair WHEREAS, a sanitary sewer main located nearby 211 Kinderkamack Road needed to be replaced due to risk of potential collapse; and WHEREAS, the Borough Engineer determined that this situation was an emergency affecting the public health, safety and welfare and as the collapse of this sanitary sewer main would cause a considerable sewer backup affecting the residents within the vicinity of this area; and WHEREAS, the Borough was required to contract with an outside vendor to perform the repair; and WHEREAS, J. Fletcher Creamer & Son, Inc. has responded to the emergency under the Riverside Cooperative (35-RC) contract for Emergency Water Main and/or Storm and Sanitary Sewer Repairs and performed the repair for a total contract price of $90,116.97; and WHEREAS, the NJAC 5:34-9.1 allows for the purchase of proprietary goods or services under certain conditions; and NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of River Edge hereby confirm that the Superintendent of the Department of Public Works and Borough Engineer were authorized to contract with J. Fletcher Creamer & Son, Inc. of 101 E. Broadway in Hackensack, NJ 07601 for the emergency sewer repair of the sanitary sewer main located nearby 211 Kinderkamack Road in the amount of $90,116.97 as an emergency purchase as per NJSA 40A:11-6.
